Terms and Conditions for Online Auctions

BBB AUCTIONS LLC;

The Placing of a bid shall constitute acceptance of the preceding terms and conditions.

All property is sold "as is" and "where is" all sales are final.

All property is described to the best of our knowledge; however, neither we nor our consignor's make any warranties, express or implied, with respect to such property as to the physical condition, quality, rarity, importance, authorship, provenance, medium, period, origin or estimated value of any sold lot.

No statement anywhere, whether oral or written, whether made in the catalog or advertisement, bill of sale, gallery posting, announcement or remarks by staff or the auctioneer, shall be a warranty, representation or assumption of liability. All measurements and weights are approximate.

The highest bidder acknowledged by the END OF AUCTION is the buyer.

Buyer's Premium: There is a 15% Buyers Premium applied to each lot sold with a 5% discount by paying cash.

SALES TAX: Buyers are required to pay local sales tax unless exempted by law. If exempt, buyers must file a tax exemption form with BBB AUCTIONS LLC, before any exemption can be made FL residents will be charged 7% sales tax unless exempt.

PAYMENT: Invoices will be emailed to the successful bidder after the conclusion of the auction. YOUR PAYMENT IS DUE AT TIME OF PICK UP. Due to the uncontrollable nature of the delivery of email, if you have participated in an auction, you are encouraged to inquire regarding whether you were a successful bidder or not. **Non-receipt of an emailed invoice does not preclude you from your responsibilities for payment** If we do not receive your payment on or before scheduled pick up date and time, BBB AUCTIONS LLC reserves the right resell the item.
BBB AUCTIONS LLC, ACCEPTS: Cash, Visa, MasterCard, American Express & Discover as payment for items purchased. US DOLLAR currency only accepted.

All items must be removed from the premises on the scheduled pick up date, unless prior arrangements in writing have been made. Items remaining in BBB AUCTIONS LLC'S possession after the scheduled pick up date will still be charged to the winner, and be put back into inventory to be sold again. The winner also forfeits the rights to the items and future bidding privileges.

High and low estimates are provided solely for comparison purposes and BBB Auctions LLC, makes no warranties of any kind relating to them.

A Buyer's premium amounting to 15% of the winning bid amount will be added to the purchase price of each lot. The winning bidders acknowledge and agree to pay a total of 15% or 10% by paying cash premium on top of the winning bid price in addition to the sales tax.

Payment: Payment of the winning bid amount, buyer's premium, and sales tax will be made at the time of Pick up.

*A $50 handling fee will be assessed for each declined credit card transaction and Bidder agrees to such charge*

Buyers not picking up items must contact BBB Auctions LLC, @ 941 888-2692 with credit card number to pay for their items before the close of the final pickup time. Not conforming to these terms will forfeit your items and a loss of bidding privileges.

Increasing your own bid: Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. To increase your bid, complete the maximum bid field only. You should immediately review your bids BEFORE submitting. After a bid is submitted there is no reversal of any bids. YOU ARE SOLELY RESPONSIBLE FOR THE BIDS YOU HAVE PLACED, no exceptions!!!!

Staggered Closing: The online auction closes X items every minute as specified per auction. This feature will close the bidding on intervals.

Dynamic Closing: The closing time of an item is automatically extended up to an additional 3 minutes whenever a bid is placed within the last 3 minutes of the items closing time.

To quickly review your bids and see if you have won you can utilize the 'review bids' feature. Items that have been outbid on will be clearly marked.

CAUTION: Varied equipment may be joined for demonstration purposes Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.

Catalog Inaccuracies: You are bidding on the described item not the photo occasionally the wrong photo is displayed always read the item description.

Warranty & Condition of Items Sold: All items are sold "AS IS, WHERE IS", with NO WARRANTY expressed or implied by the lot number affixed to the item. Descriptions are believed to be accurate but not guaranteed. Please bid accordingly when you are not certain of the condition or use of an item. You are bidding on the described item not the photo.

IMPORTANT! BBB AUCTIONS LLC, will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchasers, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.

BBB AUCTIONS LLC, reserves the right to add items to the auction, make changes to the auction closing times or Preview times or Pick up times.

Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator's may be entered in any court having jurisdiction thereof. Venue will be Sarasota County, Florida. Liability: Auctioneers and/or BBB AUCTIONS LLC., and Sellers liability shall be limited to the refund of bidder's purchase price.

Limitations: The above-stated Conditions of Sale cannot be altered except in writing by BBB AUCTIONS LLC.

BBB AUCTIONS LLC, AT ITS DISCRETION RESERVES THE RIGHT TO REFUSE A PAYMENT TYPE FROM ANY PURCHASERS, WINNERS ETC. FURTHER BBB AUCTIONS LLC RESERVES THE RIGHT TO ALTER, CHANGE, ADD & OR CANCEL THESE TERMS IN PART OR WHOLE AT ITS DISCRETION. BBB AUCTIONS LLC, ALSO RESERVES THE RIGHT TO BLOCK, CANCEL, SUSPEND ETC. ANY PERSON OR PERSONS ACCOUNT FOR ANY REASON IT DEEMS APPROPRIATE WITHOUT NOTICE TO THE BIDDERS, PURCHASERS ETC.

If any part or parts of these Terms & Conditions are found invalid by a competent Court within the appropriate jurisdiction than the other Terms & Conditions remain in full effect.

*BIDDER IS RESPONSIBLE FOR SUPPLYING BOXES AND PAPER AND PERSONNEL TO HELP MOVE ITEMS PURCHASED WHEN PICKED UP. *
