PREMIER AUCTION HOUSE Inc;

The Placing of a bid shall constitute acceptance of the preceding terms and conditions.

All property is sold "as is" and “where is” all sales are final. All property is described to the best of our knowledge; however, neither we nor our consignors make any warranties, express or implied, with respect to such property as to the physical condition, quality, rarity, importance, authorship, provenance, medium, period, origin or estimated value of any sold lot. No statement anywhere, whether oral or written, whether made in the catalog or advertisement, bill of sale, gallery posting, announcement or remarks by staff or the auctioneer, shall be a warranty, representation or assumption of liability. All measurements and weights are approximate.

The highest bidder acknowledged by the END OF AUCTION is the buyer.

Buyers Premium: There is a 14% Buyers Premium applied to each lot sold with a 4% discount by paying cash or check.

SALES TAX: Buyers are required to pay local sales tax unless exempted by law. If exempt, buyers must file a tax exemption form with PREMIER AUCTION HOUSE Inc., before any exemption can be made. FL residents will be charged 7% sales tax unless exempt.

PAYMENT: Invoices will be emailed to the successful bidder after the conclusion of the auction. YOUR PAYMENT IS DUE ON THE PICK UP DATE(S). WINNINGS SHALL NOT BE SHIPPED & OR TAKEN WITHOUT PAYMENT IN FULL BEING MADE. Due to the uncontrollable nature of the delivery of email, if you have participated in an auction, you are responsible to inquire regarding whether or not you were a successful bidder. **Non-receipt of an emailed invoice does not preclude you from your responsibilities for payment. If we do not receive your payment on or before scheduled pick up date and time, PREMIER AUCTION HOUSE Inc., reserves the right to move forward with any and all remedies available to us, including reporting your bad debt to any other related entities and charging your credit card on file for the full amount including shipping costs etc.,.

PREMIER AUCTION HOUSE Inc., ACCEPTS: Cash, Check and Visa, MasterCard, American Express & Discover as payment for items purchased. *** You are responsible for paying in US DOLLAR currency.

All items must be removed from the premises on scheduled pick up date, unless prior arrangements in writing have been made. Items remaining in PREMIER AUCTION HOUSE'S Inc., possession after the scheduled pick up date will be put back into inventory to be sold again while still charging you for the costs of said item's & the winner loses & / or forfeits etc., the rights to the items.

High and low estimates are provided solely for comparison purposes and PREMIER AUCTION HOUSE Inc., makes no warranties of any kind relating to them.

A Buyer's premium amounting to 14% of the winning bid amount will be added to the purchase price of each lot. **The winning bidders acknowledge and agree to pay a total of 14% for credit card payments or 10% by paying cash or check premium on top of the winning bid price in addition to the sales tax, shipping, packing & insurance costs when applicable.

Payment: Payment of the winning bid amount, buyer's premium, shipping, insurance & packing costs etc., will be made by no later than the time of Pick up. It is the buyers responsibility to calculate the costs for shipping, insurance etc.,.

***A $50 handling fee will be assessed for each declined credit card and Check transaction and Bidder agrees to such charge. ***

Terms and Conditions for pick-up are as follows, No exceptions. Anyone who does not pick up items at the designated time, will be charged a $10.00 or 15% of purchase whichever is greater. Buyers not picking up items must contact Premier Auction House Inc., @ 941 460-6459 with a credit card number to pay for their items before the close of the final pickup time. Not conforming to these terms will forfeit your items, which you are still liable for and loose bidding privileges.

In the event an item is not available for pickup, the Buyer must, notify the on site staff and file a claim by replying to your original emailed invoice noting what was not available within 24 hours of the pickup date. After 24 hours, the Auctioneer, Auction House and Buyer agree that no adjustment or refund will be made.

Increasing your own bid/Bidding Errors: Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. To increase your bid, complete the maximum bid field only. You should immediately review your bids prior to submission. We will not reverse bids - no exceptions.

Staggered Closing: The online auction closes 1 item every minute. This feature will close the bidding on intervals. This feature works great with the auto-extend feature to closely emulate a 'live' auction.

Dynamic Closing. The closing time of an asset is automatically extended up to an additional 5 minutes whenever a bid is placed within the last 5 minutes of the asset's closing time.

Bid Notification: If you have been outbid you will be notified by email ONLY UNTIL the last day of the auction --- starting at midnight EST the night before the ending of the auction notices are not sent.

To quickly review your bids and see if you have won you can utilize the 'review bids' feature. Items that they have been outbid on will be clearly marked.

CAUTION: Varied equipment may be joined for demonstration purposes. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.

Catalog Inaccuracies: You are bidding on the described item not the photo occasionally the wrong photo is displayed always read the item description.

Warranty & Condition of Items Sold: All items are sold "AS IS, WHERE IS, with NO WARRANTY expressed or implied by the lot number affixed to the item. Descriptions are believed to be accurate but not guaranteed. Please bid accordingly when you are not certain of the condition or use of an item. You are bidding on the described item not the photo.

IMPORTANT! Premier Auction House Inc., will resell, remove, store, donate, give away or dispose of, at the expense and risk of the purchasers, items not paid for and/or even if paid for not removed by the end of the specific pick up time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items etc.,.

Choose Wisely: We want everyone to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly.

The Premier Auction House Inc., reserves the right to add or remove items from the auction - split or combine lots - add minimum bids or reserve prices - cancel, suspend, extend or reschedule an individual item and or auction event - make changes to the auction closing times or inspection or removal times.

Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. Venue will be Charlotte County Florida. Liability: Auctioneers & or Premier Auction House Inc., and Sellers liability shall be limited to the refund of bidders purchase price.

Limitations: The above-stated Conditions of Sale cannot be altered except in writing by PAH.

All items are purchased AS-IS / WHERE IS.

All payments must cleared before items are to be shipped. Checks, Money Orders etc., may take up to 3 weeks or longer to clear.

PREMIER AUCTION HOUSE INC., AT ITS DISCRETION RESERVES THE RIGHT TO REFUSE A PAYMENT TYPE FROM ANY PURCHASERS, WINNERS ETC.,. FURTHER PREMIER AUCTION HOUSE INC., RESERVES THE RIGHT TO ALTER, CHANGE, ADD & OR CANCEL THESE TERMS IN PART OR WHOLE AT ITS DISCRETION. PREMIER AUCTION HOUSE INC., ALSO RESERVES THE RIGHT TO BLOCK, CANCEL, SUSPEND ETC ANY PERSON OR PERSONS ACCOUNT / BIDDING PRIVILEGES FOR ANY REASON IT DEEMS APPROPRIATE WITHOUT NOTICE TO THE BIDDERS, PURCHASERS ETC.,.

If any part or parts of these Terms & Conditions are found invalid by a competent Court within the appropriate jurisdiction than the other Terms & Conditions remain in full effect.

**BIDDER IS RESPONSIBLE FOR SUPPLYING BOXES AND PAPER AND PERSONNEL TO HELP MOVE ITEMS PURCHASED WHEN PICKED UP. BIDDER / WINNER PICKS UP THE ITEMS / WINNINGS AT THEIR OWN RISK. ALL HELP OF THE BIDDER / WINNERS PICK UP THE WINNINGS AT THEIR OWN RISK. ALL PARTIES AGREE TO HOLD PAH, ITS HEIRS, AGENTS, REPRESENTATIVES ETC., HARMLESS OF ANY DAMAGE OR INJURY ETC THAT OCCURS WHILE AT ANY LOCATION FOR ANY PREVIEW, AUCTION ETC.,.** CONSENT TO USE INFORMATION PROVIDED BY THE BIDDER: The bidder gives its express consent to use any & or all information provided by the bidder in regard to any matters, including but not limited to phone calls @ any & or phones numbers provided, along with any email, fax, text & or any & all forms of communication whether voice, electronic etc.
