Lake Country Sales Terms & Conditions
The following Terms and Conditions apply to all Lake Country Sales Online Auctions. Additional Terms and Conditions applicable to a specific auction are included on each specific auction. In consideration of the opportunity to bid at a Lake Country Sales Online Auction, and when you bid at a Lake Country Sales online auction, you, as a bidder and/or buyer as defined herein, are agreeing to these Terms and the Conditions of the specific auction. By accessing this site, you agree, without limitation or qualification, to all of the Terms and Conditions of this site user agreement.
1. All bidders must at least 18 years old, provide their full name, address, phone number, and email address, and maintain that all information is current. Lake Country Sales reserves the right to deny registration.
2. Some auctions may require credit card information to be provided for additional security. Specifics will be in the terms of the auction.
3. Bidders are responsible for bids placed on their account.
4. Inspection dates/times are available for every auction. Bidders are strongly encouraged to inspect prior to placing bids. Removal day is not inspection day. When an auction ends, the winning bidder will receive an invoice via the email provided in your account within 24 hrs. Bidders may also see whether they are the winning bidder by viewing auction after it closes.
5. All removal is at the expense, liability, and risk of the purchaser. Rights of the high bidder to purchase the item ends on the last day and time of the announced pick up time. At this time, the item(s) will be considered abandoned by high bidder.
6. Winning bidder must pay for items prior to the end of the pickup time. The pickup time is posted in each auction. Failure to pay for your items prior to end of pickup time will result in forfeiting your items and termination of your bidding rights on Lake Country Sales online auctions.
7. Items not picked up at the end of pickup time will be considered abandoned and will be disposed of by Lake Country Sales.
8. Each auction may have additional terms to include shipping options. For those bidders that want to use the shipping option, please contact Lake Country Sales.
9. When shipping is available, Lake Country Sales charges a $15 handling fee for all items purchased by the winning bidder. This will be collected with the invoice collection. Lake Country Sales will deliver items to our local UPS store for packing and shipping. Purchaser will pay the UPS store for said packing and shipping
10. Every auction item is sold "as is, where is" with no guarantees or warranties.
11. Bidders are responsible for knowing and complying with auction terms. Once a bid is placed, it cannot be retracted.
12. Sellers, and their agents, are prohibited from bidding on their own assets.
13. Items with a reserve will not be sold unless the reserve price has been met.
14. At the close of the auction, active items will remain open until no bids have been received for three minutes.
15. Applicable sales tax will be collected by Lake Country Sales.
16. If a bidder loses the right to bid on our online auctions due to non-payment/no show, a bidder may be granted the privilege to be reinstated by paying a $100 reinstatement fee plus 20% of the total invoice that wasn't paid for. The items will not become the property of winning bidder through this process. This penalty is at the discretion of Lake Country Sales and may not be granted to all bidders.
17. Cases of obvious bidding with no intent to redeem will be referred to appropriate legal authorities.
18. Payment methods accepted by Lake Country Sales are cash or credit cards only (no American Express!). Credit Cards will be accepted for invoices totaling $5.00 to $5000.00 only. Be prepared prior to pick up. Wire and Bank Checks may be granted on large items, but will be spelled out in each auction.
19. Credit card payment will have a 3% processing fee added to invoice.
20. There will be a 10% buyer's premium on all Lake Country Sales online auctions. Each auction may have additional buyer's premium information/terms.
21. Winning bidders agree to pay for the total of all purchases, plus buyer's premium, applicable sales tax (unless an ST-3 tax exemption form is provided), and 3% credit card processing fee (if paying with credit card. Additional fees may apply if purchaser is wanting items to be shipped (in accordance with Lake Country Sales shipping policy).
22. Title to items pass to Buyer when full payment for all items has been received and all items have been removed from Lake Country Sales online auction site or auction location. Upon removal of an item, risk of loss shall pass to Buyer.
23. In some instances, Lake Country Sales may agree to storing items that are fully paid for. This is on a case by case situation. Storage may be granted if potential buyer discusses option prior to bidding. Storage fees of a minimum of $10/day will be assessed, with a 7 day maximum storage length. Payment must be made at the time of payment before listed pickup time. If items are not picked up prior to the 7 day max, all items become property of Lake Country Sales. Winning Bidder forfeits any claim to items.
24. Disputes over the winning bid price or any other problem will be settled according to records kept by Lake Country Sales.
25. Potential bidders when inspecting and high bidders/purchasers or their agents acknowledge that an auction site is a potentially dangerous place. Every person enters the auction site at his or her own risk with notice of the condition of the premises and the activities that will be or have been conducted on the premises. High bidders will so advise their agents and employees. Persons attending the auction site during preview, sale or removal assume all risks of injury, damage, or loss of property and specifically release Lake Country Sales and the seller from liability.
26. The results of the auction may be rendered void if malfunction, shutdown, or temporary loss of service occurs. In such event, Lake Country Sales reserves the right to remedy the situation in whichever way best represents the seller, including the cancellation of existing bids. Lake Country Sales shall not be held liable in any way for any malfunctions, shutdowns, or loss of service.
27. Purchaser and Bidders agree to indemnify and hold harmless both the seller and Lake Country Sales from and against all claims and liabilities resulting from online auction, including but not limited to: proximate or consequential damages, failure to comply with local, state, or federal laws, and cost of legal expenses arising there from. No person shall have any claim against Lake Country Sales, their respective agents or employees for any injuries sustained or damages to or loss of property that may occur at the auction site.
28. These Terms and Conditions, and all questions with respect to the interpretation of these conditions, shall be governed and construed in accordance with the internal laws of the State of Minnesota, without regard to conflict laws provisions. In bidding, you consent to agreeing with all the Terms and Conditions stated above and any auction specific terms posted on each auctions event page and/or terms emailed to you and/or terms posted on lakecountrysales.com.

Payment Information: Lake Country Sales accepts cash or credit cards (NOT American Express) for payment. Payment must be made in person, by phone, or email prior to the end of pickup/checkout time. Checks are not accepted. Payment in full is amount of invoice which includes hammer price of items, buyers premium, and sales tax. If paying with credit card, a 3% credit card fee will be added. Shipping Information: Shipping is available on this auction. Lake Country Sales will either box items in USPS flat rate boxes if item is not breakable or bring items to the local UPS store for boxing and shipping. Lake Country Sales charges a minimal handling fee to bring items to the local Post Office/UPS store. The buyer pays Lake Country Sales/the UPS Store for packaging and shipping.
