REFUNDS AND ADJUSTMENTS - Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid.

HOOD REMOVAL REQUIREMENTS - If the hood buyer takes the fan(s) on the roof, the curbs must be left intact and covered with a formed metal cover, caulked and screwed into place. Failure to do so will result in a charge to the buyer for the necessary repairs, in addition to a revocation of bidding privileges.

WALK IN COOLER REMOVAL REQUIREMENTS - The buyer must deal with the Freon in a professional manner and not release it into the air. All electrical connections must be safely secured. Failure to do so will result in a charge to the buyer for the necessary repairs, in addition to a revocation of bidding privileges.

SPRINKLER SYSTEM REQUIREMENTS - Any damage to the sprinkler system, or damages caused by the setting off of the sprinklers, will be the responsibility of the damaging party. Failure to meet these responsibilities will result in the revocation of bidding privileges.

TERMS OF SALE - The terms and conditions for this auction are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Wester Auction BEFORE bidding. Once you place a winning bid you have entered into a legally binding contract. WARRANTY EXPLANATION - Everything is sold "AS IS, WHERE IS" without guarantees of any kind. If you bid without inspecting the item(s), then you accept FULL RESPONSIBILITY for the condition and completeness of the item(s). We do not guarantee items that do not belong to us. The seller no longer needs these items and refuses to guarantee the condition. It is YOUR responsibility to inspect items BEFORE you bid on them. INTERNET BIDDING - Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted on any item. Do not wait until the last possible second to place a bid. If an item is not on your invoice, then your bid was not the last and highest bid recorded and there is no recourse. PAYING FOR YOUR ITEMS - You may pay for your items when you come to remove them with cash or good NC check, or with a (credit/debit card - subject to a 3% processing fee). Failure to pay for your items by the end of the removal period will result in the suspension of your bidding privileges at future auctions. FAILURE TO SETTLE YOUR INVOICE - Any item(s) that are not paid for AND removed during the Stated Removal Period will result in your bidding privileges suspended for future auctions. Once the invoice has been settled, your bidding privileges will be re-instated. DESCRIPTION OF ITEMS - While descriptions and counts are believed to be accurate, they are NOT GUARANTEED. Buyers need to rely solely upon their own inspection and information. Please come to the preview. HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased. Buyers remove purchases at their own risk. Buyer's should arrange for professional de-installation of wired, plumbed or built-in items. Many pieces of equipment have potential hazards and should be de-installed and moved by professionals with proper equipment. REFUNDS AND ADJUSTMENTS - Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid. BUYER'S PREMIUM - The expenses of conducting the auction are shared between the seller and buyer. The buyer's expense is called a BUYER'S PREMIUM and is set at 10%. This is one of the lowest in the auction industry. CREDIT/DEBIT CARD PROCESSING FEE - If you choose to use a credit or debit card to settle your invoice your buyer's premium will be increased from 10% to 13% to cover the processing fees. This allows us to keep our buyer's premium as low as possible. SELLING TIMES THE MONEY - If there is a small box in the corner of the picture with an "x" and "number", then you are bidding one one unit and your bid will be multiplied by the number of units. REMOVAL SELECTION - If we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.) REMOVAL PERIOD - The scheduled removal time will be printed on the bottom of your invoice.. We do not provide manpower, tools, or equipment. PLEASE BRING YOUR OWN. Any item remaining after the SCHEDULED REMOVAL PERIOD is subject to be considered ABANDONED, with no refund or recourse to the buyer. INVOICE EXPLANATION - Your invoice will be emailed to you after the auction has been completed. The payment terms are detailed at the top of the page. The removal terms are detailed at the bottom of the page. HOOD REMOVAL REQUIREMENTS - If the hood buyer takes the fan(s) on the roof, the curbs must be left intact and covered with a formed metal cover, caulked and screwed into place. Failure to do so will result in a charge to the buyer for the necessary repairs, in addition to a revocation of bidding privileges. WALK IN COOLER REMOVAL REQUIREMENTS - The buyer must deal with the Freon in a professional manner and not release it into the air. All electrical connections must be safely secured. Failure to do so will result in a charge to the buyer for the necessary repairs, in addition to a revocation of bidding privileges. SPRINKLER SYSTEM REQUIREMENTS - Any damage to the sprinkler system, or damages caused by the setting off of the sprinklers, will be the responsibility of the damaging party. Failure to meet these responsibilities will result in the revocation of bidding privileges.
THIS IS AN ONLINE ONLY AUCTION. ALL BIDDING WILL BE DONE HERE. Triad Earthworks has several shipping containers full of tools, parts, equipment, and whatever else they brought from the old shop to the new one. They are going to be selling off one container at a time because of lack of storage space.
