The buyers will agree and acknowledge:
1) To accept the property "AS-IS" in the condition that it exists on the day of sale. As was customary several years ago, ravines were used as dumps for agricultural items used on the farms. The auction company has no knowledge that any such practice was used by any prior owner of these parcels. We have seen no evidence of any abandoned items on the property, but if exists it will be accepted by the buyer without question or recourse.
2) Real Estate Taxes due in the fall of 2019 are to be paid by the seller, the buyer will assume and agree to pay the taxes due in the spring of 2020 and all taxes thereafter.
3) To purchase the sale acreage as an estimated acreage and agree to pay the purchase price per acre multiplied by the final survey acreage to determine the final sales price.
4) This sale is not contingent upon any appraisals or subject to approval of any type of financing. The buyer will agree to purchase the real estate as is and if in any event decide not to close this real estate transaction, the buyer will forfeit the down payment to the sellers.
5) Any existing easements will remain in with the property. Additionally, a 10' underground utility easement will be reserved along the boundary lines of each parcel for the benefit of the adjoining parcels in case a utility company needs access to provide service to said parcel.

Order of Auction:
Since there is no Residence on the Farm, Tillable Land and Barn lot will be offered first.

The high bidder will have the option of taking his or her choice of any of these tracts (or any combination of these tracts). The bid price per acre will be multiplied by the estimated acreage of the total of all tracts taken to determine the estimated sales price.
B) If the high bidder only selects one, two or three of these tracts, the remaining tracts in this grouping will be offered in the same manner. This process will continue until all of tracts # 3, # 6, # 9 & # 10 have been taken.
C) After tracts # 3, # 6, # 9 & # 10 have been offered, the smaller tracts (# 1, # 2, # 4 & # 5 will be offered and will be sold by the acre. The same process will be followed as above until all of these parcels have been selected.

As was customary several years ago, ravines were used as dumps for agricultural items used on the farms. The auction company has no knowledge that any such practice was used by any prior owner of these parcels. We have seen no evidence of any abandoned items on the property, but if exists it will be accepted by the buyer without question or recourse. 2) Real Estate Taxes due in the fall of 2019 are to be paid by the seller, the buyer will assume and agree to pay the taxes due in the spring of 2020 and all taxes thereafter. 3) To purchase the sale acreage as an estimated acreage and agree to pay the purchase price per acre multiplied by the final survey acreage to determine the final sales price. 4) This sale is not contingent upon any appraisals or subject to approval of any type of financing. The high bidder will have the option of taking his or her choice of any of these tracts (or any combination of these tracts). The bid price per acre will be multiplied by the estimated acreage of the total of all tracts taken to determine the estimated sales price. B) If the high bidder only selects one, two or three of these tracts, the remaining tracts in this grouping will be offered in the same manner. This process will continue until all of tracts # 3, # 6, # 9 & # 10 have been taken. C) After tracts # 3, # 6, # 9 & # 10 have been offered, the smaller tracts (# 1, # 2, # 4 & # 5 will be offered and will be sold by the acre. The same process will be followed as above until all of these parcels have been selected. C) The larger wooded parcels (# 7 & # 8) will be offered last with the high bidder having the option of one or both parcels. If only one is selected, the final tract will be offered and the auction will be concluded. D) After all of the tracts have been offered, the Personal Representative will report to the court to confirm (or reject) the sale of the property.
