By participating in this Auction, you agree to the Terms & Conditions below. You are only allowed to participate in the auction for this aircraft if you can form a legally binding contract under applicable law. The winning bidder (the “Purchaser”) and the City of Naples Airport Authority (the “Authority”) shall enter into a Bill of Sale for the subject aircraft. The Authority and the Purchaser shall acknowledge that the aircraft is being sold “AS IS” with all faults condition with no obligation to make repairs and correct defects. The Authority shall offer no representations or warranties of any kind, express or implied. This includes, but is not limited to, warranties as to the value of the aircraft, warranties as to the condition of the property, warranties as to the merchantability of the property, or warranties for fitness for a particular purpose. The Authority shall disclaim and exclude all warranties.

Furthermore, the Purchaser shall be solely responsible for the payment of any and all applicable taxes that become due with respect to the sale of the aircraft. The Purchaser promises to insure the aircraft and have it removed from the Authority’s premises on or before November 18, 2019 (the “Removal Date”). If the aircraft is not removed from the premises by the Removal Date, the Purchaser grants the Authority permission to dispose of the aircraft as it deems fit.
