The method that produces the best offer to the seller will determine how this property sells. Property is selling subject to owner confirmation. Owners have initiated the liberty of bidding and may make adjustments accordingly. REGISTRATION

TERMS OF REAL ESTATE
The successful Purchaser(s) will sign and return a real estate sales contract immediately after the closing of bids or fully accepted offer, transfer by wire deposit 10% of the purchase price immediately after acceptance of offer. A 10% Buyer's Premium will be calculated the bid price on Real Estate then payable to Myers Jackson - Licensed Auctioneer immediately after confirmation and acceptance of offer.

BUYER'S PREMIUM

This bid may be used to determine the highest offer, if you desire you may make additional offers or bid during the process until the Agent / Auctioneer closes bidding after acceptance of a qualified offer by the seller. Bid increments shall be administered by the Agent up to the close of bidding. Opening bids will be at discretion of Agent being subject to refusal.

At bid award the buyer premium becomes property of the Auctioneer subject to immediate deposit. Purchasers may not restrict, hold or demand repayment after the confirmation of sale. In the event of collection procedures, the Auctioneer may use all lawful means necessary to collect and recover all costs and attorney's fees associated with this bid offering.

CLOSING
Time being of the essence, this sale shall be closed within 45 days of acceptance offer together with acceptable commitment to produce a regulatory insured title policy subject to permitted policy exceptions and or other required exclusions. This transaction is not contingent upon financing. Buyers will be responsible for all closing costs and may select the closing officer of their choosing. All Earnest money deposits shall be placed in escrow until closing. The Purchaser will be charged 100% cost of the title insurance policy which is based on the purchase price and 100% of all other closing costs {by purchasers closing agent} per real estate transaction per property, and this fee may include the following: conducting the closing; collecting and disbursing funds at closing; title abstract; document/deed preparation, preparing a closing statement and closing attorney fee. SPECIAL CONDITIONS OF THE SALE
1. Seller's presently have title to this Property. At the time of closing, Seller's agree to convey a marketable title to said Property by deeds as described and subject only to (1) zoning ordinances affecting said property; (2) general utility, sewer, road, and drainage easements of record; government easements, rights-of-way, covenants, restrictions, encumbrances and other matters of record, if any issued by any government agency for any use perpetual or limited by contract or deeded restrictions in all forms (3) subdivision easements, covenants and restrictions of record, if any; and (4) leases, other easements, other restrictions and encumbrances specified herein. This property is selling subject to visible easements or claims of easements not shown by the public records, shown or not shown graphically on subdivision plats or other maintained records, prescribed use easements recorded or unrecorded, boundary lines disputes, overlaps, encroachments, and any matters not of record that would be disclosed by an accurate survey and inspection of the premises. This property is being sold subject to all laws federal, state or local law concerning any species that may be listed as threatened, endangered or otherwise protected as disclosed on the plat attached. It is the responsibility of the purchaser to inspect the property and the purchaser(s) shall rely on their own investigation in conjunction with the purchase of this property. Seller shall have no obligation to extend the contract-closing period and purchaser will not be granted any inspection period after the final gavel call.

5. A detailed title search has not been conducted; therefore, Auctioneer/Broker, and Seller are not positive as to the status of the oil, gas and mineral rights. The Seller will convey any interest in any oil, gas, or mineral rights to the Purchaser unless stated in writing and any prior reservations shall stand as reserved. Furthermore, any oil, gas or mineral rights previously sold, conveyed or rescinded will not be conveyed to the Purchaser and such rights may be offered as a separate conveyance unrestricted to other purchasers.

6. Subject to roll back taxes for residential, commercial or other use including homestead exemption.

7. Purchaser will be responsible for any clean-up of debris and accepts property in the "as is" condition.

8. Property may be subject to any association dues, fees, annual costs or other assessment as required by the covenants, additionally subject to the restrictions thereof. Purchaser may be required to pay for and assume fees in conjunction with Owner Association Requirements and shall become the sole responsibility of the Purchaser.

Personal Property:
Shall include all property in the Auciton {that is not considered REAL PROPERTY} to include, but not limited to, equipment, tools, machinery, transportation surplus, collections, furniture, or any item ordered sold by Personal Representative, Bank Officials, Lending Institutions, Court Order, Trustee, Executor, Executrix, Administrator, Manager or Member of any LLC, Officer or Director of any Corporation and individual and family members appointed to sell personal property, singular or plural, single offerings or multiple items in any Auction Event.

Buyer's Premium:
Up to a 20% Buyer Premium will be added to the winning bid, subject to a minimum $12.50 minimum charge. Subject to all payment processing to include certified funds, checks, credit cards, PayPal. ALL WIRE TRANSFERS WILL BE ASSESSED THE APPROPRIATE FEE to be paid by the purchaser. Auction Fees include: 20% Buyer's Premium, Credit Card Fees (4%), and state and local taxes. Transfer fees, shipping, handling, and/or storage fees not included. Taxes are paid based on the entire transaction that equals bid + buyers premium. Tax will be added to the entire sale through price. Example: 100 x 10% = 110.00 x tax rate.

Possession of Property:
Once the property is announced sold it then becomes the property of the bidder. The bidder is then immediately responsible for the item and must make or has made all arrangements necessary to secure the item. The Auctioneer will not be responsible for security of any property sold. Any item left on the property will be subject to fines or loss. The winning bidder must make arrangements to move the property within 24 hours after bid award. All moveable items shall be paid for at the time of purchase without delay. Auctioneer is not responsible and shall not be liable for the security of any items.

Shipping:
Any item purchased will be the sole responsibility of the purchaser. The Auctioneer will not arrange shipping nor suggesting a shipper will not be guaranteed. All costs for shipping will be paid prior to any item being released in the event the Auctioneer arranges shipping. In all other cases the purchaser shall coordinate the method, time, delivery, and choice of shipper. Auctioneer is not responsible and shall not be liable for the security of any items.

Storage, Holding, Preparation, Packing:
At the option of the auctioneer, Auctioneer may store, hold, deliver, package or prepare items for delivery or shipping. Additional fees may be incurred by the purchaser in the event the purchaser elects not to pick any item in person or that does not make arranmgements. In the event the purchaser does not pick up items in the time required, holding cost of $150.00 per hour of wait time and minimum daily storage fees of 50.00 per day shall apply. All invoicing to include all bids, buyers premium, taxes, and/or charges shall apply and shall be charged to the payment method on file or may be subject to collection. Purchasers shall be responsible for all costs to collect including attorneys fees, court costs and/or any cost associated with the collecting the payment.

Payments:
All checks are subject to cash availability and Auctioneer reserves the right to hold any items until cash funds have been presented for collection. Auctioneer shall have the authority to collect payment in the form Authorized by the purchaser and purchaser shall vie permission to collect information necessary to process payments. All payments shall be collected same day. Purchaser shall pay any fees or surcharges connected with the method of payment. Credit card payments will be final and no rebates; refunds or disputes will be allowed in conncetion with the purchase. Storage, Holding, Preparation, Packing: At the option of the auctioneer, Auctioneer may store, hold, deliver, package or prepare items for delivery or shipping. Additional fees may be incurred by the purchaser in the event the purchaser elects not to pick any item in person or that does not make arranmgements. In the event the purchaser does not pick up items in the time required, holding cost of $150.00 per hour of wait time and minimum daily storage fees of 50.00 per day shall apply. All invoicing to include all bids, buyers premium, taxes, and/or charges shall apply and shall be charged to the payment method on file or may be subject to collection. Purchasers shall be responsible for all costs to collect including attorneys fees, court costs and/or any cost associated with the collecting the payment. Payments: All checks are subject to cash availability and Auctioneer reserves the right to hold any items until cash funds have been presented for collection. Auctioneer shall have the authority to collect payment in the form Authorized by the purchaser and purchaser shall vie permission to collect information necessary to process payments. All payments shall be collected same day. Purchaser shall pay any fees or surcharges connected with the method of payment. Credit card payments will be final and no rebates; refunds or disputes will be allowed in conncetion with the purchase. Buyers acknowledge that he/she have read the requirements and will sign the buyer's acknowledgement prior to delivery and transfer of property. Personal Property Purchasers will pay in full for the total transaction/purchase price on auction day in the form of Credit Card with signed authorization or PayPal invoice, cashier's check or good personal funds accompanied by a bank letter of guarantee with up to a 20% BP added, taxes added, transfer fees added. All will require certified funds and payment in full on the day of the auction immediately after the bid award with no rights to refund. All sales are final. Condition: Auctioneer will bot be responsible for the condition of any item. All property will be sold "AS IS" "WHERE IS" with any and all faults. Auctioneer will not grade the condition of the item nor cause any item to have any guarantee of condition. There will be no warranty, replacements or repairs to any item. All sales are at the risk of the buyer before, during and after the purchase. Any purchaser shall conduct his own inspection fo the item prior to purchase. Condition of Property Cont: Each item shall be subject to buyer inspection. Buyers may inect prior to bidding at appointed times or by special arrangement. Each item shall transfer in as is condition and may be subject to damage, discoloration, fractures, cracks, chips, warps or other imperfections. It is incumbant upon the purchaser to make arrangements for inspections of the property. In the event the purchaser does not inspct the property the purchaser accpets the property in the condition when the bid was placed.
