Internet Buyers: If you do not make arrangements for payment within 24 hours of auction ending, your credit card you registered with will be charged the full invoice amount , along with any associated fees.

Due to the current COVID-19 situation, there will be many deviations from our normal payment and pickup terms. In an effort to comply with government guidelines regarding social distancing and mass gatherings, we are making necessary adjustments for the health of our customers, employees, and neighbors.

All payments must be made within 24 hours of auction ending, before 5pm May 11. If we do not hear from you in this time your Credit card will automatically be charged 

Removal Info: In order to help protect the transporters, truck drivers, loaders, and employees, please be aware that we are using a strict social distancing protocol with the number of vehicles allowed in the yard is limited in full compliance with full local regulations. We will be loading items by appointment times only. Please phone ahead to schedule your removal of items. On site, have your buyer paid receipt with lot numbers available. Load out days have been extended for the inconvenience. If you show up to remove items without appointment, your loading may be delayed or not available.

YOU UNDERSTAND THAT THIS AUCTION OFFERS ONLINE BIDDING AS A CONVENIENCE TO OUR BUYERS AND SO RELIES ON DEVICES AND PROGRAMS AND INTERNET PROVIDERS THAT MAY MALFUNCTION OR BE SLOWED DOWN WITHOUT WARNING. YOU AGREE THE AUCTIONEER WILL NOT BE LIABLE FOR ANY ERROR OR INCONVENIENCE THAT MAY BE THE RESULT OF SUCH A MALFUNCTION. YOU FURTHER UNDERSTAND AND AGREE THAT THE AUCTIONEER MAY VOID OR SUSPEND AN ITEM OR RESELL ANY ITEM IF THE AUCTIONEER DETERMINES A TRANSACTION TO HAVE BEEN AFFECTED BY ANY SITE MALFUNCTION.

EK Auctioneers, LLC reserves the right to charge the credit card on file the total purchase price plus $30.00 late payment fee for invoices not paid within our terms. Business hours are Monday through Friday 8 a.m. to 5 p.m EST

Cash and wire transfers in any amount will be accepted. (International buyers see instructions below) Checks of $10,000.00 or greater will be accepted only with a bank guaranty letter or with prior approval from EK AUCTIONEERS, LLC. Credit Cards will be accepted only for charges up to $5,000.00, and only after authorization (via website or email) or in-person signatures are obtained from the cardholder. EK AUCTIONEERS, LLC reserves the right to hold assets and/or certificates of title until funds availability is confirmed.

Taxes and Titles: All Items are subject to state and local taxes.

Titles will be mailed within 10 business days after settlement.

NO TITLES WILL BE AVAILABLE AT THE AUCTION.

International Buyers - Prior to registration and at least 2 days before the auction, a deposit of $5,000 or 25% of expected total purchase, whichever is higher, must be deposited in Auctioneer's bank account via wire transfer from Buyer's bank. Deposit must be in U.S. funds. Bank receiving fee, if any, will be added to Buyer's total invoice. Payment for purchases must also be in U.S. funds via wire transfer.

ABANDONMENT POLICY

EK AUCTIONEERS, LLC provides this Abandonment Policy to inform you of our policies and procedures regarding any purchased item(s)/property that has not been removed by a buyer in a timely manner. Upon winning the bid for an item(s), after paying for item(s) purchased, a buyer is obligated to remove the item(s) from the auction site within a timely manner.

EK AUCTIONEERS,LLC may deem a buyer's failure to claim and remove equipment within 60 days following the close of an auction as evidence of buyer's intention to abandon the property. In these instances, EK Auctioneers,LLC may take action that is adverse to buyer's interest in the property, including, but not limited to steps to dispose of the property. Disposition of property may include a variety of approaches based upon the buyer's purchase price of the property as follows:

1) For those items with a final selling price of $5,000 or less, EK AUCTIONEERS,LLC will determine the appropriate disposition approach which may include:

a. Removing and disposing as the company sees fit.

b. Allowing seller to retain or scrap.

c. Sell the item(s), whereby EK Auctioneers,LLC will remit the sales proceeds to the buyer, less selling and advertising expenses, storage costs, plus 20% administrative fee.

2) For those items with a final selling price of greater than $5,000, EK AUCTIONEERS,LLC may remove the item from the selling location and resolve as follows:

a. EK Auctioneers,LLC may reimburse the seller on the buyer's behalf for storage fees of $25 per day, with the total amount not to exceed $1,500.

b. Sell the item(s), whereby EK AUCTIONEERS,LLC will remit the sales proceeds to the buyer, less selling and advertising expenses, storage costs, plus 20% administrative fee.

If a buyer has not removed the purchased item(s) from selling location within 8 business days after the close of the auction with the winning bid, the buyer will be responsible for directly paying the seller any and all storage fees if levied by the seller. If levied by the seller, storage fees will be $25 per day beginning the 10th day after the close of the auction/winning bid.
