General Terms & Conditions For Personal Property



All bidders are required to register and give full identification and establish credit with Auction Company prior to the beginning of the auction. Register early to ensure your approval for bidding by auction time. Note: To supply your credit information by telephone rather than online, please call 304-258-BIDS

Auction Company reserves the right to refuse admittance to any person(s). No transfer will be recognized from one bidder/buyer to another.

All items, whether personal property or real estate, are sold “As Is, Where Is”, with no warranties or guarantees, express or implied, made by the Seller, Auctioneer or Auction Company.

All sales are final.

You expressly agree that the use of this Website is at your sole risk, responsibility and obligation. J Lawyer Auctions LLC or its members, employees or providers warrant that this Site will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of this site, or as to the accuracy, completeness, reliability, security, or currency of the Site.

By bidding on an item, the bidder shows acceptance of the terms of the auction and acceptance of the item(s) being bid on.

No bidder shall retract their bid. Online bidding during a live auction is a fast process, and as a result, there may be no confirmation given – bids will be taken immediately and are irrevocable.

A 13% Buyer’s Premium will be added to each item sold. Please refer to the specific terms of each auction on the website information for the buyer’s premium percentage. (Example: A 13% buyer’s premium added to a $100 high bid on an item equals a total purchase price for bidder of $113).

Catalog and/or website descriptions of items or properties are for identification purposes only; no representation is made to the correctness, authenticity, age, origin or value of the item(s). Bidders must do the necessary ‘due diligence’ on the item(s) or property prior to the auction and rely solely on their own judgment when bidding.

Any and all announcements or changes made by the Auctioneer on the day of the auction supersede any prior marketing materials.

If bidder breaches or defaults any portion of the terms & conditions of auction, bidder agrees to pay any and all charges and expenses incurred by Auction Company, including, without limitation, reasonable attorney’s fees, and deficiencies and re-marketing expenses resulting from resale of the item(s) or property. Additional commission shall be due and payable.

Please note when bidding, there is an auto-extend feature on this online auction system. If someone bids in the last 2 minutes immediately prior to the end of the auction on that item, the online auction system will automatically extend the bidding time for a 2-4 minute increment (and will continue to do so) until that period(after the original closing time) where no one bids, then the auction on that item will close. This feature will leave the bidding open for any item that has received a bid within the last 2 minutes from the last recorded bid time, even if the ending time has been reached. This feature has been added to eliminate sniping and to make the online bidding process more fair and resemble a 'live' auction.



Additional Terms For Personal Property

Bidders are responsible for all removal, shipping and damage costs incurred with their items purchased. We ask you bring plenty of help and appropriate equipment for removal of your items.

In the event the buyer fails to pay for the entire purchase within the time set forth by the Auction Company, and/or fails to comply with any of the conditions or terms of sale:

the seller may retain and/or recover any monies paid as part of damages;

items that are not paid for can be resold at public or private sale without further notice;

any deficiency resulting from such resale shall be due to the Auction Company by the defaulting buyer together with all charges, fees and expenses, including reasonable attorney fees incurred by such resale and enforcement of the obligation hereunder.

Should a dispute arise after the auction, Auction Company records shall be conclusive in all respects. In an unresolved dispute case, the item(s) may be re-offered for auction; however, Auctioneer, in their sole discretion, will analyze the good faith of the parties involved and make the final determination as to the final disposition of the item(s). Auctioneer’s decision is final.

COVID-19 Information Concerning Online Auction
Dear Valued Customer, I wanted to reach out to you with an update on what actions we are taking regarding the implications of COVID-19 virus. For the safety of our customers and employees, we are making the following important changes: Our online auctions, at this time, will continue. We have implemented precautions at our auction sites and are sanitizing door handles and other surfaces customers may come in contact with. Customers who make purchases are REQUIRED to make an appointment to come and retrieve your purchases using the instructions that are provided on your paid invoices. Anyone showing up without making a scheduled appointment will not be served. All normal terms still apply to auction purchases. Please do not bid on items that you will not be able to pick up on the scheduled pickup day. Customers MUST come prepared with their own help and materials to move and load all items including furniture and large items. We will not be able to provide help. When possible, your purchases will be pre-organized and ready for you to pickup. Our staff will be utilizing sterile disposable gloves to pull all orders and for any interactions with the public. Shipping is offered in some instances for items that can easily be delivered to a local shipper. Shipping cost is solely at the expense of the customer. Once your invoice is paid, your items will be delivered to a local shipper who will contact you and make payment and shipping arrangements. At auction previews/inspections, we strongly advise our customers to bring and use disposable gloves and masks and practice social distancing. This is an unprecedented time and event we are working through as a community. We will do everything we can to continue to serve you and provide great auctions for you and we deeply value you and your business. General Terms & Conditions For Personal Property

All bidders are required to register and give full identification and establish credit with Auction Company prior to the beginning of the auction. Register early to ensure your approval for bidding by auction time. Note: To supply your credit information by telephone rather than online, please call 304-258-BIDS
Auction Company reserves the right to refuse admittance to any person(s). No transfer will be recognized from one bidder/buyer to another.
All items, whether personal property or real estate, are sold “As Is, Where Is”, with no warranties or guarantees, express or implied, made by the Seller, Auctioneer or Auction Company.
All sales are final.
You expressly agree that the use of this Website is at your sole risk, responsibility and obligation. J Lawyer Auctions LLC or its members, employees or providers warrant that this Site will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of this site, or as to the accuracy, completeness, reliability, security, or currency of the Site.
By bidding on an item, the bidder shows acceptance of the terms of the auction and acceptance of the item(s) being bid on.
No bidder shall retract their bid. Online bidding during a live auction is a fast process, and as a result, there may be no confirmation given – bids will be taken immediately and are irrevocable.
A 13% Buyer’s Premium will be added to each item sold. Please refer to the specific terms of each auction on the website information for the buyer’s premium percentage. (Example: A 13% buyer’s premium added to a $100 high bid on an item equals a total purchase price for bidder of $113).
Catalog and/or website descriptions of items or properties are for identification purposes only; no representation is made to the correctness, authenticity, age, origin or value of the item(s). Bidders must do the necessary ‘due diligence’ on the item(s) or property prior to the auction and rely solely on their own judgment when bidding.
Any and all announcements or changes made by the Auctioneer on the day of the auction supersede any prior marketing materials.
If bidder breaches or defaults any portion of the terms & conditions of auction, bidder agrees to pay any and all charges and expenses incurred by Auction Company, including, without limitation, reasonable attorney’s fees, and deficiencies and re-marketing expenses resulting from resale of the item(s) or property. Additional commission shall be due and payable.
Please note when bidding, there is an auto-extend feature on this online auction system. If someone bids in the last 2 minutes immediately prior to the end of the auction on that item, the online auction system will automatically extend the bidding time for a 2-4 minute increment (and will continue to do so) until that period(after the original closing time) where no one bids, then the auction on that item will close. This feature will leave the bidding open for any item that has received a bid within the last 2 minutes from the last recorded bid time, even if the ending time has been reached. This feature has been added to eliminate sniping and to make the online bidding process more fair and resemble a 'live' auction.

Additional Terms For Personal Property
Bidders are responsible for all removal, shipping and damage costs incurred with their items purchased. We ask you bring plenty of help and appropriate equipment for removal of your items.
In the event the buyer fails to pay for the entire purchase within the time set forth by the Auction Company, and/or fails to comply with any of the conditions or terms of sale:
the seller may retain and/or recover any monies paid as part of damages;
items that are not paid for can be resold at public or private sale without further notice;
any deficiency resulting from such resale shall be due to the Auction Company by the defaulting buyer together with all charges, fees and expenses, including reasonable attorney fees incurred by such resale and enforcement of the obligation hereunder.
Should a dispute arise after the auction, Auction Company records shall be conclusive in all respects. In an unresolved dispute case, the item(s) may be re-offered for auction; however, Auctioneer, in their sole discretion, will analyze the good faith of the parties involved and make the final determination as to the final disposition of the item(s). Auctioneer’s decision is final.

COVID-19 Information Concerning Online Auction
Dear Valued Customer, I wanted to reach out to you with an update on what actions we are taking regarding the implications of COVID-19 virus. For the safety of our customers and employees, we are making the following important changes: Our online auctions, at this time, will continue. We have implemented precautions at our auction sites and are sanitizing door handles and other surfaces customers may come in contact with. Customers who make purchases are REQUIRED to make an appointment to come and retrieve your purchases using the instructions that are provided on your paid invoices. Anyone showing up without making a scheduled appointment will not be served. All normal terms still apply to auction purchases. Please do not bid on items that you will not be able to pick up on the scheduled pickup day. Customers MUST come prepared with their own help and materials to move and load all items including furniture and large items. We will not be able to provide help. When possible, your purchases will be pre-organized and ready for you to pickup. Our staff will be utilizing sterile disposable gloves to pull all orders and for any interactions with the public. Shipping is offered in some instances for items that can easily be delivered to a local shipper. Shipping cost is solely at the expense of the customer. Once your invoice is paid, your items will be delivered to a local shipper who will contact you and make payment and shipping arrangements. At auction previews/inspections, we strongly advise our customers to bring and use disposable gloves and masks and practice social distancing. This is an unprecedented time and event we are working through as a community. We will do everything we can to continue to serve you and provide great auctions for you and we deeply value you and your business. Items not picked up or left behind shall be considered forfeited and or abandoned and subject to a minimum disposal fee $15.00 up to $40.00 and fee will be charged to the card on file. Winning bidders who have items picked up by a third party agree that the third party is a representative of the winning bidder and therefore the winning bidder is liable in and subject to any incurred fee. All auction day announcements take precedence over any previously printed material or any other oral statements made.

Please note when bidding, there is an auto-extend feature on this online auction system. If someone bids in the last 2 minutes immediately prior to the end of the auction on that item, the online auction system will automatically extend the bidding time for a 2-4 minute increment (and will continue to do so) until that period(after the original closing time) where no one bids, then the auction on that item will close. This feature will leave the bidding open for any item that has received a bid within the last 2 minutes from the last recorded bid time, even if the ending time has been reached. This feature has been added to eliminate sniping and to make the online bidding process more fair and resemble a 'live' auction.

Additional Terms For Personal Property
Bidders are responsible for all removal, shipping and damage costs incurred with their items purchased. We ask you bring plenty of help and appropriate equipment for removal of your items.
In the event the buyer fails to pay for the entire purchase within the time set forth by the Auction Company, and/or fails to comply with any of the conditions or terms of sale:
the seller may retain and/or recover any monies paid as part of damages;
items that are not paid for can be resold at public or private sale without further notice;
any deficiency resulting from such resale shall be due to the Auction Company by the defaulting buyer together with all charges, fees and expenses, including reasonable attorney fees incurred by such resale and enforcement of the obligation hereunder.
Should a dispute arise after the auction, Auction Company records shall be conclusive in all respects. In an unresolved dispute case, the item(s) may be re-offered for auction; however, Auctioneer, in their sole discretion, will analyze the good faith of the parties involved and make the final determination as to the final disposition of the item(s). Auctioneer’s decision is final.

Dear Valued Customer, I wanted to reach out to you with an update on what actions we are taking regarding the implications of COVID-19 virus. For the safety of our customers and employees, we are making the following important changes: Our online auctions, at this time, will continue. We have implemented precautions at our auction sites and are sanitizing door handles and other surfaces customers may come in contact with. Customers who make purchases are REQUIRED to make an appointment to come and retrieve your purchases using the instructions that are provided on your paid invoices. Anyone showing up without making a scheduled appointment will not be served. All normal terms still apply to auction purchases. Please do not bid on items that you will not be able to pick up on the scheduled pickup day. Customers MUST come prepared with their own help and materials to move and load all items including furniture and large items. We will not be able to provide help. When possible, your purchases will be pre-organized and ready for you to pickup. Our staff will be utilizing sterile disposable gloves to pull all orders and for any interactions with the public. Shipping is offered in some instances for items that can easily be delivered to a local shipper. Shipping cost is solely at the expense of the customer. Once your invoice is paid, your items will be delivered to a local shipper who will contact you and make payment and shipping arrangements. At auction previews/inspections, we strongly advise our customers to bring and use disposable gloves and masks and practice social distancing. This is an unprecedented time and event we are working through as a community.
