AEIT’S TERMS & CONDITIONS OF ONLINE SALES

CONDITIONS OF SALE
By placing an online order, you agree to be bound by these terms & conditions, and any additional announced terms and conditions of sale or rules of this site. Arizona law and statutes will apply to any and all legal disputes.
This Buyer Agreement(“Agreement”) is between An Estate in Time, LLC, known from this point on as AEIT, and the person or entity listed on this page (“Buyer”). Buyer agrees to be bound by the terms and conditions of this Agreement with respect to all sales conducted by AEIT. Buyer acknowledges that additional terms and conditions may be posted and/or stated and such additional terms are thus incorporated into this Agreement by this reference and are binding on the Buyer. Any participation in the online sale binds you to the agreement of the terms whether or not you read or understand said terms.
DISCLAIMER
Each lot is sold, “AS IS-WHERE IS, WITH NO WARRANTIES, EXPRESSED OR IMPLIED with all FAULTS AND DEFECTS and all ERRORS OF DESCRIPTION. All SALES ARE FINAL, WITH NO REFUNDS”. The description provided is to be used as a guide only. It is the buyer’s responsibility to determine the exact condition and value of each item they choose to buy. No allowance will be given and sale set aside on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed are sold as is and without recourse. Buyer hereby waives and indemnifies AEIT from and against any claim, demand, liability, and/or expense of any kind arising out of or related to the lot.
Buyer acknowledges and understands:
1. AEIT does not express any opinions or make any representations concerning any lot.
2. Buyer has the option to examine any lot before buying and assumes any and all risk.
3. If you are unable to view and examine the item in person, condition reports requests are strongly suggested. Condition report requests are answered in the order they are received. It is at the discretion of AEIT to respond to any request sent the days of the online sales.
4. Buyer acknowledges that he has not relied on any oral or written representations by AEIT contained in any catalogue or advertisements of any kind pertaining to the sale, including but not limited to statements concerning condition, genuineness, authenticity, provenance, prior use by owner, manufacturing, year, age, serial number, make, model or mileage, or any other component of any lot offered for sale.
5. The warranty of merchantability generally promises that the goods will conform to the ordinary standards and are of average grade, quality, and value of like goods which are generally sold in the stream of commerce. Buyer assumes all risks associated with any nonconformity of any lot or any component of any lot.
6. Buyer acknowledges that the amount paid for any lot is based solely and independently on Buyer’s own inspection and evaluation, either in person or online.
7. To participate in the sale, Buyer represents that he will conduct any and all inspections and examination necessary to satisfy himself of all material facts before buying.
8. AEIT is not liable for any issues regarding online buying.
9. AEIT reserves the absolute right to withdraw any item at any time before its actual final sale, including during the sale, without any risk of loss from buyer.
10. AEIT, at its sole discretion, reserves the right to refuse any sale from any buyer.
DISPUTES
AEIT’s designation of a buyer is FINAL. A binding contract is then created by the sale of the item. Title does not fall to the buyer until payment is made and deemed valid. AEIT’s authority ceases when the sale is complete and the purchase price has been collected. The risk of loss transfers to the shipping company, Pak Mail, for packing, shipping and delivery or to the buyer when the item is picked up, received, and signed for by buyer. If buyer refuses delivery of the property, it shall be deemed to be a breach of contract.
Buyer agrees not to join AEIT as a defendant in any action, claims or proceeding arising directly or indirectly out of the sale of or condition of the lot or any representations concerning the lot. If buyer fails to comply with this provision, buyer agrees to reimburse AEIT for all costs, expenses, and fees, including attorney fees, in defense of such claims.
LEGAL REMEDIES
Buyer waives any potential or actual conflict of interest inherent in a mediation process and agrees to defend. Buyer acknowledges responsibility for any personal injury or property damage caused by buyer and further agrees to hold harmless AEIT and seller, their respective agents, employees, and representatives for and from (a) any and all personal injury to buyer, (b) any property damage occurring on the sales premises, and any and all suits, claims, damages, costs and expenses of every kind and nature which may or might be asserted against any of them as a result of the actions or omissions of buyer. Buyer hereby acknowledges that AEIT is an Arizona company with its principal place of business in the State of Arizona.
Buyer expressly agrees that this agreement shall be construed under the substantive laws of the state of Arizona, that the state courts of Arizona shall have exclusive jurisdiction over any action brought to enforce the terms of this agreement and over any action arising out of the underlying transaction(s) with AEIT. The venue is in the Maricopa County Superior Court System of the State of Arizona, with Amendments and Integration notwithstanding.
The rights and remedies of AEIT under this agreement are cumulative and the use of any one right or remedy shall not preclude or waive the right to use any or all other remedies AEIT may have by law, statute, ordinance or otherwise. In any litigation, claims and/or proceeding arising out of or related to this agreement, buyer agrees to pay all of AEIT’s attorney fees, costs, and other expenses incurred in connection with the litigation or proceeding if AEIT is successful in such litigation or proceeding.
This agreement and related Contract of Sale contain the entire agreement between buyer and AEIT pertaining to the subject matter described therein. Any terms proposed by buyer orally or in writing which add to, vary from or conflict with this agreement shall be void.
BUYER’S FEES
The price paid by Online Buyer is the sum of:
1. Buyer’s final price.
2. All applicable sales tax.
Buyer understands and agrees he/she will be required to pay all applicable taxes, or other fees levied by any authority.
SALES TAX LAW
State sales tax law, if applicable, will be applied to all purchases and will be added to the sales price. Unless a tax resale license is provided prior to the date of the sale, the purchaser will be required to pay the combined Arizona state and local sales tax.
CONDITION OF GOODS
AEIT takes pride in accurately documenting and describing the merchandise available for sale. All damages and defects seen at the time of listing have been identified. However, not all common scratches, nicks, and wear may have been noted. It is the buyer’s responsibility to determine the overall condition of the item before buying an item, by looking at photographs, reading the descriptions and requesting a condition report. Buyer assumes all risk associated with any nonconformity of any lot or any component of any lot.
PAYMENT
Acceptable forms of payment are Credit, Debit Card, and Wire Transfer. Wire transfer is the ONLY payment accepted for vehicles, guns, fine jewelry, and fine art/sculptures priced over $2000.00. A credit card deposit of 25% of the purchase price will be accepted in lieu of cash to hold an item. The deposit shall serve as a binding contractual agreement between the buyer of the item and AEIT and shall be non-refundable should the buyer choose to default. Local checks, money orders and cashier’s checks are not accepted. Complete payment is required at the time of purchase.
SHIPPING TERMS
Local Pick up is Available. The address for pick up will be provided with the invoice sent via email for the winning buyer, as will the dates and times available for pick up. AEIT is NOT a shipping company. It is the buyer’s responsibility to take packing and shipping costs into consideration when purchasing an item online. Packing, handling, shipping and insurance are the FULL responsibility of the purchaser. Any disputes arising from shipping issues will be handled between the shipper and the purchaser.
Out of Town Shipping
For out of town buyers, once we have received your payment, your purchase will be turned over to Pak Mail, our exclusive shipping provider. Pak Mail will proactively reach out to you to arrange packing, shipping and insurance. For larger items, Pak Mail will Pack, Ship, Crate and Freight. For questions related to shipping, we strongly recommend you contact them directly for shipping questions or quotes before you buy. Please know we make absolutely NO PROFIT off the items that ship. This is a courtesy that we provide and that Pak Mail provides by coming to our location and picking up and packing any and all of your items.
