These Terms & Conditions are frequently updated between auctions, and are subject to have changed from one auction to the next. It is absolutely imperative that all bidders read & understand ALL Terms & Conditions before participating in EACH auction!

*All Public Bidders for this auction must register BEFORE 9am CST on auction day!*
Bidders registering after 9am CST on auction day may or may not be approved to buy before the live auction begins. Absolutely NO online registrations will be approved to bid after auction begins.

Public Bidders registering from outside of the general area of auction may be subject to acceptance by auctioneer, pending further verification of bidder's express acknowledgement and acceptance of all auction policies and procedures.

All Items are sold AS-IS, with no warranties, expressed or implied, except as to ownership of the items to be sold. Item listings, information, and/or descriptions provided to the bidder by Venture Auctions or The City of Memphis is deemed reliable, but not warranted, and is intended as a guide only. Bidders should inspect auction items carefully, and bid accordingly. Bidder agrees not to base a bid solely on information provided by Venture Auctions or The City of Memphis. All sales are final.

No effort has been made by the City of Memphis or Venture Auctions to inspect or verify the year, make, model, or condition, mechanical or otherwise, of any vehicle on this auction. Many vehicles could potentially run and drive; some vehicles will not. Some vehicles will have keys provided to the purchaser; many vehicles will not. Bidders should bid accordingly.

Per City of Memphis ordinance, non-licensed Individual buyers may only purchase up to 6 vehicles at the Memphis impound per calendar year. This limitiation is specific to vehicles purchased AT THE MEMPHIS IMPOUND ONLY and DOES NOT APPLY to any number of vehicles purchased at City of Memphis Surplus Auctions, or other City of Memphis auctions.
Once a buyer meets the 6-vehicle Impound purchase limit, bidding privileges at all City of Memphis Impound Auctions will be suspended until January 1 of the following calendar year. If a buyer exceeds the 6-vehicle Impound purchase limit during an Impound auction, all sales after the sixth purchase wil be nullified. Bidders may NOT choose to pay for certain vehicles, and not for others. At the sole discretion of the City of Memphis, the 6-vehicle Impound purchase limit may not apply to items sold that do not require motor vehicle registration. For instance, utility trailers, ATVs, bicycles, etc., are typically EXEMPT from annual purchase limitations. Bidders MUST pay for ALL items upon which that bidder submits a winning bid amount, subject to the aforementioned 6-vehicle Impound limit, and in the order of purchase up to that limitation. No exceptions.

The City of Memphis Impound operates in Shelby County, Tennessee. Purchasers from outside Shelby County, Tennessee bear the sole responsibilty to be knowledgeable of any applicable motor vehicle documents and/or titling processes and requirements that could affect the transfer of a motor vehicle from the City of Memphis to an individual or business located in any jurisdiction outside of Shelby County, Tennessee. Purchasers of motor vehicles at the Memphis Impound Auction will recieve a Paid-in-Full invoice from Venture Auctions, and a Bill-of-Sale/Odometer Statement from the City of Memphis. These documents are wholly sufficient for titling purposes in Shelby County, Tennessee, as defined by state and local regulations. No further documents will be offered by the City of Memphis and/or Venture Auctions. Examples of Memphis Impound Vehicle purchase paperwork will be made available to Registered Bidders upon request.

All Bill-of-Sale/Odometer Statements for purchases will be emailed to successful bidders upon receipt of same from City of Memphis staff. This paperwork is typically emailed to the buyer within two business days, but this process is not guaranteed to occur within any specific timeframe.

Full Settlement must be made Day of Sale. NO EXCEPTIONS.
Buyers may pay in-person, with cash, credit card, or certified funds, until 2pm CST on day of auction ONLY. In-person payments are recieved at the Venture Auctions trailer, located at the Memphis Impound. After 2pm CST, all remaining balances will be charged to buyer's credit card on file as entered at registration. ANY declined credit card transaction WILL result in an immediate ban for that bidder from attending or participating in ANY future Venture Auctions live, online, and webcast auctions. NO EXCEPTIONS.

10% Buyers Premium applies to all purchases. An additional 3% convenience fee applies to all credit card payments.

Buyer is 100% responsible for the removal of any purchased vehicle(s) from auction site.
All purchases should be removed from the Impound lot within 24 hours. NO EXCEPTIONS. Vehicles remaining on lot after 48 hours will be subject to re-impounded, with the buyer subject to forfeiture of entire purchase price, including fees, at the sole discretion of the City of Memphis.
Neither Venture Auctions nor the City of Memphis will assist with vehicle removal in any way. Repairing and/or working on vehicles in any capacity is strictly prohibited on City of Memphis property. If a purchased vehicle will not drive properly as-is, then that vehicle must be removed from lot by a city-approved towing company. Buyer must show paid invoice in order to remove vehicle(s) from lot. No more than ONE PERSON PER INVOICE will be allowed onto auction lot to remove vehicle. Contact the Memphis Impound Lot for a list of all approved towing providers.
The City of Memphis reserves the right to add, delete, or alter any item prior to the opening of live/webcast bidding. Prebids will not be recognized on any vehicle/item that is removed from auction prior to opening of live/webcast bidding. Auction items left on City of Memphis property after the auction are the sole responsibility of the buyer. Neither Venture Auctions nor the City of Memphis will recognize any claims for theft, damage, or loss once the item has been awarded.

In the event of a tie-bid between online bidders, the tie goes to the first bid recieved. In the event of a tie-bid between any online bid and any live bidder during the live webcast auction, the tie goes to the onsite bidder. Auctioneer's decision is final and binding on all parties in the event of any dispute. Bidder's acknowledgement of this stipulation and consent to abide by it, and all other terms & conditions of this sale, are implied by bidder's decision to register for and participate in the auction, and expressed by bidder's acknowledgement and acceptance of these terms and conditions at the time of registration.

Announcements on day of auction take precedence over any printed or previous information.

Bidders may inspect auction items onsite from 12-3pmCST on Tuesday, subject to specific Covid-19 distancing and safety guidelines(proper masks required, 10-person limit in auction lot, 30 minutes max. per person). NO public bidders may be onsite during auction; ALL public bidding is ONLINE ONLY.
