Conditions of Sale
Before bidding on-site, online or at any Mountain City Realty & Auction, LLC (MCR&A) sale, you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you sign your Bidder Registration Agreement or click the "accept" button online, you enter into a binding legal agreement with MCR&A.
Any information supplied by any employee or agent of MCR&A, in any form whatsoever, is intended solely as general guidance on the use of Online Bidding Services and the buying and selling of lots at MCR&A sales. REMEMBER: We represent the seller.
MCR&A offers no guarantees or warranties-expressed or implied. Of any nature whatsoever as it relates to the lots offered at any of our sales. Should there be any remaining manufacturer’s warranty, it is up to you as the buyer to obtain satisfaction from the manufacture. Each and every lot at MCR&A Is sold "AS IS, WHERE IS”. Where there is an opportunity to preview a sale, we strongly encourage you to attend the preview. Regardless, it is up the buyer to determine the value and condition of each item, even if there is not a preview offered or you failed to attend. Feel free to contact us if you need additional information on a particular item. Ultimately, it is up to the buyer to determine the condition before you bid. Once you bid, you are committed.
Associate Disclosure:
We are auctioneers, not authenticators. We do our best to describe as best we can, based on our research, education and overall market experience. It is ultimately up to you, the buyer to determine what you are buying and how it may be used and how much you should pay for it.
Firearms:
We do not have firearms tested before selling them. With today’s high-power ammunition, we strongly recommend you have a gunsmith or otherwise qualified firearms expert checkout your firearm purchase before discharging the weapon. There is no opportunity to test-fire a weapon in this sale. Furthermore, we will not allow ammunition to be loaded into a weapon or clip.

Indemnification:
You agree to indemnify, defend and hold harmless MCR&A and its clients, consignors, employees, agents, affiliates, successors, officers, directors and assigns from and against any and all claims, demands, losses, damages, liabilities, costs and expenses, including attorney fees, arising out of or relating to any claim or action based upon your use of internet bidding or live auctions or other sales or your otherwise breach of this agreement.

As previously mentioned, all property real or personal, sold "AS IS-WHERE IS” and neither MCR&A nor the Consignor(s) makes any representation of warranty, expressed or implied, as to the merchantability, fitness, or condition of the property or as to the correctness of description, genuineness, attribution, provenance or period of the property or any use or repurpose of a particular item. No reference to imperfections is made in the catalog descriptions or verbally by the Auctioneers. Since all sales are final and MCR&A make no refunds, please carefully review the descriptions, then verify the information to your satisfaction before you bid.
Contract:
Before bidding on-site, online or by proxy at an MCR&A, you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you sign your Bidder Registration Agreement or click the "accept" button online, you enter into a binding legal agreement with MCR&A of Roanoke, Virginia USA. Any information supplied by any employee or agent of MCR&A in any form whatsoever, is intended solely as general guidance on the use of online bidding services and the buying and selling of lots at MCR&A.

All lots in the Catalog will be subject to a reserve, unless otherwise indicated. A minimum reserve price may be disclosed or kept confidential as our clients desires. We as the Agent for Consignor may place bids during the auction if and when the highest outstanding bid at any time during the sale is below the reserve which may have been established on the lot being offered. Associates of MCR&A may bid and buy.
Payment:
If you win the bid, congratulations-it’s yours. If you do not want us to charge the bank card you have registered with, YOU MUST CONTACT US. Otherwise, we will charge your card. If you are picking up and paying in cash or pre-approved personal/business check, cashier’s check or money order, let us know at once. If we do not hear from you within 24 hours, we will consider the item abandoned and will charge the bank card on file including a $25.00 fee for each lot plus any additional expense required in removing the item. MCR&A reserves the right to hold purchases until checks clear the bank or authorization/verification is obtained on credit cards, cashier’s checks or money orders.
No Shipping:

We do not ship. If you require shipping, there are numerous carriers for you to contact and make arrangements. A simple internet search will result in numerous qualified shippers. If you do hire a shipper, you must make sure that shipping agent can be at the pick-up site at the appointed time. If arrangements cannot be made, please do not bid. If you need insurance, that also will between you and your shipping agent. MCR&A recommends that you contact your personal/business insurance carrier and notify them of your purchase(s). MCR&A will bear no responsibility for any mishaps or loss due to shipping, fire, theft or any reason whatsoever natural or man-made.
Premium:
A Buyer’s Premium, unless otherwise mentioned, will be added to the high bid to determine the final sales price. Example: $100.00 x .15 = $115.000.
Taxes

We sell locally. We work from Roanoke County, Virginia USA. We collect 5.3% percent sales tax to all bidders. If you are a merchant, farmer or otherwise sales tax exempt, it is your responsibility to furnish us with the proper Virginia state forms. Otherwise, we will collect the sales tax.
