  Mi tax of 6% added to all final bids.  Any company seeking tax exempt status must have their paper work in prior to auction end.  Any late tax exempt submissions will take effect for the next auction.

Out of area bidders, we can ship smaller items to you for a fee.  If you purchase larger items, you will have to arrange your own ltl shippers to pickup during scheduled pickup hours.

  Addition to or withdrawal from sale - the auctioneer reserves the right to withdraw from sale any of the items listed.  Auctioneer also reserves the right to add or modify lots as needed.  However, a lot will not be significantly modified once a bid has been received.

  The auctioneer has the right at his absolute discretion to refuse any bid. The highest bidder shall be the buyer at the hammer price.

  Dispute between bidders - if any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the auctioneer shall be final and absolute.

  Condition of items sold - the auctioneer shall not be responsible for the correct description, authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “as is” and without recourse.

  Manner of payment - all lots are to be paid in full by cash, approved check, credit card or debit card or paypal before items may be received.  Auctioneer reserves the right to hold merchandise until a buyer’s check clears and reserves the right to not accept a check. There will be a $35.00 service charge for any check returned from the bank for any reason.  Once the auction is over and winning bidders have been notified, they may pay via paypal to the paypal email account estatE48sales@gmail.com.  Credit cards, cash, paypal vendmo  will be accepted at the pickup location.  Winning bidders will receive an invoice with their total and payment methods.  Winning bidders will be informed of the pickup location and times.

  Removal/pickup – estatE48.com hosts internet based auctions from homes throughout the area.  All items must be picked up at those locations during the scheduled pickup days and time.  Buyers may request in writing for items to be stored in n their behalf for scheduled future pickup.  In this case, a handling / storage fee will apply and must be prepaid by buyer.

  All purchases must be removed from the auction site without damaging any property and within the time stated in the auction listing. All costs, responsibility and risk of item removal shall be borne by buyer and, in every case; buyer will use prudence and care in such removal.

  
  

If, for any reason, a buyer fails to remove any winning items within the time specified, Estate 48 shall immediately have the right, but not the obligation, in its sole discretion, to resell, discard, remove or store unclaimed items at buyer’s sole risk and expense. Late pickups will incur a storage fee which will be in the auction listing. Storage fees will begin on the last day of pickup as soon as our office has closed and will be charged at the beginning of each day thereafter-- including the weekend. Storage fees must be paid at the time of pickup and payment. All fees are non-negotiable and will not be withdrawn for any reason.

  In the event purchases are scheduled for local delivery, auctioneer shall not be responsible for goods damaged in transit or goods not removed within the time specified, and shall have the option of removing and storing or reselling at the expense and risk of the purchaser any article purchased but not removed in a timely manner. No lot may be taken from Estate 48 auctions until paid in full and checked out in writing by auction staff and customer.  Pickup dates and times for the current auction are listed in the auction description.

  Claims - no claims will be allowed after goods are removed from premises.

  Personal and property risk - persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the auctioneer from liability therefore. Neither the auctioneer, the home owner nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held.

  Records - the record of sale kept by the auctioneer and clerk will be taken as final in the event of any dispute.

  All lots - to be sold as is, where is. All sales final.

  This sale is being conducted pursuant to section 2328 of the uniform commercial code and section 53.5 of the penal code.

The seller, their agent or Estate 48 reserve the right to bid on the seller's item in order to protect their investment or reserve bid. Sellers will be responsible for all fees associated with buying back and listing their items. There are no discounts for buying back your items.
