The terms of sale are non-negotiable. Registering to bid either live, online or absentee signifies your acceptance of the terms. Your bid is a binding agreement. Do not place a bid unless you intend to honor it.
Inspection: All items are located at Heritage, 6877 Gadsden Hwy, Trussville AL 35173. Inspection of firearms/ammo is 9am-6pm, Fri November 5th ONLY. Inspection of coins/jewelry/vehicles is 9am-6pm, Mon-Fri November 1st-8th. You are advised to inspect items BEFORE bidding. We do our best to describe and photograph items, but we are by no means perfect and may miss something that is important to you. If the item was tested, it will say so in the description - time does not allow for testing of most items.
General: 'AS IS, WHERE IS, WITH ALL FAULTS'. Full Payment due at end of auction. Area sales tax collected (Alabama State, Jefferson County) - 0% on coins, 2.75% on vehicles/motorcycles, 6% on all else. Dealers present your resale certificate to avoid sales tax. All times stated are Central. Bid retraction will result in suspension of bidding privileges. No international bidders accepted without prior approval from Heritage.
Removal: Buyers are responsible for removal of purchases from auction site. Buyers must provide their own moving equipment and personnel. Appointments are required for pickup and are available 3pm-6pm Tues November 9th, 9am-6pm Wed-Fri November 10th-12th, and 10am-2pm Sat November 13th. NO ALTERNATIVE DATES/TIMES are available. If you do not have an appointment, the facility may not be open. All items are located at and must be picked up from Heritage, 6877 Gadsden Hwy, Trussville AL 35173. Each item left past this deadline will be considered abandoned and will be immediately resold with no notice or credit given to you. You must present a printed copy of your PAID receipt to pick up items (PAID receipt available at front office). Forklift driver is available. The link to sign up for a pickup date/time will be included in your invoice email.
Forms of Payment: (A) If you wish to pay by CASH or CERTIFIED FUNDS, you must notify us of your intent no later than Fri November 12th at 4pm, otherwise your credit card on file will be charged. Then we must receive your Cash or Certified Funds payment by Sat November 13th at 4pm, otherwise your credit card on file will be charged. All requests to pay in cash will be acknowledged - if you don't receive an acknowledgement then we have not received your request. (B) VISA, MASTERCARD, DISCOVER, AMERICAN EXPRESS. Card must be present and in users name. Bidder waives their right to initiate a charge-back on their credit card for any reason. In the event of large internet credit purchases and to reduce credit card fraud, Heritage will require copies of the Bidder's driver's license and credit card front and back. Credit cards are not accepted in the case of purchases of $500 or more in silver or gold that is to be shipped - wire transfers are the preferred method of payment in these instances.(C) If you wish to pay by WIRE TRANSFER you must notify us of your intent no later than Fri November 12th at 4pm, otherwise your credit card on file will be charged. Then we must receive your Wire Transfer confirmation by Sat November 13th at 4pm, otherwise your credit card on file will be charged. Keep in mind that most bank's wire departments are not open on the weekend. (D) If you wish to pay by PERSONAL/COMPANY CHECK, you must notify us of your intent no later than Fri November 12th at 4pm, otherwise your credit card on file will be charged. Then we must receive your Check payment by Sat November 13th at 4pm, otherwise your credit card on file will be charged. Heritage accepts Checks ONLY with a verifiable Bank Letter of Guarantee. Letter must contain wording that your bank will "guarantee payment" of your check. This is not the same as a letter of available funds or of good standing. We will need to receive the letter during banking hours, when we can verify it through a publicly published number or your items will be held until the letter can be verified. If you cannot meet these requirements, please choose another form of payment. Sample Guarantee Letter (NOT same as letter of available funds or of good standing): As a customer of our bank, we will guarantee payment of (insert customer name here)'s checks drawn on account #_____ not to exceed the aggregate amount of $_____ for purchases at the auction of Heritage Realty & Auction Co Inc ending on November 9, 2021.
ONLINE Buyer's Premium & Convenience Fee: For all ONLINE bidders, a 13% internet premium will be added to all items, with a 3% discount for cash, guaranteed check, wired or certified funds only. It is assumed that most internet bidders will be using their credit/debit card on file.
Titled Vehicles: There is a $25 Doc Fee for all titled vehicles (lot descriptions indicate if titled). Your title application will be mailed to you within 10 business days, unless otherwise stated in the item's description. If you are a dealer or an out-of-state purchaser, your title will be mailed to you within 10 business days, unless otherwise stated in the item's description.
Firearms: Buyers are responsible for knowing the rules and regulations of the state in which they live pertaining to the ownership of firearms. ALL SALES ARE FINAL! If a firearm is purchased and the background check is deny or the firearm cannot be shipped to the buyer's state, the buyer is still responsible for payment of said firearm and the firearm will be sold at our next scheduled firearm auction and under normal contract. Descriptions are based on a visual inspection of the item. We have made no examination of any internal mechanical workings or firing mechanisms. You should have your firearms inspected and serviced by a qualified gunsmith. Firearms must be pickup up in person (pistol/revolver pickup available only to AL residents) or shipped to the FFL Licensee of the buyer's choice. All shipping and insurance will be charged to the buyer and is calculated as the actual cost of shipping plus insurance at the USPS published rates. No firearm will be shipped until a signed copy of the appropriate FFL license is emailed or faxed to Heritage Realty & Auction Co Inc. CA/NY residents, your state will not allow you to own certain firearms so please check the list of approved items BEFORE bidding.
Background checks are required for all pistols, revolvers, rifles and shotguns. Baxkground checks are not required for bb/pellet or black power firearms.
Ammo/Powder/Primer: PLEASE KEEP IN MIND WHEN PURCHASING AMMUNITION THAT IT IS HEAVY AND THAT THE SHIPPING MAY EXCEED THE PURCHASE PRICE. Shipping for ammo/powder/primer is only available through UPS. AK and HI will not allow us to ship ammo/powder/primers.
Coins: We do not clean coins - you see them as they came to us.
Silver & Gold: Credit cards are not accepted on purchases of $500 or more of silver or gold that is to be shipped. Wire transfers are the preferred method of payment in these instances.
Shipping: Is available on most small items that can be shipped by USPS or UPS/FedEx Ground. No shipping quotes are given prior to the auction. Shipping will be at the carrier's published rates plus insurance plus any handling fee stated in the item's description. Whenever reasonably possible, we will combine shipping and use the most economical shipping method. If you prefer to use your own shipper account, you may email us the labels - please request the box weight and dimensions before ordering your labels, PLEASE KEEP IN MIND WHEN PURCHASING ITEMS THAT ARE HEAVY OR ODD SHAPED, THAT THE SHIPPING & HANDLING MAY EXCEED THE PURCHASE PRICE. Note that just because we CAN ship an item, doesn't mean that the cost to ship will be feasible. Heritage is not responsible for breakage or loss during shipping. If you want coverage, you must purchase insurance at the time of shipping. All claims must be taken up with the carrier. Art will only be shipped without frames and glass, unless otherwise requested.*** NOTES ON FREIGHT SHIPPING: You may arrange for your own freight shipping and we will coordinate with them. If your item requires a pallet, you will be charged for the cost of the pallet. Double pallets are quoted as needed. *** NOTES ON PRIVATE CARRIER SHIPPING: No shipping offered by Heritage for any items which are required to be shipped by private carrier. If you wish to directly arrange for your own shipping on these type items, we will be glad to coordinate with your shipper.
