PLEASE READ CAREFULLY. These terms and conditions cannot be altered or changed in any way except in writing by the auctioneer. If you cannot follow these terms 100%, you are welcome to stay as a spectator, but do not bid.

USA BIDDERS ONLY: Buyers outside of the USA, do not register, do not bid. We do not offer shipping outside of the United States of America.

BUYERS PREMIUM: A 15% buyers' premium is added to the final invoice price. If your winning bid is $100, you will be charged $115 (plus sales tax and/or shipping where applicable).

REGISTRATION: You must be at least 18 years old to register and participate in this sale. In order to bid, you must create a username and password. You agree that all information provided during registration is true, accurate and up to date.

AUCTION FORMAT: This is an online only auction. Bids can be placed online for the period of days indicated. Lots will close at staggered times, 30 seconds apart. If a bid is placed within 1 minute of the scheduled auction close, an addition 1 minute will be added to the bidding for a soft close on that item. If you place a bid in this sale, and your bid is determined to be the winning bid, you become obligated to pay for the item(s) that you have won at the price you gave as your bid.

ALL SALES ARE FINAL: No returns or exchanges are accepted. Once the item is sold, the winning bidder becomes the new owner of the item and has effected a legally binding contract which cannot be altered or voided. Additionally, bids cannot be changed or cancelled once submitted.

NO WARRANTIES: All items are sold as is, where is without warranties or guarantees, expressed or implied as to the quality, character or condition.

INSPECTION: The buyer agrees to rely exclusively on his/her personal inspection of the property through photos provided. Photographs are an important part of the item description.

SETTLEMENT: High bidders' will be invoiced in U.S. dollars and credit cards provided at registration will charged within 24 hours of the close of the sale. Buyer agrees that valid credit card information has been provided, you will accept all charges and that you will not charge back any charges placed by the auction company in accordance with fees discussed throughout the terms and conditions (ie high bid, buyer's premium, no-show and late show fees).

NO APPOINTMENT IS NECCESSARY, BUT YOU MUST SHOW UP DURING HOURS PROVIDED. NON-MICHIGAN Residents cannot pickup hand guns at Todd's Guns LLC. They must delivered or shipped by Todd's Guns to an FFL license holder in your state. SEE BELOW FOR OHIO LOCAL PICKUP OPTION. ADDITIONAL FEES ALSO LISTED BELLOW.

PICKUP TIMES LOTS 9-31 (non-firearms) : Monday, December 6th from 11am-3pm and Tuesday, December 7th from 4:30pm until 8:00pm BY APPOINTMENT ONLY (appointment link will be provided to high bidders). No show for pickup or late pickup will have a $10 fee. Buyer understands that Items not picked up during scheduled pickup time are considered abandoned and becomes the property of Montrie Auction & Estate Service L.L.C. Any such items will be resold or disposed of without any reimbursement or refund to the buyer.

SHIPPING lots 1-8 (firearms): ALL SHIPPING ARRANGEMENTS MUST BE MADE IMMEDIATELY through Todd's Guns

SHIPPING lots 9-31 (non-firearms): Montrie Auction will ship some, but not all, of the non-firearm lots (9-31) as indicated in each lot. Following the close of the auction, high bidders will receive a link to indicate whether they plan to pickup locally or if they will require shipping on their purchase.

INJURY & DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by bidder or his agent, and further agrees to hold auctioneers and sellers harmless from any personal injury to himself or his agents and any property damage incurred on auction premises. All bidders and their agents enter the site, participate with the auction and remove items at their own risk. Additionally, buyers are responbile for any damage caused by themselves or their agents to the property during removal and also agree that the credit card provided will be charged for any expenses incurred and/or repairs necessary as a result of any damage you cause. Professional removal is recommended.

CHANGE WITHOUT NOTICE: Auctioneer reserves the right to modify or cancel lots and extend or change close dates. Additionally, Montrie Auction reserves the right to extend an auction that may have already closed but was not online at the time of closing due to technical problems, system outages, etc. Auctioneer reserves the right to remove items from the sale without notice, including items that have already received a bid.

CLAIMS: Any claims or disputes arising out of these terms and conditions or this auction will be settled in Lucas County, Ohio.

ADDITIONAL FIREARM TERMS:
All firearms will be handled through Todds Guns located at: 8019 Summerfield Rd, Lambertville, MI 48144. Their phone number is (734) 568-6030 to make arrangements for out of state shipping.

ADDITIONAL FEES APPLY:
LOCAL PICKUP FOR MI RESIDENTS & LONG GUN): Background check/transfer fee: $30 (collected by Todds Guns, LLC) per firearm

LOCAL PICKUP FOR OH RESIDENTS: If buyer lives in Ohio and would like to pick up at ADCO Firearms, LLC (Sylvania, OH), Todds Guns will deliver to ADCO for a fee of $40 rather than shipping. ADCO will also charge an FFL fee.

SHIPPING TO YOUR LOCAL FFL (where a background check will be performed): $60 shipped per each long gun, collected by Todds Guns, LLC. $50 shipped per each hand gun, collected by Todd Guns, LLC. Buyers must provide to Todds Guns, LLC their FFL's license and information. Buyer is responsible for all of their own fees at their local FFL. ALL SHIPPING ARRANGEMENTS FOR FIREARMS MUST BE MADE IMMEDIATELY WITH TODDS GUNS, LLC.

KNOW YOUR LAWS BEFORE BIDDING: All federal and state laws apply. FFL paperwork and passing a background check (NICS) is required, NO EXCEPTIONS. ***All buyers are 100% personally responsible for knowing if your state or jurisdiction bans/bars certain types of firearms, magazines and/or accessories.*** IF YOU ARE NOT SURE OF THE ABOVE, DO NOT PARTICIPATE IN THIS AUCTION.

AGE REQUIREMENTS: You must be at least 18 years old to purchase a long gun and at least 21 years old to purchase a hand gun.

BID ONLY ON YOUR OWN BEHALF: It is unlawful to purchase a firearm for someone else. The same person who registered to bid, must also be the same person to pay for and take possession of the firearm. This includes family members and spouses as well (they can not bid for, purchase or pickup on your behalf).

CONDITION OF FIREARMS: These firearms are part of an estate/trust where their condition and function are unknown. USE OF ANY FIREARMS PURCHASED AT THIS AUCTION IS ENTIRELY AT USER'S OWN RISK.. ALL firearms should be examined by a competent gunsmith. Montrie Auction & Estate Service, expressly disclaims any liability whatsoever for any injury, accident, dismemberment, death or any other damage caused by or to any person as a result of the purchase and/or use of these firearms.
