PLEASE READ CAREFULLY. These terms and conditions cannot be altered or changed in any way except in writing by the auctioneer. If you cannot follow these terms 100%, you are welcome to stay as a spectator, but do not bid.

USA BIDDERS ONLY: Buyers outside of the USA, do not register, do not bid. We do not offer shipping outside of the United States of America.

BUYERS PREMIUM: A 15% buyers' premium is added to the final invoice price. If your winning bid is $100, you will be charged $115 (plus sales tax and/or shipping where applicable).

REGISTRATION: You must be at least 18 years old to register and participate in this sale. In order to bid, you must create a username and password. You agree that all information provided during registration is true, accurate and up to date.

AUCTION FORMAT: This is an online only auction. Bids can be placed online for the period of days indicated. Lots will close at staggered times, 30 seconds apart. If a bid is placed within 1 minute of the scheduled auction close, an addition 1 minute will be added to the bidding for a soft close on that item. If you place a bid in this sale, and your bid is determined to be the winning bid, you become obligated to pay for the item(s) that you have won at the price you gave as your bid.

ALL SALES ARE FINAL: No returns or exchanges are accepted. Once the item is sold, the winning bidder becomes the new owner of the item and has effected a legally binding contract which cannot be altered or voided. Additionally, bids cannot be changed or cancelled once submitted.

NO WARRANTIES: All items are sold as is, where is without warranties or guarantees, expressed or implied as to the quality, character or condition.

INSPECTION: The buyer agrees to rely exclusively on his/her personal inspection of the property through photos provided. Photographs are an important part of the item description.

SETTLEMENT: High bidders' will be invoiced in U.S. dollars and credit cards provided at registration will charged following the close of the sale. Buyer agrees that valid credit card information has been provided, the card has the funds available to complete the purchase, you will accept all charges and that you will not charge back any charges placed by the auction company in accordance with fees discussed throughout the terms and conditions (ie high bid, buyer's premium, no-show and late show fees). Buyers requiring shipping (on select items), will be invoiced separately for shipping charges upon which the buyer will need to complete payment.


PICKUP: Local pickup only for this online auction; no shipping offered. LOCAL PICKUP in Toledo, OH near the Heatherdowns/Byrne area (exact address will be provided to high bidders) Pickup days will be on Thursday, December 2nd from 3pm-7pm by appointment (appointment link will be provided to high bidders). No show for pickup or late pickup will have a $10 fee that will be charged to credit card provided during registration. Items not picked up within are considered abandoned and becomes the property of Montrie Auction & Estate Service L.L.C. Any such items will be resold or disposed of without any reimbursement or refund to the buyer.

INJURY & DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by bidder or his agent, and further agrees to hold auctioneers and sellers harmless from any personal injury to himself or his agents and any property damage incurred on auction premises. All bidders and their agents enter the site, participate with the auction and remove items at their own risk. Additionally, buyers are responbile for any damage caused by themselves or their agents to the property during removal and also agree that the credit card provided will be charged for any expenses incurred and/or repairs necessary as a result of any damage you cause. Professional removal is recommended.

CHANGE WITHOUT NOTICE: Auctioneer reserves the right to modify or cancel lots and extend or change close dates.

CLAIMS: Any claims or disputes arising out of these terms and conditions or this auction will be settled in Lucas County, Ohio.
