* Per CDC guidelines: you will be required to wear a mask unless fully vaccinated, gloves will be provided, please stay home and request more pictures or call for a condition report if YOU ARE SICK or have been around anyone who has been sick.

- PAYMENT: We will run the Credit Card you register with after the completion of the auction.

* All buyers will be charged 13% buyers premium regardless of payment type. and 7.5% NYS sales tax if you are a NY buyer. If you are tax exempt you must send us a copy of your resale certificate PRIOR to auction closing, once cards are ran we cannot refund sales tax.

PICK UP: Please be aware of pick up days and pick up at those times, we need items to be removed during these times so we can set up more auctions.

No Charge for NICBC (Background) Checks

* If you fail your background check you will NOT get a refund, you can consign it to a future auction.

*NOTE: New York State law requires that a National Instant Criminal Background Check must be completed prior to all firearm sales or transfers, including sales or transfers of rifles or shotguns. The sale of transfer of a firearm, rifle or shotgun at a gun auction without first conducting a Background Check is a crime.

** If you are tax exempt you MUST notify us prior to the close of the auction, along with a copy of the form, if not you will be charged tax. We cannot remove tax once the card has been processed.

If you would like your items shipped please contact our office as soon as possible with shipping information, including your FFL (If required) Any item deemed to large to ship in house will be brought to the UPS Store at your expense.

All Ammo is shipped via UPS - no Ammo can be shipped to a NYS resident but can be shipped to an FFL near you.

Everything is sold AS IS. WHERE IS. All Sales are Final- No Returns.
Hessney Auction Co. provides ample opportunity for buyers to thoroughly inspect goods to be sold. All purchases should be made on the buyer's own recognizance. All persons bidding in absentee who have not physically inspected the goods prior to the sale are also subjected to these terms. All lots are sold "As is". There are no warranties expressed or implied, including, but not limited to warranties of merchantability or fitness for a particular purpose. Hessney Auction Co. and consigners make no guarantee or warranty as to the authenticity of the merchandise, the correctness of the catalog, nor shall any description (oral or written) of condition, size, quality, rarity, importance or provenance be deemed a guarantee.

* Condition is listed with obvious flaws, or noted if firearm are new, unfired in box. "As New" does not mean "New" it is a condition report, meaning the firearm is "as new condition". If a firearm is brand new- unfired, it will be listed as so.

* Box Lot Ammo- Please be sure to review photos & full descriptions for box lot ammo, all is sold as is. In person preview is available. Box lot ammo may contain mixed, partial or full boxes and is sold as is. The lot descriptions are meant merely as a guide and we do not guarantee the counts or descriptions described therein. We make every effort to accurately describe all items, but there is the possibility of error. Hessney Auction Company is not responsible for any errors or omissions in the description of merchandise. Buyers Premium:
All sales are subject to a Buyer's Premium; reference to the buyer's premium is made in auction advertisments, flyers and catalogs. Buyer's premium will be a stated percentage and must be paid by the buyer as part of the purchase price.

All paperwork for firearms will be done on site at no extra cost. * If you purchase a handgun that needs to be added to your pistol permit, PLEASE contact your county for information. You can print out the paid invoice we email you and bring it (or send it, whatever your county's rules are) to your pistol permit office. They will add the handgun to your permit and issue you a purchase coupon for your handgun. You will then come to pick up your hangun at Hessney Auction Center. Be sure to bring NYS pistol permit, receipt, and purchase coupon. Each county may have different hours/instructions due to COVID-19. We realize many cannot pick up the week after auction; simply make an appointment by email for Monday - Wednesday the following week (or when you receive your purchase coupon). All firearm purchases require a Federal Background Check (NICS Check) unless you have a Federal Firearms License. All pistols require a NYS pistol permit unless you have a federal firearms license. Some firearms are not NYS compliant. Read the descriptions prior to bidding. SHIPPING: If you would like your items shipped, please respond to the email we send when you recieve your invoice asking for SHIPPING and Include your name and verify address. You will not recieve a response until the item is shipped. If you purchase a firearm, please see instructions below. All shipping costs are the responsibility of the buyer. We are very busy Monday - Wednesday with local pick up. Shipments will start on Thursday, and may take 1-2 weeks. We will charge your registration credit card for your purchases. Once the shipping is calculated, we will charge your card for a second time. This process is much more convenient for us. Items typically ship within 2 weeks. For all out of state buyers, we will follow any federal regulations for shipping and amAmmo is shipped via UPS due to restrictions with USPS.
