It is the responsibility of the buyer to review any items before they bid. Top Tier Auctions and any employees or representatives make no warranty or guarantee of condition or functionality of any item being sold. We believe that all material and advertisements were made with information provided by the consigner or seller in good faith and accuracy, but we are not warranting or guaranteeing the condition or authenticity of any item sold. Please make any and all inspections before bidding so you might bid with confidence.

FEES:
- NO BUYERS PREMIUM LIVE OR ONLINE!
- If using a Credit Card, 3.54% will be added to the total price* of the invoice. *The amount charged for using the card. A wire fee of $20 will be charged for all wires.
- SHIPPING AND HANDLING FEES FOR FIREARMS ONLY. No shipping of any other items unless pre-arranged with Top Tier Auctions, LLC and Buyer assumes all expenses and tasks related to the scheduling.

Terms and Rules:
- TOP TIER AUCTIONS is providing internet prebidding, simulcast bidding, and live onsite bidding as a service to buyers for some of the items sold. Bidder acknowledge and understand that this service may or may not work on the day of the auction. Under no circumstances shall a Bidder have any kind of claim against TOP TIER AUCTIONS or anyone else associated with the sale of these items if the service fails to work correctly on the day of the sale. We cannot control service or function of the platform on the day of the sale. Any bidder should either show up the day of the sale to bid live or should turn in a proxy bid with their maximum bid atleast 24 hours before the sale to have the best possible chance of being the successful bidder and buyer of any item they wish to win.
- You must register to bid, registering to bid creates a contract between the bidder and Top Tier Auctions. He/She agrees with the Terms and Conditions by registering for a bidder number. Additional Terms which may be posted or announced from the Auction block are just as binding as the printed Terms and Conditions.
- No "Straw Purchases". The Bidder must be the actual Purchaser. You can NOT bid on firearms with the intent to purchase for someone else.

DO NOT BID IF:
- Were convicted of a crime that carried a sentence of more than one year, or a misdemeanor that carried a sentence of over two years
- If convicted of two or more DUIs within last 10 years or one DUI in last 5 years.
- Are a fugitive (i.e. there's a felony or misdemeanor warrant for your arrest)
- Are a substance abuser
- Are diagnosed mentally ill, which can include being involuntarily committed, found not guilty by reason of insanity, or found unfit to stand trial
- Reside in the US illegally
- Are dishonorably discharged from the military
- Had a restraining ordered issued against you (i.e. found guilty of harassing, stalking, or threatening a partner or the child of your partner)
- Were convicted of domestic violence (i.e. convicted of using or threatening to use a deadly weapon against a spouse, former spouse, parent, guardian of the victim, etc.)
- Have renounced your US citizenship
- You must be 18 yrs. old to purchase a Long Gun or ammunition for long guns.
- You must be 21 yrs. old to purchase pistols, ammunition for pistols, and long guns with pistol grips.

BIDDING ONLINE FOR GUNS.
All guns long or handguns will be required to be shipped to a valid FFL. If you are the winning bidder you will have to have a valid FFL email a copy of their FFL to abynum@warealtytn.com. Payment will have to be received by TOP TIER AUCTIONS. Once these terms are met we will ship the gun at YOU EXPENSE. Even if the items qualify for C&R we will still have to ship to an FFL of your choice. NO EXCEPTIONS.

ONSITE Long Gun Winning Bidder: If you are the winning bidder, you will be expected to pay the day of the sale. Once you have paid, you will take the receipt to the identified area for background checks that will be performed onsite. If you are a resident of Tennessee or live in a state that touches Tennessee, you will be able to take possession of firearm after payment. If you live in a state that does not touch Tennessee, you will have to have the firearm shipped to a valid FFL in your state of residence at YOUR EXPENSE.

ONSITE Handgun or Long Guns Classified as Hand Guns Winning Bidder: If you are the winning bidder, you will be expected to pay the day of the sale. If you are a resident of Tennessee, you will be able to take possession of the firearm after payment and background check is approved. If you are a NON-Tennessee resident, you will have to have firearm shipped to a valid FFL in your state of residence at YOUR EXPENSE.

DO NOT BID IF YOUR CAN NOT PAY OR CAN NOT PASS FFL BACKGROUND CHECK.

All Sales are final. If you are the winning bidder but fail the background check or have a pending approval the day of the sale, you will NOT be allowed to take the firearm. We will NOT refund money the day of sale. We will keep possession of the firearm and give you a reasonable amount of time for you to try and remedy the issue. If you are unable to complete the FFL background check, we will resale the item at your expense. Refunded money will then be less expense to resale the item.

VEHICLES and BOATS
All vehicles that have a valid title will be given to Buyer once funds are certified. Buyer will receive the title if paid with cash on the day of the sale. If buyer pays with Credit Card or Check, the title will be mailed within 3 weeks to the buyer once funds have cleared. TOP TIER makes no warranties or guarantees about the condition of any item sold. It is the responsibility of the buyer to come and inspect any item before bidding so that they can make the best decision of value and condition. If you are the winning bidder either online or live you will be expected to pay for the item. We will not ship any items besides Firearms. We will try and work with anyone to assist with a 3rd party shipper that the buyer hires. Please make arrangements before bidding.

GENERAL
- Inventory may be amended, updated, withdrawn or altered at any time before or during the Auction by the Auctioneer and/or the Seller. Included but not limited to the lot location in the sale, the amount of items in the sale, or a reserve for an item in the sale.
- Cash, Check or Credit Card with proof of funds will only be accepted. Purchaser agrees not to stop payment on checks, stop payment on credit cards or disallow a bank draft. Purchaser is responsible for any expenses due to collection of bad check or non-payment. In the event of non-payment of bad check, the Auctioneer reserves the right to repossess the merchandise involved at any time at your location.
- Top Tier Auctions reserves the right to sell to the next highest qualified bidder in the event the successful bidder does not comply with the terms of the sale.
- Auctioneer reserves the right to reject any bid at any time for any reason. All bids are accepted at the sole discretion of the Auctioneer. TOP TIER AUCTIONS is not responsible for any bidding errors online. We cannot control internet access and problems that might arise during online bidding. Please understand that if you have interest in an item. Your safest and best opportunity to purchase would be to show up the day of the sale and bid live in-person.
- All bids are pending bids until accepted by auctioneer. Top Tier Auctions and or auctioneer are not liable for any missed bids.
- All items are absolute with no reserve.
- Purchaser shall defend and indemnify and hold Auctioneer and Seller harmless from and against all claims and liabilities relating to the condition of, removal of, or use of the guns, ammunition and other miscellaneous items purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state, and local laws applicable to such articles, including OSHA requirements or for proximate or consequential damages, costs or legal expenses arising there from.

FIREARM SHIPPING
If shipping is necessary for the item, this expense will be the buyer's responsibility. Top Tier Auctions will only be shipping to another FFL of the purchaser's choosing. The cost of shipping will be figured at the actual cost of shipping plus $40 per item (handling fee). Buyer understands that it could take up to 2 weeks for Top Tier Auctions to get all items shipped. Top Tier Auctions will provide shipping receipts and tracking information, as requested. The type of insurance wanted on the property will need to be told to Top Tier staff during checkout.

DISCLAIMERS
- The Auctioneer is acting as an independent contractor only and is not responsible for the acts of its principals or sellers.
- Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release and indemnify Top Tier Auctions, the Auctioneer from liability. Neither Top Tier Auctions, the Auctioneer nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held.
- The record taken by Top Tier Auctions will be considered final as recorded. If there is a dispute over sales price, it will be at the auctioneer's full discretion how this dispute will be finalized.
- Any person who registers, agrees to be subject to the personal jurisdiction of the State of Tennessee. Bidders agree to be bound by the laws of the State of Tennessee and subject to the courts of Tennessee jurisdiction.
- All bidders acknowledge and agree that it is their responsibility to find and review all auction terms. Understand that at any time you have questions, you have a degree of expectation to ask so that you can bid with confidence and have an understanding of the auction process.
- You accept all terms, conditions, and rules when registering for a bidder number and bidding on any real or personal property auctioned by Top Tier Auctions.
