BIDDER APPROVAL: To be approved as an online bidder a signed copy of the terms and conditions along with a signed bidder's certification must be received and approved by the auction office. Once you register for the auction, we will email you the documents that will need to be filled out, signed and emailed back, before you will be approved for bidding. GENERAL INFORMATION: The Parcels sell as-Is with no warranties expressed or implied. Read each Parcel description, each parcel is different from the other. The auction is Subject to prior sale (the property can be purchased prior to the end of the auction) The seller reserves the right to cancel the auction at any time prior to the final bid closing. Any survey cost to be paid by buyer(s). Any acreage difference greater than half (½) acre plus or minus from the advertised acreage discovered in survey will be reflected in price adjustment based upon original bid price per acre & original buyer's premium per acre. BUYERS PREMIUM: Buyer's Premium of 10% will be added to the final bid and charged to the buyer, the final bid plus the 10% buyer's premium will establish the final sales price. DEPOSIT: A 20% down payment must be paid by the successful bidder by direct wire transfer or Personal Check within 24 hours of being determined to be the successful high bidder. The down payment deposit will be non-refundable; your bidding is not conditional upon financing, so be sure you are prepared to pay cash at closing or have arranged your financing prior to bidding. The balance of the purchase price including the buyer's premium will be due via a wire transfer or bank check at the time of closing on or before September 30, 2022. CLOSING: The closing will take place at Near North Title, St Joseph, MI. Seller will convey a clean and clear title and pay for the owners policy. Real Estate Taxes: the taxes will be prorated to the day of closing. Any closing fees will be paid by the buyer and any buyer lender/loan fees. Closing will be held on or before September 30, 2022. Possession will be granted on day of final closing. PURCHASE CONTRACT: The successful Bidder shall sign a Buy Sell Agreement for the parcel (s) immediately after being declared the Successful Bidder by the Auctioneer. Each potential Bidder is responsible for conducting at their own risk, their own independent inspections, investigations, and due diligence concerning the property. Further; Property sells as-is with no warranties expressed or implied Big Bear Auctions, LLC and Southwest Real Estate and their representatives are exclusive agents of the Seller. All announcements made up to the final close of the Auction bidding take precedence over all advertising, oral or printed material.
