Auction Terms

General Auction Company will be selling all vehicles as a California Licensed Motor Vehicle Dealer. Each buyer of vehicles will be required to provide a valid driver's license and will be responsible to pay all sales tax, D.M.V. fees, and buyer fees. These fees will be paid to General Auction Company. General Auction Company will process all paperwork for you at the D.M.V. ($70.00 processing fee), which includes smog and safety certification (If Applicable) ($58.25). Certain vehicles may be classified as "Dealer Only" these vehicles will need to be purchased by a Licensed Dealer/Dismantler only. Please do not bid on these vehicles if you do not possess a valid Auto Dealer License. Dealers must register prior to bidding on these vehicles with current Active standing with the STATE DMV system. Vehicles identified as “Out of State” can be sold to a public out-of-state buyer. However, If the vehicle has the identification of “To be sold Out of State” with a “Dealer Only” status this vehicle can not be sold to the public out of state. Company policy is No vehicles will be sold to the public on the basis of buyer demand title (No exceptions).


*Notice to Public:

"There is No Cooling-off period unless you obtain a "contract cancellation option" California law does not provide for a "cooling-off" or another cancellation period for vehicle lease or purchase contracts. Therefore, you cannot later cancel such a contract simply because you changed your mind, decide the vehicle costs too much, or wish you had acquired a different vehicle. After you sign a motor vehicle purchase or lease contract, it may only be canceled with the agreement of the seller or lessor or for legal causes, such as fraud. However, California law does require a seller to offer a 2-day contract cancellation option on used vehicles with a purchase price of less than $40,000.00, *Subject to certain conditions. The Cancellation option is offered to passenger Vehicles only. This contract cancellation option requirement does not apply to the sale of a Commercial Vehicle, Motorcycle or off-highway motor vehicle subject to identification under California law. See the vehicle contract cancellation option agreement for details. 11709.2 California Vehicle Code.




AS IS
The property to be sold is sold in an "as is, where is" condition, with all faults. There are no warranties of any kind, expressed or implied by the Seller, auctioneer, MFG, distributors, or employees of General Auction Company.
No adjustments will be made to any item for any reason whatsoever. All descriptions of vehicles, equipment, and miscellaneous, general, or specific merchandise, are for reference only. Information provided by any auction employee will need to be verified by the bidder of each lot. The Buyer has the final obligation to determine the size, condition, shape, year, make, model, and value of each item at the state it is in as it sits. All sales are final!

Registration
Each bidder must register and agree to the outlined Terms to qualify with G.A.C. to bid on auction items. The registration process can be found at WWW.GeneralAuction.com site https://generalauction.com/how-to.php. The bidder will be recognized by bidder number only. Each qualified bidder will be issued a digital numbered bidder card within the online auction site. Each lot will be identified and sold by the lot number. General Auction Staff uses a unique control number for internal data tracking. Each sale is digitally audited, and information is provided to the appropriate parties for archived bid records.


Deposit


Online bidders will need to register with a valid Driver's license as well as complete a Credit Card deposit of $500. The bidder registration information MUST match the payment information used to place the deposit. If the information does not match the bidder registration request will be kept in the “Pending” stage and this will not allow any bids to be accepted in the auction system. To increase your spending limit amount from $25,000 to $50,000, an additional $500 deposit is required, for a total deposit amount of $1,000. A deposit is held during the auction and is fully refundable if nothing is purchased during the sale. the transaction will be voided the next business day.


PAYMENTS:

Successful bidders will be notified of the winning status at the close of each lot, Final total Invoice will be emailed no later than the end of the 1st business day after the sale (Monday). Full payment must be made by the close of business on the 3rd business day after the sale (Wednesday) unless agreed to in writing by General Auction Company management. Any amounts not paid when due may be subject to a late payment fee of $35 per invoice item and General Auctions cost of collection (including reasonable legal fees and costs) and shall accrue interest at a rate equal to (i) 1.5 percent per month or (ii) the highest rate permitted under applicable law, on the unpaid balance, commencing on the due date. (Garrett v. Coast and Southern Federal Savings and Loan, 108 Cal. Rptr. 845 (July 18, 1973) Discussing a situation involving a credit card debt: "the borrower "remains liable for the actual damages resulting from the (buyers) borrowers’ default. In addition, if any amount due to General Auction Co. is not paid by the Due Date, General Auction Co. may, at its sole discretion, terminate or suspend the non-paying User's account and/or withhold from the bidder General Auction's Services until such time as full payment is made. Notwithstanding any such cessation or suspension of said Services, the User shall continue to be obligated under this Agreement to pay the remaining balance (including accrued interest) due to General Auction Co.

A 3% automatic discount applies to all cash, cashier check, money order & wire transfer payments.
A $25.00 transaction fee applies to all wire transfers.
Initial disclosure of fees and other information. Section 1005.18(f)(1) requires a financial institution to include, See, e.g., § 1005.18(b)(1)(ii) regarding the retail location exception.


Buyer's Fee:

A 14% Buyer's Premium will apply on all Vehicles & Construction Equipment along with a $20.00 lot fee for Construction Equipment in addition to all other taxes and DMV fees that apply. Any vessel will be sold with its accompanied trailer unless otherwise called out by General Auction Companies Lot Description.

A 16% Buyer's Premium will apply on all Miscellaneous along with a $20.00 per lot fee on each winning bid in addition to all other taxes and fees that apply. A lot is defined as an auction item sold in the current sale represented by the single lot tag “Lot #”, Online Auction Bids start closing @ 9:00 AM (PST) the day of the sale.



Removal
All items must be removed within five (5) calendar days after the sale (By appointment only). A $20 per day storage fee will apply on each and all lots not removed by Friday after the auction. (No exceptions) Any loading or moving of items is the sole responsibility of the Buyer. Removal shall occur during regular business hours established by General Auction. Not picking up items will give General Auction Co full rights to dispose of or sell any left-behind items one week after said sale date. Simple Rule: Once the storage fee exceeds the bid value on the item it will be automatically forfeited and General Auction Company has full ownership of the items on-site or whichever comes first.


Diesel Warning.
In accordance with California Code of Regulations Title 13 certain Portable Diesel Equipment and Off-Road Diesel Vehicles may not be legal to operate in California currently or in the future depending on the age of the equipment, application, and other factors, and for all off-road diesel vehicles, that "when operated in California, any off-road diesel vehicle may be subject to the California Air Resources Board In-Use Off-road Diesel Vehicle Regulation. It, therefore, could be subject to retrofit or accelerated turnover requirements to reduce emissions of air pollutants."


Gasoline Combustible Engine Warning.
In accordance with the California Code of Regulations certain Portable Gasoline Equipment and Off-Road Gasoline Vehicles may not be legal to operate in California currently or in the future depending on the age of the equipment, application, and other factors. Any Gasoline vehicles, that "when operated in California, any off-road diesel vehicle may be subject to the California Air Resources Board In-Use Off-road Gasoline Vehicle Regulation. It, therefore, could be subject to retrofit or accelerated turnover requirements to reduce emissions of air pollutants."

1 (b) The rules required under this subsection must be implemented 2 by July 1, 2024, and may be periodically updated thereafter. 3 Sec. 5. RCW 82.44.200 and 2019 c 287 s 15
32 (b) "Passenger and light duty vehicles" are on-road motor 33 vehicles with a scale weight of up to 10,000 pounds and three or more wheels.
