All Items are sold AS-IS, with no warranties, expressed or implied, except as to ownership of the items to be sold. Item listings, information, and/or descriptions provided to the bidder by Venture Auctions or The City of Memphis is deemed reliable, but not warranted, and is intended as a guide only. Bidders should inspect auction items carefully, and bid accordingly. Bidder agrees not to base a bid solely on information provided by Venture Auctions or The City of Memphis. All bids are final. All sales are final.

No effort has been made by the City of Memphis or Venture Auctions to inspect or verify the condition, mechanical or otherwise, of any vehicle on this auction. Many vehicles could potentially run and drive; some vehicles will not. Some vehicles will have keys provided to the purchaser; many vehicles will not. Bidders should bid accordingly.

Per City of Memphis ordinance, non-licensed Individual buyers may only purchase up to 6 vehicles at the impound per calendar year. Once a buyer meets the 6-car limit, bidding privileges at all City of Memphis Impound Auctions will be suspended until January 1 of the following calendar year. If a buyer exceeds the 6-car limit during an auction, all sales after the sixth purchase wil be nullified.

The City of Memphis Impound operates in Shelby County, Tennessee. Purchasers from outside Shelby County, Tennessee bear the sole responsibilty to be knowledgeable of any applicable motor vehicle documents and/or titling processes and requirements that could affect the transfer of a motor vehicle from the City of Memphis to an individual or business located anywhere outside of Shelby County, Tennessee. Purchasers of motor vehicles at the Memphis Impound Auction will receive a Paid-in-Full invoice from Venture Auctions, and a Bill-of-Sale/Odometer Statement from the City of Memphis. These documents are wholly sufficient for titling purposes in Shelby County, Tennessee, as defined by state and local regulations. No further documents will be offered by the City of Memphis and/or Venture Auctions. Examples of Memphis Impound Vehicle purchase paperwork will be made available to Registered Bidders upon request.

The City of Memphis bears sole responsibility to provide any and all applicable titling documents, in accordance with the terms described herein, to purchaser. Upon delivery of paid invoice to purchaser from Venture Auctions, purchaser agrees to indemnify and hold harmless Venture Auctions in any and all disputes arising between purchaser and seller. This indemnity includes, but is not limited to, any disputes over titling documents, potential refunds, etc.

Full Settlement must be made Day of Sale. NO EXCEPTIONS.
Buyers may pay in-person, with cash, credit card, or certified funds, until 2pm CST on day of auction ONLY. Certified funds/cashiers checks must be made payable to VENTURE AUCTIONS. In-person payments are recieved at the Venture Auctions trailer, located at the Memphis Impound. After 2pm CST, all remaining balances will be charged to buyer's credit card on file as entered at registration.
ANY declined credit card transaction, WILL result in an immediate ban for that bidder from attending or participating in ANY future Venture Auctions live, online, and webcast auctions. NO EXCEPTIONS.
Checks are accepted at auctioneer's sole discretion, and must be approved BEFORE auction. At auctioneer's sole discretion, returned check fees will be assessed at a rate of 2% of total balance owed, compounding daily, from date of payment due through date full payment is received.

10% Buyers Premium applies to all purchases. An additional 3% convenience fee applies to all credit card payments. *Due to increased technology costs, there will be a $10.00 per item internet fee beginning January 1, 2021.*

The City of Memphis reserves the right to add, delete, or alter any item prior to the opening of live/webcast bidding. Prebids will not be recognized on any vehicle/item that is removed from auction prior to opening of live/webcast bidding. Auction items left on City of Memphis property after the auction are the sole responsibility of the buyer. Neither Venture Auctions nor the City of Memphis will recognize any claims for theft, damage, or loss once the item has been awarded.

In the event of a tie-bid between online bidders, the tie goes to the first bid recieved. In the event of a tie-bid between any online bid and any live bidder during the live webcast auction, the tie goes to the onsite bidder. Auctioneer's decision is final and binding on all parties in the event of any dispute. Bidder's acknowledgement of this stipulation and consent to abide by it, and all other terms & conditions of this sale, are implied by bidder's decision to register for and participate in the auction, and expressed by bidder's acknowledgement and acceptance of these terms and conditions at the time of registration.

Live Webcast or Online-Only Auctions involve fallible technology beyond the control of Venture Auctions and The City of Memphis. In the event of outage, for any reason, Venture Auctions reserves the right to postpone, pause, or restart bidding on individual items, or on the entire auction, at its sole discretion. In the event of auction postponement, ALL previously placed pre-bids or live bids may be nullified at the sole discretion of Venture Auctions.

Once full payment for any item has been transferred from Buyer to Venture Auctions, and from Venture Auctions to the City of Memphis, the entirety of that transaction between Venture Auctions and Buyer shall be deemed closed and final. Bidder agrees not to pursue, or to cause any other party acting on bidder's behalf to pursue, ANY refund of ANY purchase funds OR fees from Venture Auctions under ANY circumstance on any transaction between Buyer and Venture Auctions that is closed and final. In the event of ANY post-transaction discrepancy between Bidder and City of Memphis, Buyer agrees that any such process will be handled exclusively between Bidder and City of Memphis, and will exclude Venture Auctions entirely. ANY disputed or returned credit card transaction, for ANY reason, WILL result in an immediate ban for that bidder from attending or participating in ANY future Venture Auctions live, online, and webcast auctions. NO EXCEPTIONS.

ANY Bidder registering, or attempting to register, for any auction utilizing ANY false or misleading identification or payment information will barred from attending or participating in ANY future Venture Auctions live, online, and webcast auctions. Venture Auctions may, at the sole discretion of the Auctioneer, require any online registrant to provide additional proof of identification prior to the acceptance of bids. Such additional measures may include, but are not limited to, in-person presentation of a valid government-issued ID, as required for all purchasers at City of Memphis auctions. Any bidder registration records and/or details determined to be fraudulent or suspicious will be forwarded to Memphis Police Department for further investigation and/or prosecution. NO EXCEPTIONS.

Announcements on day of auction take precedence over any printed or previous information.

Please carefully read ALL information and instructions regarding auction registration, online bidding, payment requirements, vehicle removal, etc., BEFORE participating in this auction! *All Public Bidders for this auction MUST register BEFORE 9am CST on auction day!* Due to the prior purchase verification process necessary in order to adhere to the City of Memphis's 6-vehicle purchase limit for all Public Bidders, any Bidders registering after 9am CST on auction day may or may not be approved to buy before the live auction begins, subject to auction personnel availibility. Absolutely NO online registrations will be approved to bid after auction begins. Bidders may inspect auction items onsite from 12-2pmCST on Tuesday. NO public bidders may be onsite during auction; ALL public bidding is ONLINE ONLY.
