Auction: Online from Monday, May 22nd through 7:00PM CDT Thursday June 8th, 2023
Please note: With online bidding, we will be utilizing a soft close which means if anyone bids with a minute or less remaining, the auction will continue until no more bids are received.
Property Address of House: 21851 Chestnut Rd., Council Bluffs, IA 51503

Purchase Agreement: Successful bidder will enter into a purchase agreement immediately after being declared the winning bidder by the Auctioneer. PLEASE NOTE: The purchase agreement will offer NO CONTINGENCIES: for financing, property condition, or any other alterations to the agreement. Property is being sold "AS IS". Prospective Buyers are urged to inspect the property prior to the auction date to their own satisfaction.
Earnest Deposit: Successful bidder will provide a $10,000 Earnest Deposit on the day of the auction with the balance due at closing. Earnest deposit will be held in the Trust Account of Ambassador Title Services.
Taxes: Taxes will be prorated to the date of closing.
Buyers Premium: A Buyers Premium of 2.5% will be added to the final bid to determine contract price.
Closing: Closing to be on or before June 30th, 2023. Closing to be conducted by Ambassador Title Services with the cost to be split 50/50 between the Buyer and the Seller.
Possession: Will be given at Closing.
Personal Property: Personal items remaining at the close of the auction are the Buyer's property.
Septic Binding Agreement: Septic Time of Transfer inspection determined the system is NOT an approved system and will need to be replaced by the Buyer at their expense after closing. Buyer will sign a Binding Agreement with Pottawattamie County when signing Purchase Agreement and pay the required $150.00 filing fee to Pottawattamie County.
Easements: Sale is subject to all Easements and Right of Ways of record.
Agency: Menke Auction & Realty and their agents are acting as Exclusive Agents for the Sellers or Dual Agents with a signed Dual Agency Agreement.
