Welcome to this short 3 Lot Online Only Equipment and Vehicle Auction. We know you are anxious to begin bidding, however it is critical that you fully understand and agree to the following terms and conditions of this online only auction. By participating in this auction, you agree to the following terms and conditions.

Disclaimer: All lots sell as is, where is, with all faults. Braun and Helmer Auction Service and the seller do not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. All vehicles are being sold as running unless otherwise stated in the listing.

Braun and Helmer Auction Service has attempted to provide accurate descriptions of all items, however, it is your exclusive responsibility as a bidder to determine the condition and suitability of each lot. Printed statements, descriptions and counts by Braun and Helmer Auction Service staff are provided in good faith and are matters of opinion.

The pictures and descriptions provide information on the condition. It is not the policy of Braun and Helmer to hide any issues or problems with the vehicles. If most cases we can provide additional pictures or information up to 24 hours prior to auction day.

We recommend that you bid early and become familiar with the software. Not everyone has high speed internet and it make take longer for you to place your bids. Something to consider is that at the end of the auction, there may be a dozen individuals bidding the same amount at virtually the same time. Because of this we do not guarantee that your bids will be executed to your satisfaction.

The bidding increments for this auction will be in $100.00 increments.

Buyer's Premium: A buyers' premium of 10% of the high bid will be added to the high bid to determine the final selling price for the auction lot.

The Michigan State sales tax (6%) will be paid at the Secretary of State if purchasing a vehicle.

Payment: Braun and Helmer Auction Service accepts the following forms of payment: Cash, Cashier�s Check, Personal or Company Checks. (Checks made to Braun and Helmer Auction Service.) No checks outside of the state of Michigan are accepted (unless approved).

The auction company reserves the right to reject any bids.

Merchandise becomes the full responsibility of the buyer at time of payment and the buyer assumes all risk of loss and damage to property at that time. Braun and Helmer Auction Service reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the Buyer will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.

Inspection Dates & Time:
There will be no in person viewing for this auction.

AUCTION BEGINS: 9AM Wednesday February 27th, 2024
AUCTION ENDS: 7 PM Thursday March 7th, 2024

MERCHANDISE PICK UP: By Appointment Only. Braun and Helmer Auction Service will contact the winning bidders and schedule an agreed upon pickup date and time (Must be within 1 week of auction ending).

PICK UP LOCATION: 5220 S State Rd. Ann Arbor MI 48108.

Pickup: All items, must be picked up on the published move out date(s). Buyers are responsible for rigging, loading, and moving all items purchased without assistance from Braun and Helmer Auction Service.

**Very important: With exception of previous arrangements with Braun and Helmer Auction Service, you MUST pick up your items on the specified date(s). If your items are not picked up within 7 days Braun and Helmer Auction Service reserves the right to forfeit your items.

Auction Ending: Beginning at the stated closing time, the auction software will conclude bidding for one lot each sixty seconds in catalog order with the following exception: if a bid is placed in the last three (3) minutes remaining for that auction lot, bidding for that lot will remain open for an additional minute. Some lots may be grouped together so that a bid on one lot will extend the time on all lots in that group.

Debt Collection and Interest Charges: The buyer agrees to pay all reasonable attorney fees and other costs incurred by Braun and Helmer Auction Service in its efforts to collect unpaid funds from the buyer. The buyer agrees that a fee of 10% of the outstanding balance per month be added to any unpaid balance due Braun and Helmer Auction Service. Any debt collection or dispute proceedings will be heard in Ann Arbor, Michigan. Limitation of Liability If, for any reason, Braun and Helmer Auction Service is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of Braun and Helmer Auction Service, if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser.

Non Paying: In addition to the above, understand that we are working for our seller. We have zero tolerance for non-paying bidders and we will proceed aggressively to rectify such situations.

Age Requirement All bidders must be 18 years of age or older.

Bidder Information and Security: All registration information the bidder provides to Braun and Helmer Auction Service shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify Braun and Helmer Auction Service if they believe that their bidder number and password have been compromised.

This Online Only Forklifts and Transit Van Shell Auction will take place online starting on Wednesday February 27th, 2024 and will go through Thursday March 7th, 2024. Pickup tImes will be by appointment only.
