1) I agree that Durham Realty & Auction Co., Inc. can charge my credit card for my purchase in the event I do not pick up my items in person. In addition Durham Realty & Auction Co, Inc. can charge my credit card a $25.00 no show fee and forfeit my items purchase.

2.) SHIPPING - Durham Realty & Auction Co., Inc. DOES NOT SHIP it is your responsibility to pick your items up on the pickup date specified location for each auction.

3.) LOADING- If you are the winning bidder on an item, please bring help to load your items. The bidder is solely responsible for loading and rigging of items purchased.

4.) AUCTION ENDING- On-Line Auctions are a timed event and all bidding will close at a specified time. Our sales have an auto-extend feature. Any bid paced in the final (2) two minutes of an auction the auction ending will automatically extend (2) two minutes from the time the bid was placed.

5.) BIDDER VERIFICATION- All buyers are required to register to bid, giving full name, address, phone number and e-mail address. Bidding rights are provisional, if complete verification is not possible Durham Realty & Auction Co., Inc. will reject the registration and bidding activity and will terminated. Durham Realty & Auction Co., Inc. and the seller reserve the right to preclude any person from bidding if there is any question as to the person's credentials or fitness to bid.

6.) TECHNICAL ISSUES- In the event there are technical difficulties related to the server, software, internet or any other on-line auction related technologies, Durham Realty & Auction Co., Inc. reserve the right to extend bidding and continue the bidding or close the bidding. Neither the company providing the software nor Durham Realty & Auction Co., Inc. shall be held responsible for a missed bid or the failure of the software to function properly for any reason.

7.) DEFAULT- If purchases are not settled by the specified pick-up day, it will be considered in default. The bidder bill be charged a $25.00 no show fee. All defaulted items may be offered to the next highest bidder qualified at the discretion of Durham Realty & Auction Co., Inc. The bidder agrees to pay all responsible attorney fees and other cost incurred by Durham Realty & Auction Co., Inc. in its efforts to collect unpaid funds from bidder. Any dispute will be tried in a court of jurisdiction in Rutherford County, Tennessee.

8.) "SOLD AS IS, WHERE IS"- Durham Realty & Auction Co., Inc. and the seller furnish all auction items to buyer "AS IS" unsupported, without warranty of any kind. Bidders are responsible for ascertaining actual current condition of an item through personal inspection and careful review of the picture and description of the item. All lots are sold "AS IS, WHERE IS" with all faults, imperfections and errors of description, due diligence is the responsibility of the bidder. Printed statements or descriptions by staff are provided in good faith and are a matter of opinion.


9). CONDUCT OF AUCTION- Conduct of the auction and increments of bidding are at the direction and discretion of Durham Realty & Auction Co., Inc. Durham Realty & Auction Co., Inc. reserves the right to reject any and all bids for any reason and also reserves the right to cancel this auction, or remove any item or lot from this auction prior to the close of bidding. All decisions of Durham Realty & Auction Co., Inc. are final. Your bid on this auction indicates both an understanding and an acceptance of the terms of this contractual agreement between yourself and both Durham Realty & Auction Co., Inc. and the seller and that you as the bidder are prepared to purchase items under these terms and conditions.
