**Blackwell Realty & Auction � Personal Property Auction Terms & Conditions**

1. General Terms of Sale
1.1 These Terms and Conditions, together with specific auction details posted online and in promotional materials, comprise the Complete Terms and Conditions of Sale.
1.2 By registering to bid and/or placing a bid, all bidders agree to be bound by these terms.
1.3 In accordance with Tennessee law, Blackwell Realty & Auction and its Auctioneers reserve the right to bid on behalf of the seller, estate, or for their own purchase.

2. Property Condition and Inspection
2.1 All items are sold �AS IS,� �WHERE IS,� and �WITH ALL FAULTS� without warranties or guarantees of any kind, express or implied.
2.2 The Auctioneer makes no representations or warranties regarding:
a. The accuracy of descriptions,
b. The authenticity, genuineness, or condition of any lot, or
c. The fitness of an item for a particular purpose.
2.3 Descriptions and photos are offered as a guide only. Photos may be inaccurate, and incorrect images may be posted. Buyers must rely on personal inspection.
2.4 It is the Buyer's full responsibility to confirm all item details before bidding.
2.5 On-site inspection is strongly recommended. Preview times will be listed in auction details or may be scheduled with the auction manager.

3. Legal Jurisdiction
3.1 This agreement shall be governed by the laws of the State of Tennessee, specifically Wilson County.
3.2 Any legal action must be filed in a Tennessee State Court located in Lebanon, Wilson County.

4. Bidding and Contract Formation
4.1 A successful bid at auction�live or online�constitutes a legally binding contract of sale.
4.2 All sales are final. No refunds, returns, or exchanges will be permitted.
4.3 The bidder�s number is nontransferable. All bids made using this number are the responsibility of the registered bidder.

5. Buyer's Premium and Payment
5.1 A 15% buyer�s premium will be added to the hammer price of all items.
5.2 Payment terms:
a. Invoices under $2,500 will be automatically charged to the card on file at auction close.
b. Invoices over $2,500 must be paid via wire transfer or cash within 48 hours.
c. All major credit cards are accepted for invoices under $2,500.
5.3 Non-payment policy:
a. If a credit card is declined, the Buyer has two (2) business days to resolve the issue.
b. Failure to make full payment may result in legal action and liability for damages, including legal fees.

6. Item Pickup and Abandonment
6.1 Buyers must pick up items on the designated pickup day.
6.2 Items will be considered abandoned and become the property of Blackwell Realty & Auction if:
a. The buyer fails to retrieve unpaid items from the pickup location.
b. The buyer fails to pay for shipping within 10 days.
6.3 Auctioneer reserves the right to resell, dispose of, or charge for storage and legal costs due to abandonment.

7. Shipping
7.1 Buyer is responsible for all shipping charges, which will include: hammer price + buyer's premium + sales tax (if applicable) + shipping.
7.2 Shipping Process:
a. Our third-party shipper, Shipping Saint, will contact buyers via email or text.
b. Buyer must confirm the shipping request.
c. Allow 7�10 days for the shipping invoice to be generated.
d. Once paid, a tracking number will be provided.
7.3 Shipping Charges:
a. $5 per item handling fee (maximum of $25 per invoice).
b. Full insurance is required.
c. No media mail or buyer-supplied labels are allowed.
7.4 Non-payment of Shipping:
a. If the shipping invoice is not paid within 48 hours, the item(s) will be considered abandoned and become the property of Blackwell Realty & Auction.
b. No refunds will be issued under any circumstances.
7.5 International Buyers:
a. Are responsible for all customs fees and international shipping costs via USPS, UPS, or FedEx.
b. Shipping method will be chosen based on item type and destination.

8. Firearms Policy
8.1 Buyers must know and comply with their state�s firearm laws.
8.2 Non-Tennessee residents must have firearms shipped to a licensed FFL holder in their home state.
8.3 Buyer is responsible for all transfer fees, background checks, and shipping expenses.
8.4 Buyer must provide FFL contact information to the auction company immediately following purchase.

9. Personal Information
9.1 Accurate and complete bidder information is the responsibility of the Buyer.
9.2 Delays or errors resulting from incorrect contact or shipping information will not be the responsibility of Blackwell Realty & Auction.
