Real Estate Auction Terms & Conditions:

Absentee Bids may be placed by calling our office at (812) 254-2220, calling Mark at (812) 486-8927 or Jeff at (812) 830-8117, or online at graberauctions.com.

LIVE ONLINE BIDDING - Online bidders will be able to bid online day of auction at specified time. Graber Auctions or Seller not responsible for bidders ability to not connect to internet, or electronic problems.

BUYER'S PREMIUM - There is a 3% Buyer's Premium for this auction. 3% will be added to the final sales price to determine the final selling price for the purchase contract.

NOTE: Final bids are subject to owner's approval with 24 hour approval or denial period.

DOWN PAYMENT (EARNEST MONEY) : A down payment of 10% of final bid price will be required on the acceptance of purchase agreement from the family within 24 hours of auction. The down payment (earnest money) may be made in the form of Personal Check, Business Check or Certified Cashier's Check made payable to Graber AUctions, LLC, and is NON-refundable and will be applied to the purchase price at closing. Earnest Money will be placed in a escrow account until closing.

ClOSING - Close on property/s to occur on or before August 25, 2025

YOU'RE BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing if needed. A pre-approval letter from your lender will be required to bid if you are financing and must be turned into Graber Auctions, LLC prior to beginning of auction. CASH and ONLY CONVENTIONAL LOANS will be considered. NO other loan programs (FHA, USDA, Etc) will be considered.

ACCEPTANCE OF BID PRICES: The successful bidder will be required to sign a Purchase Agreement upon acceptance of the final bid plus the 3% buyer's premium. (The final bid is subject to the Sellers acceptance or rejection).

AS-IS: The property is being offered As-Is, without any contingencies. Potential buyer's may with advanced notice have an inspection of the property conducted at the BUYER'S expense. NO CONTINGENCIES.

PLATS - Plats shown herein and the description of any improvements are for informational purposes only, and no representations, warranties, or guarantees are made concerning locations, dimensions, or tract size or nature, quality or suitability for use of the tract for any improvements. All information concerning property has been gained from the Dubois County GIS.


EVIDENCE OF TITLE: Seller shall provide an Owner's Title Insurance Policy in the amount of the purchase price.

DEED: Seller shall provide Warranty Deed(s).

SURVEY: If property is sold all together to one buyer in its entirety then no survey will be offered. If propery is sold in seperate lots, then seller will pay to have a survey conducted.

CLOSING: The balance of the purchase price is due at closing, which will take place in 45 days after the auction, or as soon thereafter as applicable closing documents are completed by the Seller. Fees for an administered closing shall be shared 50/50 between Buyer(s) and Seller(s).

POSSESSION: Possession will be given at closing.

REAL ESTATE TAXES: Real Estate taxes shall be prorated to the date of closing.

PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries, and due diligence concerning the property. The Seller disclaims any and all responsibility for Bidders safety during any physical inspection of the property.

DISCLAIMER AND ABSENCE OF WARRANTIES: The property is being sold on an AS IS, WHERE IS basis, and no warranty expressed or implied, concerning the property is made by the Seller or the Auction Company. All sketches in the brochure and listing are approximate, as well as measurements or acreage. Each potential bidder is responsible for conducting his or her own independent inspections, investigations, and inquiries concerning the property. The conduct of the auction and increments of bidding are in the direction of the Auctioneer. The Seller and Selling Agents reserve the right to preclude any person from bidding if there is any question as to the person's credentials, fitness, etc.

Once bidding is declared closed by the auctioneer, there shall be no further bidding.

Auctioneer and/or seller reserves the right to withdraw the property prior to auction.

This is a "with reserve" auction. The seller reserves the right to accept or reject the final bids at auction within a 24 hour period at auction close.
