Auction Terms & Conditions Thank you for participating in a Kaser Auction Serice (Justin Kaser Auctioneers LLC) Online Auction. It is important that you become familiar with the terms and conditions as all sales are final. For online bidders your credit card will NOT be charged following the auction. You can pay at pickup Cash or pay using bank transfer prior to pick up. For online bidders.. Online buyer's premium of 8% will be added to final bid. No buyers premium for in person bidders. Payments must be made at or before pickup, before loading items. All Sales are final, with no refunds.
The terms of sale are non-negotiable. Registration at the auction (online and/or in person) finalizes each bidder's agreement to the terms and conditions of sale as stated in the Contract and any Addenda which are incorporated by reference into your bidding.

Buyers agree not to dispute any credit card charges. While every effort has been made to ensure accuracy in this catalog, we are not responsible for errors, omissions, deletions or additions. Purchasers are advised to attend the scheduled preview to inspect equipment and to make their own determination of condition. Neither the Auctioneer nor the Consigners shall be responsible for the correct description, authenticity, genuineness of, or defect in any lot, and make no warranty in connection therewith. No allowance will be made or sale set aside on account of incorrectness, error in cataloging, condition or any imperfection.

The applicable 8% buyer's premium will be added to the hammer price of each lot. All costs should be considered and taken into account when determining any and all bids. We WILL NOT charge your Credit Cards when the auction ends. You can pay at pickup Cash or pay using bank transfer prior to pick up. For online bidders.

Employees of Kaser Auction Service are not prohibited from bidding on property. Kaser Auction employees are required to adhere to the terms and conditions and pay all fees as described herein.

THE SALE WILL BE CONTROLLED BY THE AUCTIONEER PROGRAM: AuctionFlex/HiBid. Kaser Auction Service is not responsible for malfunctions or system errors which cause a bid or bidder to fail to be recognized or registered. In case of technical difficulties, the auctioneer has the right to postpone and/or extend the auction to another date and/or time. The auctioneer is not responsible for any local power failures or internet disruption or delays before, during or after the auction.

According to Indiana state law there are no tie bids. All items will be sold 'AS IS, WHERE IS' with no financing, inspection or other contingencies to sale. Kaser Auction Service represents the Sellers only and does not inspect properties on bidder's behalf. Buyers must conduct their own due diligence and investigation of each property and must also investigate the suitability of each parcel prior to making a bid and purchase at the auction. Buyers must rely solely upon their own investigation and not any information provided by the Seller or Auctioneer. Failure of a Buyer to be fully informed on the condition of a property will not constitute grounds for any claim adjustment or right to cancel sale.

THERE ARE NO REFUNDS OR BID CANCELLATIONS. THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. AN ONLINE BID ACCEPTED AT PUBLIC AUCTION IS A LEGAL AND BINDING CONTRACT TO PURCHASE. ANY BIDDER WHO FAILS TO CONSUMATE A PURCHASE WILL BE BANNED FROM BIDDING AT ALL FUTURE SELLER AUCTION EVENTS AND MAY BE PURSUED FOR CIVIL AND/OR CRIMINAL VIOLATIONS.

Announcements made day of auction may take precedence over theses Terms of Auction or other printed material

NOTE: After the initial scheduled pickup days, additional time may be requested for pick up. A $5 per day storage fee will be charged for up to 10 days of the auction close. After that time, the unretrieved item(s) will be declared abandoned with no further claims to ownership by you with no return of funds}.

This is both an online and live in person auction. You may leave prebids online up until the live auction begins April 27th at 10am EST. At which time you can bid live with our in-person bidders. There is 100s of items in the live portion of the auction that will not have internet bidding available, so it is recommended to attend in person on the day of the auction. An 8% buyers premium will be added to the total of online bidders. In person bidders will have no buyers premium. Pick Up: Saturday 5-31-2025 immediately after the auction ends or by appointment within a week.
