SALES TAX Sales Tax applies at this auction. Bidders who furnish a properly completed Resale Certificate PRIOR to bidding and approved will be exempt from paying sales tax.

There will be no re-bids or rebates after an item is bid on or sold. This catalog is presented strictly as a guide and is subject to errors and omissions. All property is described to the best of our knowledge; however, neither we nor our consignor(s) make any warranties, express or implied, with respect to such property as to the physical condition, quality, rarity, importance, authorship, provenance, medium, period, origin or estimated value of any sold lot. No statement anywhere, whether oral or written, whether made in the catalog or advertisement, bill of sale, gallery posting, announcement or remarks by staff or the auctioneer, shall be a warranty, representation or assumption of liability. All measurements and weights are approximate.
The auctioneer reserves the right to to sell and bid on items on behalf of a third-party if there is a reserve price.
PICKUP INSTRUCTIONS: Winning bidders will be notified of the exact address and pickuip times at the conclusion of the sale within 24 hours. CHECK YOUR SPAM EMAIL AS IT MAY BE THERE. It is your responsibility to contact us if you have not received your invoice and pickup location. Bring Boxes, packing material and assistant to load if needed. Please do not bid if you are unable to pickup your purchases in the specified time periods for each auction. Items must be picked up at the scheduled pick up times or they will be considered abandoned without refund and your account and bidding privileges will be cancelled.
ALL SALES ARE FINAL No returns or adjustments will be made after the auction. Bidders who elect to pay their balance by credit card understand and agree to relinquish any and all rights to charge backs.
DISPUTES / DISCREPANCIES All bids are binding, any bidders in default will be banned from future auctions and suit for damages will be initiated through NJ civil courts. Record of sale kept by the Auctioneer will be taken as final in the event of any dispute. In the event the auctioneer cannot release all or part of the lot, the extent of the auctioneer's responsibility will be to refund all monies paid in connection with the lot in question. Auctioneer records the sale by recorder. No adjustments will be made to an invoice once the inventory leaves the premises. Auctioneer has right to bid on sellers behalf if there is a reserve on any lots.
LIABILITY All persons attending, inspecting or removing merchandise assume all risks whatsoever of damage or loss to person and property and specifically release the Auctioneer and Seller formal liability therefore. Auctioneer and Seller shall not be liable by reason of any defect in condition of the merchandiser premises on which the sale is held.

By registering to bid you hereby understand and agree that we at Mountain Auctioneers, are not responsible for any technical or personal errors / issues which occur to you the user (you the registered bidder), meaning you are responsible for payment of the items that you win as well as all fees which are described and available to read before auction registration. There are no valid explanations or excuses to void your bids, period. These Terms & Conditions act as a legally binding contract. If your toddler, grandfather, or pet cat was bidding on your behalf, you still have to pay for the items as you're the person responsible for your account. Each lot's description is just as valid as the lead (title). Both fields should be understood clearly before bidding. If there is a discrepancy between the photos and the description please contact us for clarification. If purchasing despite a discrepancy between description and photos, the descriptive words shall stand as accurate over the photo(s) unless Mountain Auctioneers judges otherwise. Items and their conditions are not subject to discount, returns, or refunds based on subjective views.
