TERMS & CONDITIONS
NOTE: The Massey Ferguson 5450 will be used on loading days and cannot be picked up before 3 PM CT on September 6. Items requiring tractor loading must be collected before 3 PM that day.

We thank you for your participation in another FHRA, Inc. auction. It is vital that you familiarize yourself with the terms and conditions as all sales are final, without contingency and irrevocable. The terms of sale are non-negotiable. Bid deliberately and with care, happy bidding!

PAYMENT: Payment in full and possession given day of item pickup, with the exception of any titled automobiles/boats/trailers after being transferred at the courthouse with proof of transfer supplied to auctioneers. Acceptable forms of payment are cash or good checks or properly issued Cashier's Checks. NO CREDIT OR DEBIT CARDS ACCEPTED. All sales are final. There are no returns, refunds, or adjustments. Items with values over $2,500 will be limited to Cashier's Check endorsed to FHRA Escrow.

FAILURE TO PAY: Interest on overdue amounts will be paid by Purchaser at a rate of 18% per annum or at such other maximum rate as allowed by law, together with any legal or collection costs incurred by Auctioneers.

SALES TAX: A 6% KY sales tax will be charged on the final selling price on all taxable items. Dealers with a resale certificate must have on file a current sales tax exemption form with our office at the start of the auction in order to receive the sales tax exemption, no exception. Farm Exempt items are taxed, no exceptions unless a current year KY or Farm Exempt is in our possession prior to the end of the auction.

BUYERS PREMIUM: A Ten Percent (10%) buyer's premium will be added to all winning bids to determine the final selling price.

DELIVERY & BIDDING TERMS: No items will be shippedno exceptions. By registering (online or in person), bidders agree to all terms and conditions outlined in the Contract and Addenda. Do not bid unless you've registered, received a bidder card or paddle number, and read and accepted the sale terms. Bidding confirms your agreement and makes the terms enforceable if you become the high bidder.

PICKUP DAYS: Pickup is available Friday, September 5 and Saturday, September 6 from 10 AM to 6 PM CT. Note: The Massey Ferguson 5450 will be used for loading and cannot be picked up until after 3 PM on September 6. Items requiring tractor loading must be picked up before 3 PM that day.

PICKUP LOCATION: With the exception of the firearms, all items will be picked up at 8812 Millerstown Road, Clarkson KY 42726.

ONLINE BIDDING: Your computer will automatically refresh with new bids. You do not need to refresh your webpage. Refreshing may cause a delay in your bidding experience due to the reloading of the entire page. At the end of the auction if you suffer with slower internet connections, you may need to refresh but do so with caution.

BIDDING INCREMENTS: Each FHRA, Inc. Real Estate & Auction, Inc. auction may have different bidding increments. The software will calculate the next bid amount before submitting the bid.

AUCTION ENDING: FHRA, Inc. Real Estate & Auction, Inc. Online Auctions are timed events and all bidding will close at a specified time. FHRA, Inc. Real Estate & Auction, Inc. Online Auctions also have an auto-extend feature. Any bid placed in the final three (3) minutes of an auction, the auction ending will be automatically extended three (3) minutes from the time the bid was placed. The auto-extend feature remains active until no further bids are received within a three (3) minute time frame. The extension time normally applies to individual lots only.

OUTBID NOTIFICATION: Until the auction begins to close, the bidding software will notify bidders by email when they have been outbid. Bidders may also find out if they have been outbid by refreshing the individual lot information. Due to varying internet connections/speed, please place a max bid or constantly monitor the auction at close of bidding. Max bidding sets the maximum you are willing to bid on an item. The software will automatically place bids on your behalf only if you have been outbid. It does not place your max bid until you have been outbid and only bids when you have been outbid. Once your max bid has been met, you will be out of the bidding unless you manually bid. Sometimes email notifications can be delayed. FHRA, Inc. is not responsible for software or internet glitches or missed bids. NOTE: This acution has 400 plus lots, so it is paramount that you set realistic and final max bids as it will be difficult to monitor multiple lots due to the large number of items being offered.

PROPERTY INFORMATION & INSPECTION: FHRA, Inc. Real Estate & Auction, Inc. is not responsible for any missing or incorrect listing information. FHRA, Inc. Real Estate & Auction, Inc. has attempted to provide accurate descriptions of all items in the auction. However, it is the bidder's responsibility to inspect the item and determine the condition of each lot. Descriptions that are provided by FHRA, Inc. Real Estate & Auction, Inc. are provided in good faith and are matters of opinion. The only recourse for the buyer of an item or items that are missing or damaged prior to pick up is not paying for the item.

SOLD "AS IS, WHERE IS": All auction items are sold by FHRA, Inc. Real Estate & Auction, Inc. and the seller strictly as is, without any warrantiesexpress or impliedincluding merchantability or fitness for a particular purpose. Items are offered in their current condition, with all faults, defects, and possible description errors. FHRA's liability is limited to the purchase price paid. Bidders accept items with all faults, visible or not, and are solely responsible for inspecting and evaluating each item through descriptions, images, videos, and documentation. All bidding decisions are made independently by the bidder.

AUCTION DISCRETION: FHRA, Inc. Real Estate & Auction, Inc. may modify the auction's date, time, order, bidding increments, or item details at its sole discretion, for any reasonincluding technical issues, emergencies, or convenience of FHRA or the seller.

BIDDING TERMS & LIABILITY: FHRA, Inc. Real Estate & Auction, Inc. may reject any bid for any reason. Accepted bids are legally binding. Responsibility for items transfers to the bidder upon payment, including all risk of loss or damage. Unpaid items by the stated pickup deadline may be resold, with the original bidder liable for the purchase price, collection costs, and any resulting damages. FHRA also reserves the right to modify bidder usernames or passwords as needed. Bidders agree to indemnify and hold harmless FHRA and its affiliates from any claims, damages, judgments, or related costs.

AUCTION CANCELLATION: FHRA, Inc. Real Estate & Auction, Inc. reserves the right to cancel this auction, or remove any item or lot from this auction prior to the close of bidding.

BIDDER VERIFICATION: The identity of all bidders will be verified. Bidding rights are provisional and may be terminated if full verification is not possible. FHRA, Inc. Real Estate & Auction, Inc. and the seller reserve the right to reject any registration or preclude any person from bidding if there is any question regarding credentials, mental fitness, or other concerns.

AGENCY DISCLOSURE: The member company acting as auctioneer/agent is an agent for the seller only.

By accepting the terms and conditions of the auction: All parties agree that any lawsuits/legal disputes in Grayson County are under the jurisdiction of the Grayson County Courts and must be filed in this court.

Gun purchases made are subject to a federal background check. Guns purchased shall be delivered by the seller to Locked and Loaded guns located at 1613 Elizabethtown Road Leitchfield Ky 42574 where they will be held until the background check has been completed to be satisfactory for transfer to the buyer.

Sales Tax: 6% Kentucky sales tax is required for all non-farm purchases unless otherwise exempt. A Kentucky Farm Exempt Form must be on file at time of purchase or before payment is submitted. Dealers with a resale certificate must have on file a current sales tax exemption form with our office at the start of the auction in order to receive the sales tax exemption.

All sales are final and without contingencies & are "AS IS, WHERE IS" without expressed or implied warranty both surface and subsurface, having invited buyers to inspect property prior to bidding. All information derived from sources deemed to be reliable, however accuracy is not guaranteed. Persons relying upon this information are invited to inspect any and all property prior to bidding.
