Auction Terms & Conditions

TERMS & CONDITIONS:
BY PLACING A BID, BIDDER CERTIFIES THAT THEY HAVE READ AND WILL ABIDE BY ALL TERMS & CONDITIONS AS STATED BELOW. IT IS THE BUYER'S RESPONSIBILITY TO UNDERSTAND ALL THE TERMS & CONDITIONS PRIOR TO BIDDING.

ONLINE BIDDING:
This is a timed, online-only Auction. At close of auction, the highest online bid will be the winning bid for the item. This auction will incorporate a "SOFT CLOSE" which means, should bidding on an item occur within the last 5 minutes before the closing of that item, the open bid period for that item will extend by an additional 2 minutes.

All items are sold "AS IS, WHERE IS" with no warranty or guarantees, expressed or implied, by the seller or AUCTION GANG LLC. Bidders accept all auction items/property "WITH ALL FAULTS", whether or not immediately apparent. It is strongly recommended that bidders thoroughly inspect items before placing a bid. Items are described as accurately as possible, but do not represent any guarantee by the seller or AUCTION GANG LLC. By placing a bid, bidder signifies that they have inspected the item to their satisfaction.

In the case of an online auction, should there be an unexpected software, cloud server or major network outage, AUCTION GANG LLC reserves the right to pause, extend, fully reopen or cancel the auction in order to allow given auction sufficient time to run and close under normal conditions without disruption in all fairness to auction attendees, bidders & consignors.

AUCTION GANG LLC reserves the right to withdraw, add, or re-catalog items in this auction. AUCTION GANG LLC also reserves the right to reject a bid from any bidder.

As a result of registering and accepting these terms and conditions, you are agreeing to OPT-IN to AUCTION GANG LLC text messaging. AUCTION GANG LLC will only send text messages at the start of each auction, 1 hour prior to close of an auction, and in the event of a urgent notification due to auction change, system issue, etc. Should you desire to OPT-OUT of text messaging, simply reply STOP to any text message received from AUCTION GANG LLC.

PHOTOS & ITEM DESCRIPTIONS:
Multiple photos will be included in item descriptions whenever possible. Note: photos may or may not fully represent the item as lighting, surroundings and other factors can affect the perception of an item in a photo. As such, all bidders are responsible for their own personal inspection of the item(s) before placing a bid. Photos and item descriptions are to be used as a guideline only. Auction Software used by AUCTION GANG LLC will not be held liable for any software or software malfunction discrepancies.

INVOICING:
An invoice and payment instructions will be sent to each buyer's registered email at the close of the auction. All Iowa, non-exempt residence will be charges 7% sales tax on purchases. Please read email message completely for payment instructions. Please contact us at (515) 669-6357 if you do not receive an invoice from us within 24 hours of auction close. Payment must be received at time of checkout and pickup following the conclusion of the auction. If payment is not received or payment arrangements made within 1 day after the conclusion of the auction, the buyer will lose all right, title and interest to the item(s), including any and all monies. Auction items will not be released for pickup until payment is made in full. Failure to comply with these terms will prohibit bidder from participating in future auctions conducted by AUCTION GANG LLC.

ITEM PICKUP/SHIPPING & DELIVERY:
Removal and/or transportation of item(s) won at auction shall be at the expense, liability and risk of the buyer. Any Items not removed by the allotted checkout time, unless arrangements have been made and agreed upon by AUCTION GANG LLC, will be considered abandoned and the buyer will lose all right, title and interest to the property, including any and all monies from the buyer. AUCTION GANG LLC will ship items within the continental United States & Canada if requested - NO OTHER INTERNATIONAL SHIPPING WILL BE MADE. Shipping costs will be included in final invoice and will be responsibility of the buyer. Should bidder wish to have a shipping cost estimate prior to bidding, an inquiry can be made by emailing AUCTION GANG LLC @ info@auctiongang.com. Unless shipping has been agreed to by AUCTION GANG LLC, all items are pick-up only. AUCTION GANG LLC will not provide boxes, packing material, etc. so please be sure to bring your own at pickup time.

RETURNED CHECK FEES:
A fee of $35.00 will be assessed on returned checks and may result in the buyer being denied access to future auctions. Be sure you are capable of paying immediately after the conclusion of the auction and realize your bids are not conditional upon financing.

PAYMENT:
All auction sales will be settled using the bidders credit card on file with HiBid with payment directly to AUCTION GANG LLC. You must notify AUCTION GANG LLC in advance should your wish to pay for purchases using an alternative method.
