Auctioneer may refuse to accept a Bidder Registration from any potential Bidder, may refuse to grant bidding privileges to any potential Bidder, and may revoke the Bidder Registration or bidding privileges of any Bidder. Bidder agrees to all terms and conditions of the auction set forth prior to bidding on the auction. These terms and conditions are made part of the offer to purchase. All bidders are required to register online prior to the beginning of the online auction if they intend to bid. Each bidder is assigned a unique bidder number. In consideration of being allowed to participate in this auction, bidder agrees that all bids he or she submits are irrevocable and binding. (2.) Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. (3.) All property sold “AS IS,” “WHERE IS,” and “WITH ALL FAULTS.” All property is being offered and sold in its AS IS/WHERE IS condition at the time of the auction, WITH ALL FAULTS, including any hidden defects of any nature. No statement anywhere, whether express or implied, including verbal statements made by Auctioneer or their staff, will be deemed a warranty or representation by the Auctioneer or Seller. Without limiting the generality of the foregoing, there are no warranties of non-infringement, authenticity, origin, merchantability, or fitness for a particular purpose, all of which are expressly disclaimed. You acknowledge and agree that you cannot rely, and have not relied, on any representation, warranty, or guaranty made by Auctioneer or their staff or the Seller, or anyone acting as agent of the Seller, orally or in writing. You acknowledge and agree that you have had the opportunity to inspect any lot(s) in person. You further acknowledge and agree that any photographs or other images of lot(s) are adequate for your purposes, and that you have had a full and fair opportunity to ask questions of the Auctioneer, and to conduct any and all due diligence deemed by you to be necessary or appropriate. If the payment does not go through to your card on file, your account will be suspended until this invoice is paid off or a $50 service charge is paid (whichever amount is higher of the two). You may also be blocked from future bidding or face legal action if the items are not paid for or picked up. (6.) Purchases requiring shipping will have the shipping, handling, and insurance charges sent to the buyer on a separate invoice. If you request shipping and then decide to cancel your shipping request after Saturday, Oct. 4 at 11 AM a minimum $20 charge will be assessed for the time spent picking and packing your items and for the packing materials. (7.) For buyers who purchase unopened bottles of alcohol, you must be 21 years of age or older. (8.) All Federal firearms laws will be complied with. Background checks will be conducted on ALL firearm purchases. Firearms and the required background check must be paid for before we will conduct the background check. Failure to pass the background check will result in the buyer consigning the item to an upcoming Auction. Any out of state firearm purchases must be shipped to an FFL (buyer is responsible for all shipping/handling charges). For buyers who purchase firearms, to be compliant with federal and state regulations we must do background checks and process the required paperwork for which there is an additional $15.00 processing fee if a long gun or long guns are purchased and a $20.00 processing fee if a handgun or handguns are purchased (with a maximum charge of $35 regardless of how many guns of both types the buyer purchases). Some firearms may not be legal in all locations. Not for sale where prohibited. Check local laws and ask/get answers to all questions before bidding. THERE ARE NO REFUNDS. As a precondition of participating in this auction, the buyer agrees to release the seller from all liability, whether criminal or civil, arising from the purchase, ownership, possession, use or misuse of this item. All firearms should be inspected by a certified gunsmith prior to loading or firing. Always wear eye and ear protection when shooting firearms. Treat every firearm as if it is loaded. Safety is no accident. (9.) You agree that as a buyer on this auction, Beloit Auction may attempt to contact you by email, text, or phone regarding your invoice. (10.) Anyone caught tampering with tags, merchandise or shoplifting will be prosecuted to the fullest extent possible. (11.) Beloit Auction will not be held responsible for any inconsistencies in the description announced or printed; therefore, buyers are responsible for inspecting all items and deciding for themselves if the item they have seen is what they want to buy. (12.) According to Federal Uniform Commercial Code (UCC 2-238) at the closing of each auction item, there is a legal binding contract for the purchase of the item. The buyer shall be responsible for safeguarding their purchased items from the public, such as during the pick-up time. Beloit Auction recommends scheduling to be on site as quickly as possible to pick up your purchases. (13.) Buyers are responsible for the additional moving, packing, boxing, and loading of all items purchased. This means providing your own vehicle, packing materials, boxes, bags, and labor/help to load your own vehicle. Beloit Auction cannot provide or insure assistance for loading of your items. (14.) Beloit Auction staff reserve the right to bid on and purchase merchandise. (15.) All our online only auctions are conducted using staggered closing times. That means every minute a select number of lots will close. The closing of an item means it is a scheduled time that bidding should end on that lot. (16.) All our online only auctions are conducted using a soft close. This means even if an item is scheduled to close at a particular time, if someone places a bid in the last 90 seconds, 90 seconds will be added to the scheduled close time for that particular lot. The time extension will continue to occur every time a bid is placed until there are at least 90 seconds with no additional bids. (17.) The Auctioneer cannot, and will not be, held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in their sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final. (18.) Buyer agrees any legal action taken regarding this auction, that jurisdiction is agreed upon by all parties to be placed in Rock County, WI. Beloit Auction & Realty, Inc. will be entitled to the value of its time, costs, and attorney’s fees incurred as damages.
