Auction Terms & Conditions-Updated 1/2/2025
You are required to read and agree to all terms and conditions for this auction. (If you do not agree please do not register to bid.) All items are sold as is / where is! It is recommended that you attend the open house to familiarize yourself with the items you wish to purchase. (Example: color, size, shape, age, or overall condition). If there is no open house offered, please feel free to call us if there is a question about the condition of a lot prior to bidding. All bids are binding.

Registration:
Registration requires a credit card for verification of identification only. We will not add any charges to your credit card until auction pick up is over. Therefore, you can pay with a check or cash if you wish.

By registering for our online or live auctions you agree to all of our terms and conditions, an online registration will be considered a signed contract from the bidder who wishes to participate in our auction and that the bidder is accepting all of these terms & conditions. All registrations and bids are considered legal and binding.

Bidding:
Once you have registered now it's time to bid. Go to the view catalog. Click on an item inside the catalog that you wish to bid on. After reading the description you can now bid. Click on the "bid button". You can bid to the next increment or place a max bid. If you choose max bid the computer will bid for you up to your max amount. Preset bidding increments have been set up. As the price of an item increases the bid amount increments will increase. It is not necessary to enter a decimal point and zeros to your bid amount. The computer software will enter them for you. Some items will be sold "times the money". If it's a sold "times the money" item it will look like this "X5". Example: If an item sells for $2 dollars each and it is a X5 lot then the price will be $10. You can also bid live as the auction closes. 30 minutes before the auction closes click on "enter live auction" button. Place your bids as the increments increase.

Auction Closing:
Our Internet auctions use a "soft close" format. An item will close every 10 seconds after the beginning of an auction. This gives the bidder the opportunity to bid on more than one item. If there is an advance bid inside of 2 minutes to close the bidding, that item will be extended by 2 minutes. This process will continue until there is no more bidding activity.

Payment:
A 13% buyer's premium will be added to the final purchase price of each item. Payment is expected on pick up day. We accept most major credit cards. All items that are not picked up during the scheduled pick-up times will have a $20 no show fee added to the unpaid invoice. After 30 days, the items will be considered abandoned and resold. All monies will be retained by Bid-N-Buy Realty and Auctions, Inc. and any losses will be owed by the delinquent buyer.

Pick up information:
Pick up times are listed in the auction description, as well as the beginning lots of the auction. An appointment must be made to pick up your items. We will honor our 3% discount for cash or check on our scheduled pick-up dates ONLY! If you do not pick up your items during this time, there is a flat 13% buyer�s premium.

If an auction is offsite from our office, all large items (like couches, chairs, dressers, appliances, tables & chairs.....Etc.) will NOT be brought to our office and a $20 no show fee will be added to the invoice. Large items will be considered abandoned.

Buyers will be charged for all items purchased whether you pick them up or not. It is your best interest to make an appointment during the scheduled pick up times.

Sales Tax: 8% New York State sales tax will be charged on all purchases and buyer's premium. If you are tax exempt, you must sign a resale or farm exempt form.

Shipping: We ship USPS and UPS. There is a $5 per box shipping charge added to each box shipped. We will accept credit card payment or a check for shipping. If you wish to pay with a check your items will be held until the check clears. If you wish to have your items shipped please respond to your emailed invoice at the conclusion of the auction and we will contact you if we have any questions.

Firearms, Ammunition & Muzzleloaders:
All firearm purchases require a NYS Background Check (NYSNics) unless you have a Federal Firearms License. All pistols require a pistol permit unless you have a federal firearms license. Some firearms are not NYS compliant. Read the descriptions prior to bidding.
All firearms are registered with Bid-N-Buy Realty & Auctions, Inc. Purchasers must complete a NYS background check to complete any firearms, ammunition and muzzleloader transactions. Pistol purchases require a valid pistol permit. There is no additional fee for a background check from Bid-N-Buy Realty & Auctions, Inc., NYS fees apply. Bid-N-Buy Realty & Auctions Inc. is a federal licensed dealer and New York State licensed for pistol sales. Shipping is available, but all firearms, ammunition & muzzleloaders shipped must be received by a FFL dealer of the buyer�s choice. If you have questions please call our office prior to bidding.
All Firearm background checks must be completed in person at our office. You are NOT permitted to add any pistols to your pistol permit prior to completing and passing a background check. We will be offering a chance for buyer�s to complete background checks for ammunition and muzzleloaders prior to coming to our office. All buyers who elect to use this option must pay for the ammunition or muzzleloader via credit card prior to us running the background check.
All firearms, ammunition & muzzleloader transactions require a valid form of ID (ie: VALID Driver�s License, Passport, Fingerprint ID, Military SN, Mariners Doc, Non Immigrations Number, Non-Driver ID, Port Security ID, Veterans Admission Claim #). All these licenses must be valid, we will not accept any expired licenses.
Per NYS Law, all primitive muzzleloaders require a NYS background check. If you plan to have the muzzleloader shipped, it must be sent to a C&R or FFL Licensee.

NO STOP PAYMENT ORDERS OR CREDIT CARD CHARGEBACKS:
No stop payment orders or credit card chargebacks. Each bidder agrees that such bidder will not, under any circumstances, (i) issue a stop payment order with respect to any checks issued or in connection with the auction, or (ii) initiate a credit card chargeback with respect to any purchases at the auction. Each bidder further agrees that if, in violation of these terms and conditions, a stop payment order is issued or a credit card chargeback is initiated, these buyer terms & conditions will be conclusive evidence of the bidder's (i) waiver of any rights to issue a stop payment order or to initiate a credit card chargeback, and (ii) agreement not to issue a stop payment order or to initiate a credit card chargeback; and each bidder acknowledges and agrees that the auctioneers presentation of these bidder terms and conditions to the bank, credit card company, or other financial institutions against which a check was drawn or that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to, or for the account of auctioneer. If, in violation of these bidder terms and conditions, a bidder issues a stop payment order or initiates a credit card chargeback, such bidder, even if successful, will remain liable for all purchases made at the auction, and will be responsible for all costs and expense, including attorney's fees, incurred by or on behalf of auctioneer and/or seller in challenging the stop payment order or credit card chargeback and in collecting payment. Each bidder acknowledges and agrees that the covenant not to issue a stop payment order or initiate a credit card chargeback is a condition to the issuance of a bidder number to such bidder, and is being made as an inducement for the auctioneer to accept such bidder's bidder registration, to issue a bidder number, and to permit the bidder to bid at the auction. Each bidder acknowledges and agrees that the auctioneer is relying on the covenant not to issue a stop payment order or to initiate a credit card chargeback in accepting such bidder's bidder registration, in issuing a bidder number, and in permitting the bidder to bid at the auction. All items are sold in as/is condition with no warranties implied or expressed. By signing this you agree to all these terms and conditions.

VERY IMPORTANT-***ALL ITEMS ARE SOLD AS/IS. WE ARE NOT "WALLY MART" AND DO NOT HAVE A RETURN POLICY. WE TRY TO DESCRIBE THE ITEMS TO THE BEST OF OUR ABILITY. IT IS IN YOUR BEST INTEREST TO ATTEND AN OPEN HOUSE TO VIEW THE CONDITION OF ANY LOT YOU WISH TO BUY. OUR CONSIGNERS BRING ITEMS TO SELL AND EXPECT A CHECK AT THE END OF THE AUCTION. WE WILL IN NO WAY ACCEPT ANY ITEM RETURNED DUE TO DESCRIPTION OR CONDITION! BY REGISTERING AND BIDDING ON THIS AUCTION YOU AGREE TO THESE TERMS.***
