1.All purchasers are required to have a bidder’s number to bid. Purchasers must present identification and give their correct name, address, and phone number as well, to obtain a bidder’s number. A CASH DEPOSIT OF $100.00 is required of everyone to obtain a bidder number. This deposit WILL be applied to your purchase or, if no purchase is made, it will be fully refunded before you leave the sale. Deposits not collected within 5 business days will be forfeited. A 15% BUYERS PREMIUM will be added to your Sale Total
2.ALL PURCHASES MUST BE PAID DAY OF AUCTION!!! ALL SALES ARE FINAL!!! SALES TAX FORM MUST BE PROVIDED EVERY MONTH
3.The descriptions of items at or prior to the sale are believed to be correct. However, neither these descriptions nor any oral statement made by Worstell Auction Company, its agents, employees, or the Auctioneer concerning any item shall be construed as warranty, either expressed or implied. All items are sold “AS IS, WHERE IS” There will be a merchandise inspection period the day before the sale during the hours of 8 A.M. until 4 P.M. WORSTELL AUCTION COMPANY IS NOT RESPONSIBLE FOR YEAR, MODEL, OR MILEAGE DISCREPANCIES!
You are strongly advised to examine the merchandise before bidding. BUYER MUST PAY FOR ALL ITEMS HE IS DECLARED HIGH BIDER ON, BEFORE LEAVING THE DAY OF SALE.
4.The Auctioneer reserves the right to group lots, make smaller lots, and or delete lots, as well as to offer individually or by group. The Auctioneer shall determine the advance of bidding. The Auctioneer reserves the right to make statements that will take precedence over any printed matter or prior statements. In the case of tie bids, the Auctioneer shall reopen bidding. The designation of the buyers will be final.
5.Merchandise becomes the full responsibility of the purchaser once declared the high bidder. Buyer must pay for all merchandise and assumes all responsibility for loss and/or damage of purchased merchandise. Neither Worstell Auction Company nor the Auctioneer shall be responsible for the buyer’s merchandise. A receipt is furnished to the buyer at the time of sale. Worstell Auction Company will have auction employees posted at all exits immediately following the end of sale. You must present your receipts to these employees before you are permitted to remove any items you have purchased from the sale. A $50.00 fee will be collected for copies of your manila tickets. Lot numbers must remain on all merchandise for verification prior to removal.
6.PLEASE ALLOW 45 MINS. FROM THE TIME OF PURCHASE TO BE POSTED TO SALE.
7.Customer acknowledges that he is a Business Consumer with knowledge and experience in financial and business matters that enable him to evaluate the merits and risks of the Transaction. Customer, therefore, expressly waives the provisions of the Texas Deceptive Trade Practice/Consumer Protection Act. Auction Items not picked up by the deadline will be considered abandoned property, and Worstell Auction Company may at its discretion, resell or donate this merchandise without refund to you. Buyers are prohibited from reselling and/or trading merchandise on the property.
The Company shall not be responsible or liable for any damages, whether on account of personal injuries, death, or otherwise, suffered or sustained on the premises.
SHOPLIFTERS WILL BE PROSECUTED TO THE FULL EXTNT OF THE LAW.
The Auctioneer or Worstell Auction Company will resolve any disputes that may arise.
