Auction Terms & Conditions: This is an on-line bidding platform only. 10% Buyer's Premium added to final bid price. If you win a bid for $110.00 and additional $11.00 will be added for a total of $121.00 not including sales tax or late pickup fees. All items are located for PICK-UP at 169 Pleasant Hill Road, Harrisonburg, Virginia 22801. PICK-UP IS Wednesday, DECEMBER 17, 2025, FROM 2:00 PM - 6:00 PM. There will be no other available pick-up times offered unless prior arrangements were made before the closure of the sale. Cash or Check (with official identification) will be accepted in person prior to removal of the item on Wednesday, December 17, 2025, during the hours of 2:00 PM � 6:00 PM. The 5% credit card fee will be waved for all cash or check payments.
It is the responsibility of the buyer to understand the condition of the item prior to purchasing. Ensure what you are buying is what you expect. AUCTION PICK UP DAY IS ONLY on Wednesday, December 17, 2025, 2:00 PM to 6:00 PM.
Late Fee is an additional 20% or $5:00 whichever is greater any lot that is not settled on and picked up by the close of the scheduled pick-up day.
All items will be considered abandoned if they are not picked up and paid for at the scheduled date and time, unless prior arrangements have been made with an auction company representative on behalf of the buyer. If an item is declared abandoned, the auctioneer reserves the right to donate the item to a charity of their choosing or relist the lot for sale, without any obligation to the buyer.

These Bidder Terms and Conditions apply to auctions conducted by LARRY WITTIG AUCTIONEERS AND ASSOCIATES, LLC ("Auctioneer"), and constitute a legal, valid, binding, and enforceable contract between Auctioneer and each Bidder. These bidder terms and conditions also form the basis for the contract of sale between the Seller and the Buyer. For the purposes of these Bidder Terms and Conditions, the term "YOU" refers to each Bidder (as defined below).
Bidder Terms and Conditions; Published Terms; Announcements Made During the Auction; Acknowledgement of Binding Agreement.
The Auction is conducted under and in accordance with these Bidder Terms and Conditions and all other terms and conditions posted on the Auctioneer website(s) and on the websites of any Online Auction Platform Provider(s) used by Auctioneer. The Auction is subject to any announcements or corrections by Auctioneer. By participating in the Auction in any way, YOU agree to be bound by, and to abide by, these Bidder Terms and Conditions.

Auction pick-up is scheduled exclusively for Wednesday, December 17, 2025, from 2:00 PM to 6:00 PM.
Buyer's Premium: 10% for cash or good check payments; 15% for credit/debit card payments.
A late fee of 20% or $5.00 (whichever is greater) will be charged to the buyer's credit card and will apply to any items not settled and collected by the conclusion of the designated pick-up day.
These Bidder Terms and Conditions govern auctions conducted by Larry Wittig Auctioneer and Associate LLC ("Auctioneer") and constitute a valid, legally binding contract between the Auctioneer and each participating Bidder. These terms equally provide the foundation for the contract of sale between Seller and Buyer. For purposes of these Bidder Terms and Conditions, "YOU" refers to each Bidder as defined herein.
Bidder Terms and Conditions; Posted Terms; Auction Announcements; Agreement to Be Bound.
Auctions are conducted pursuant to these Bidder Terms and Conditions, as well as all other terms posted on the Auctioneer�s website(s) and those of any Online Auction Platform Provider(s) employed by the Auctioneer. The Auction may be subject to additional announcements or corrections by the Auctioneer. By participating in any manner, YOU affirm your agreement to these Bidder Terms and Conditions.

The key terms are defined as:
"Auction" denotes an online auction conducted by the Auctioneer.
"Bidder" encompasses any individual or entity, including their agents or representatives, who registers, bids, purchases, or otherwise participates in the Auction (including inspection and pick-up), regardless of whether a bid is submitted.
"Bidder Account" refers to the identifier assigned to a Bidder by the Auctioneer.
"Bidder Registration" comprises the information provided by prospective Bidders and the registration process, which includes acceptance of the Bidder Terms and Conditions. �Buyer� identifies the Winning Bidder for a Lot,
"Buyer's Premium" signifies a percentage of the Hammer Price payable by the Buyer to the Auctioneer.
"Contract Price" is defined as the sum of the Hammer Price and the Buyer's Premium.
"Delivery" is the transfer of possession of Lot(s) to the Buyer at a location specified by the Auctioneer, unless otherwise agreed; the Auctioneer is not required to relocate any Lot unless expressly provided in writing.
"Fall of the Hammer" indicates the moment at which the Auctioneer formally declares a Lot sold, either in person or electronically, to the recognized Winning Bidder.
"Hammer Price" is the highest bid accepted at that time.
"High Bid" and "High Bidder" refer to the leading bid and its originator, respectively.
"High Estimate" and "Low Estimate" indicate anticipated bidding ranges but do not represent appraisals.
"Lot" refers to each item or grouping offered for sale.
"No Sale" applies when a Lot is withdrawn or remains unsold.
"Online Auction Platform" represents the technological system used for online bidding,
"Online Auction Platform Provider" is its operator.
"Private Sale" and "Private Sale Price" relate to transactions and corresponding values occurring outside the Auction setting.
"Reserve" or "With Reserve" grants the Auctioneer discretion to withdraw Lots or reject bids post or prior to the Fall of the Hammer; unless specifically stated otherwise, all Lots are sold With Reserve. The "Reserve Price" is the minimum price acceptable, which may remain undisclosed.
"Winning Bid" and "Winning Bidder" pertain to the accepted highest bid and its submitter.
"Without Reserve" designates an Absolute auction.

Bidder Registration; Qualification.
Registration is required for participation in bidding. The Auctioneer sets forth all necessary requirements and qualifications for registration at their discretion. Bidders must submit information and documentation as requested to establish eligibility. The Auctioneer reserves the exclusive right to deny registration, restrict bidding privileges, or withdraw existing privileges at any time. By registering, individuals confirm they are at least eighteen (18) years of age and possess legal capacity to enter into contracts; entities similarly confirm they have the requisite authority to register and transact. Participation signifies full acknowledgment of and agreement to all applicable terms and conditions. The Auctioneer retains sole discretion to accept bids from unregistered parties, who will be subject to these terms. All qualification provisions are intended exclusively for the benefit of the Auctioneer and Seller, and do not extend rights to other parties. The Auctioneer and/or Seller reserve the right to waive any such qualifications as they deem appropriate.
Jurisdiction.
All bids and payments shall be considered received within the Commonwealth of Virginia, regardless of the physical location of the Bidder or Lot.
Buyer�s Premium.
A Buyer's Premium equivalent to ten percent (10%) of the Hammer Price shall be added to each Lot's Hammer Price to establish the final Contract Price not including any credit card charge fee. This premium is retained by the Auctioneer.
Access and Reviews.
Participants acknowledge and accept all risks associated with accessing the Auction, whether through online platforms or at any premises affiliated with the Auctioneer. Access may be restricted at the sole discretion of the Auctioneer. The Auctioneer also reserves the right to publish accurate reviews pertaining to Bidder conduct.
Nature of the Auction.
Unless stated otherwise, all auctions are conducted with reserve, and lots may be withdrawn at any time before the fall of the hammer.
Bid Retraction
After acknowledgment by the Auctioneer or submission through the online platform, bids are considered final and may not be withdrawn. The withdrawal of bids is strictly prohibited as it interferes with the orderly conduct of the Auction and violates the terms of participation.
Timing
All times indicated are in Eastern Standard Time (EST). Closing times are estimated and may be adjusted at the sole discretion of the Auctioneer.
Online Bids; Maximum Bid Amounts
A maximum bid amount may be specified by the bidder. Online bidding typically begins at either the opening bid or the next increment, which may be lower than the maximum bid entered. Bids will be automatically executed up to the point at which the Hammer falls or bidding concludes. The submission and execution of online bids does not create an agency relationship between the Auctioneer and the bidder.
Party relationship
The Auctioneer serves exclusively as the agent for the Seller(s) and does not represent or act on behalf of the bidder.
Bid Increments
The Auctioneer reserves the right to determine and adjust bid increments at their sole discretion.
Records
Except in cases of clerical error, the records maintained by the Auctioneer shall be considered definitive and binding for all purposes.
Interruptions in website connections
The Auctioneer shall not be held liable for any interruptions or malfunctions affecting website connectivity, including but not limited to connection issues, platform errors, or equipment failures. At the Auctioneer's discretion, the auction schedule may be modified in response to such disruptions; however, such adjustments are not obligatory.
Shortcomings of Online Auction Platform Operators and Their Partners
The Auctioneer may utilize third-party online auction platforms; however, the Auctioneer assumes no liability for any matters concerning Hibid or its affiliates.
Soft Close (Auto-Extend Feature)
If an online bid is submitted within one (1) minute of the scheduled auction closing time, the bidding period shall automatically be extended by one (1) additional minute. This extension process will repeat until no further qualifying bids are received during any subsequent one-minute interval, at which time the auction will officially close.
Statement Concerning Online Auction Platform(s)
The Auctioneer makes no representations or warranties regarding the uninterrupted or error-free operation of any Online Auction Platform(s) or related technology, and does not guarantee the results, accuracy, completeness, reliability, or security of these systems.
Accountability Regarding Online Bidding
You are fully responsible for all bids submitted via your computer or Bidder Account. Upon confirmation by the Auctioneer, any successful bid placed from your account will result in your designation as the Buyer.
Successful bidders are subject to final certification by the auctioneer.
The Auctioneer possesses exclusive authority to officially confirm the winning bidder; electronic notifications are not considered a final determination.
Successful Bid; Buyer
The person placing the highest bid on any Lot will be designated as the Buyer, subject to final confirmation by the Auctioneer.
Bidders Inspection
All property is offered for sale in its existing condition and location, inclusive of any known or unknown defects. Prospective purchasers are strongly encouraged to perform comprehensive due diligence, as all transactions adhere to the principle of caveat emptor (Buyer Beware).
Each item is sold as-is, with all faults, including latent defects. Neither the Auctioneer nor the Seller makes any warranty or representation regarding the quality, value, function, authenticity, or suitability of any property. Buyers are advised to inspect all lots before bidding and must rely solely on their own assessment.
Quality and Completeness of Descriptions and Visuals
Prospective purchasers are strongly advised to examine items prior to placing bids. Participation in the bidding process signifies acknowledgment of the opportunity for such inspection and confirmation that all decisions are based exclusively on your assessment or waiver thereof. All images and descriptions are intended solely for identification purposes and shall not be construed as guarantees or warranties.
Description of Property
Except where expressly indicated in writing, descriptions of lots are prepared through visual inspection and are intended solely for identification; no warranty is provided.
Upper and Lower Projections
When available, high and low estimates are intended solely as reference points and should not be construed as definitive indicators of final hammer price, intrinsic value, or future resale prospects. Please note that these estimates do not include the Buyer�s Premium.
Announcements
All announcements or postings made by the Auctioneer during the Auction take precedence over any prior advertisements or listings.
Administration of the Auction
The Auctioneer oversees every aspect of the Auction, ensuring its orderly conduct. All decisions rendered by the Auctioneer are final and binding. The Auctioneer exercises complete authority over the bidding process and the resolution of any disputes, retaining exclusive discretion to reopen bidding when deemed appropriate under specified circumstances.
Agreement for the Sale of Personal Property
The presence of a sale contract is established through these Terms and Conditions, together with the Auctioneer�s records detailing each lot, its price, and the purchaser. Collectively, these documents constitute the foundation of the contractual agreement.
Payment
All purchases are required to be paid in full by the specified pick-up date and time. Accepted payment methods are cash, approved check, credit card, certified funds, or wire transfer. Certified funds or wire transfer may be necessary for larger transactions. Shipments will be processed only after payment has cleared. Please note that payments made by debit or credit card are subject to an additional 5% Buyer�s Premium.
Title
Ownership will be transferred to the Buyer solely upon receipt of full payment credited to the auction account, notwithstanding any contractual obligations established upon confirmation of winning.
Delivery; Sales Tax
Lots will be delivered to their designated location as specified upon the conclusion of the auction. The Auctioneer assumes no responsibility for transferring lots to alternative locations. Agents are permitted to accept delivery on behalf of buyers. Sales tax will be applied in accordance with the jurisdiction where delivery occurs, unless an exemption is applicable. Buyers are responsible for any taxes imposed by other jurisdictions and must cooperate in rectifying any errors related to tax collection.
Pick up and Removal; Shipping; Insurance
The Buyer is obligated to remove lots in a timely manner, as indicated in posted notices or announcements. All disassembly, rigging, shipping, and transportation shall be conducted at the Buyer's own risk and expense. Any damage incurred during removal must be repaired by the Buyer. Shipments will be made free on board (FOB) at the specified location, with risk transferring to the Buyer upon shipment. Buyers are also responsible for arranging insurance coverage.
Non-Collection or Delivery Arrangements; Abandonment of Property; Storage Procedures
Any lots that are not collected within one (1) day after the designated pickup date shall be considered abandoned by the Buyer to the Auctioneer, irrespective of payment status. The Buyer will remain liable for the purchase price, and the Auctioneer retains the right to donate any abandoned item(s) to a charity of his choice or resale without credit to previous buyer.
Please note that all sales are considered final.

No Credit Card Chargebacks
The initiation of a credit card chargeback for auction purchases is expressly forbidden. In the event that a chargeback occurs contrary to these terms, this agreement will serve as evidence disputing its validity. Buyers are liable for all costs and fees resulting from unauthorized chargebacks. Acceptance of these conditions is required for registration and participation in the auction.
Claims
Unless otherwise specified in writing, once a Lot has been collected or removed by you or your representative, claims, returns, adjustments, or rescissions will not be permitted.
Involvement of Third Parties and Subsequent Purchasers
The Auctioneer maintains no affiliation with third parties or subsequent purchasers of Lot(s), and neither third parties nor subsequent purchasers shall rely on any statements or descriptions provided by the Auctioneer. Furthermore, the Auctioneer assumes no liability toward such individuals or entities. You agree to indemnify and hold the Auctioneer harmless against any claims brought forth by third parties or subsequent purchasers regarding any Lot(s) acquired by you.
Buyer's Remedies; Bidders and Buyers Are Not Eligible for Incidental or Consequential Damages
Should you be entitled to remedies in connection with the Auction, your sole and exclusive recourse shall be the return from the Seller of (i) the Hammer Price paid, and (ii) an amount equivalent to the Buyer's Premium. In no event shall the Auctioneer or Seller be liable for incidental or consequential damages, including but not limited to lost profits or diminished productivity. Furthermore, you acknowledge and agree that you are not eligible for specific performance or other forms of equitable relief.
Remedies Available to Sellers
If you fail to fulfil any obligations outlined in these Terms and Conditions or within a contract with a Seller, the property in question may be resold. You will be liable for all resulting damages, including any shortfall or reduction in the Contract Price, as well as incidental damages, and be blocked from future sales.
Private Sale
You are required not to engage in any Private Sale transaction with the Seller(s) of any Lot(s) before or during the Auction. Should you enter into such a transaction either prior to, during, or within three (3) days following the Auction (for Lot(s) unsold at the Auction), the Auctioneer shall be entitled to receive its full Commission and Buyer�s Premium, calculated as a percentage of the Private Sale Price, along with any reimbursable expenses. Both you and the Seller shall be jointly and severally responsible to the Auctioneer for payment of these amounts.
Waiver
Certain provisions within these Bidder Terms and Conditions are designed solely for the benefit of the Auctioneer and/or Seller(s). These provisions�including, but not limited to, Bidder registration and qualification requirements, payment terms, removal and delivery terms, and inspection terms�do not confer any rights or advantages upon other individuals, such as competing Bidders, and may not be enforced by them. The Auctioneer and/or Seller reserve the right, at their discretion and on either a global or case-by-case basis, to waive any provisions intended for their benefit; however, they are under no obligation to do so.
Indemnification
You hereby agree to indemnify and hold the Auctioneer harmless from any claims for damages arising from the Auction, any purchases made at the Auction, or any subsequent sale of Lots.
Email Subscription; Consent to Receive Communications
By agreeing, you consent to being included in the email list maintained by the Auctioneer. Each communication from the Auctioneer will include an unsubscribe link at the bottom. You also agree not to designate any emails sent by or on behalf of the Auctioneer as spam.
Applicable Law and Dispute Resolution
These Bidder Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia, including its statutes of limitations, but excluding its conflict of law principles. In the event of a dispute, the parties agree to first pursue mediation; if mediation does not result in resolution, the matter will proceed to binding arbitration. The mediator will be an impartial individual mutually selected by both parties and situated within thirty (35) miles of Harrisonburg, Virginia. If the dispute remains unresolved within thirty (30) days following submission to mediation, it will be referred to binding arbitration before a single neutral arbitrator, also mutually agreed upon, located within the same geographic area. Arbitration proceedings must be concluded within sixty (60) days from the commencement date. The arbitrator�s decision shall be final, binding on all parties, and not subject to appeal. All costs associated with mediation or arbitration shall be divided equally among the parties.
If the parties are unable to mutually select a mediation or arbitration venue within thirty (35) miles of Harrisonburg, Virginia, they irrevocably submit to the exclusive jurisdiction of the courts located in the City of Harrisonburg, Virginia for resolving disputes. Should any dispute be addressed through civil litigation rather than mediation or arbitration, all related expenses�including reasonable attorney�s fees incurred by the prevailing party�shall be promptly reimbursed by the losing party. The right to a jury trial is hereby waived.

These Bidder Terms and Conditions govern auctions conducted by Larry Wittig Auctioneer and Associate LLC ("Auctioneer") and constitute a valid, legally binding contract between the Auctioneer and each participating Bidder. These terms equally provide the foundation for the contract of sale between Seller and Buyer. For purposes of these Bidder Terms and Conditions, "YOU" refers to each Bidder as defined herein. Bidder Terms and Conditions; Posted Terms; Auction Announcements; Agreement to Be Bound. Auctions are conducted pursuant to these Bidder Terms and Conditions, as well as all other terms posted on the Auctioneer�s website(s) and those of any Online Auction Platform Provider(s) employed by the Auctioneer. The Auction may be subject to additional announcements or corrections by the Auctioneer. By participating in any manner, YOU affirm your agreement to these Bidder Terms and Conditions. The key terms are defined as: "Auction" denotes an online auction conducted by the Auctioneer. "Bidder" encompasses any individual or entity, including their agents or representatives, who registers, bids, purchases, or otherwise participates in the Auction (including inspection and pick-up), regardless of whether a bid is submitted. "Bidder Account" refers to the identifier assigned to a Bidder by the Auctioneer. "Bidder Registration" comprises the information provided by prospective Bidders and the registration process, which includes acceptance of the Bidder Terms and Conditions. �Buyer� identifies the Winning Bidder for a Lot, "Buyer's Premium" signifies a percentage of the Hammer Price payable by the Buyer to the Auctioneer. "Contract Price" is defined as the sum of the Hammer Price and the Buyer's Premium. "Delivery" is the transfer of possession of Lot(s) to the Buyer at a location specified by the Auctioneer, unless otherwise agreed; the Auctioneer is not required to relocate any Lot unless expressly provided in writing. "Fall of the Hammer" indicates the moment at which the Auctioneer formally declares a Lot sold, either in person or electronically, to the recognized Winning Bidder. "Hammer Price" is the highest bid accepted at that time. "High Bid" and "High Bidder" refer to the leading bid and its originator, respectively. "High Estimate" and "Low Estimate" indicate anticipated bidding ranges but do not represent appraisals. "Lot" refers to each item or grouping offered for sale. "No Sale" applies when a Lot is withdrawn or remains unsold. "Online Auction Platform" represents the technological system used for online bidding, "Online Auction Platform Provider" is its operator. "Private Sale" and "Private Sale Price" relate to transactions and corresponding values occurring outside the Auction setting. "Reserve" or "With Reserve" grants the Auctioneer discretion to withdraw Lots or reject bids post or prior to the Fall of the Hammer; unless specifically stated otherwise, all Lots are sold With Reserve. The "Reserve Price" is the minimum price acceptable, which may remain undisclosed. "Winning Bid" and "Winning Bidder" pertain to the accepted highest bid and its submitter. "Without Reserve" designates an Absolute auction. Bidder Registration; Qualification. Registration is required for participation in bidding. The Auctioneer sets forth all necessary requirements and qualifications for registration at their discretion. Bidders must submit information and documentation as requested to establish eligibility. The Auctioneer reserves the exclusive right to deny registration, restrict bidding privileges, or withdraw existing privileges at any time. By registering, individuals confirm they are at least eighteen (18) years of age and possess legal capacity to enter into contracts; entities similarly confirm they have the requisite authority to register and transact. Participation signifies full acknowledgment of and agreement to all applicable terms and conditions. The Auctioneer retains sole discretion to accept bids from unregistered parties, who will be subject to these terms. All qualification provisions are intended exclusively for the benefit of the Auctioneer and Seller, and do not extend rights to other parties. The Auctioneer and/or Seller reserve the right to waive any such qualifications as they deem appropriate. Jurisdiction. All bids and payments shall be considered received within the Commonwealth of Virginia, regardless of the physical location of the Bidder or Lot. Buyer�s Premium. A Buyer's Premium equivalent to ten percent (10%) of the Hammer Price shall be added to each Lot's Hammer Price to establish the final Contract Price not including any credit card charge fee. This premium is retained by the Auctioneer. Access and Reviews. Participants acknowledge and accept all risks associated with accessing the Auction, whether through online platforms or at any premises affiliated with the Auctioneer. Access may be restricted at the sole discretion of the Auctioneer. The Auctioneer also reserves the right to publish accurate reviews pertaining to Bidder conduct. Nature of the Auction. Unless stated otherwise, all auctions are conducted with reserve, and lots may be withdrawn at any time before the fall of the hammer. Bid Retraction After acknowledgment by the Auctioneer or submission through the online platform, bids are considered final and may not be withdrawn. The withdrawal of bids is strictly prohibited as it interferes with the orderly conduct of the Auction and violates the terms of participation. Timing All times indicated are in Eastern Standard Time (EST). Closing times are estimated and may be adjusted at the sole discretion of the Auctioneer. Online Bids; Maximum Bid Amounts A maximum bid amount may be specified by the bidder. Online bidding typically begins at either the opening bid or the next increment, which may be lower than the maximum bid entered. Bids will be automatically executed up to the point at which the Hammer falls or bidding concludes. The submission and execution of online bids does not create an agency relationship between the Auctioneer and the bidder. Party relationship The Auctioneer serves exclusively as the agent for the Seller(s) and does not represent or act on behalf of the bidder. Bid Increments The Auctioneer reserves the right to determine and adjust bid increments at their sole discretion. Records Except in cases of clerical error, the records maintained by the Auctioneer shall be considered definitive and binding for all purposes. Interruptions in website connections The Auctioneer shall not be held liable for any interruptions or malfunctions affecting website connectivity, including but not limited to connection issues, platform errors, or equipment failures. At the Auctioneer's discretion, the auction schedule may be modified in response to such disruptions; however, such adjustments are not obligatory. Shortcomings of Online Auction Platform Operators and Their Partners The Auctioneer may utilize third-party online auction platforms; however, the Auctioneer assumes no liability for any matters concerning Hibid or its affiliates. Soft Close (Auto-Extend Feature) If an online bid is submitted within one (1) minute of the scheduled auction closing time, the bidding period shall automatically be extended by one (1) additional minute. This extension process will repeat until no further qualifying bids are received during any subsequent one-minute interval, at which time the auction will officially close. Statement Concerning Online Auction Platform(s) The Auctioneer makes no representations or warranties regarding the uninterrupted or error-free operation of any Online Auction Platform(s) or related technology, and does not guarantee the results, accuracy, completeness, reliability, or security of these systems. Accountability Regarding Online Bidding You are fully responsible for all bids submitted via your computer or Bidder Account. Upon confirmation by the Auctioneer, any successful bid placed from your account will result in your designation as the Buyer. Successful bidders are subject to final certification by the auctioneer. The Auctioneer possesses exclusive authority to officially confirm the winning bidder; electronic notifications are not considered a final determination. Successful Bid; Buyer The person placing the highest bid on any Lot will be designated as the Buyer, subject to final confirmation by the Auctioneer. Bidders Inspection All property is offered for sale in its existing condition and location, inclusive of any known or unknown defects. Prospective purchasers are strongly encouraged to perform comprehensive due diligence, as all transactions adhere to the principle of caveat emptor (Buyer Beware). Each item is sold as-is, with all faults, including latent defects. Neither the Auctioneer nor the Seller makes any warranty or representation regarding the quality, value, function, authenticity, or suitability of any property. Buyers are advised to inspect all lots before bidding and must rely solely on their own assessment. Quality and Completeness of Descriptions and Visuals Prospective purchasers are strongly advised to examine items prior to placing bids. Participation in the bidding process signifies acknowledgment of the opportunity for such inspection and confirmation that all decisions are based exclusively on your assessment or waiver thereof. All images and descriptions are intended solely for identification purposes and shall not be construed as guarantees or warranties. Description of Property Except where expressly indicated in writing, descriptions of lots are prepared through visual inspection and are intended solely for identification; no warranty is provided. Upper and Lower Projections When available, high and low estimates are intended solely as reference points and should not be construed as definitive indicators of final hammer price, intrinsic value, or future resale prospects. Please note that these estimates do not include the Buyer�s Premium. Announcements All announcements or postings made by the Auctioneer during the Auction take precedence over any prior advertisements or listings. Administration of the Auction The Auctioneer oversees every aspect of the Auction, ensuring its orderly conduct. All decisions rendered by the Auctioneer are final and binding. The Auctioneer exercises complete authority over the bidding process and the resolution of any disputes, retaining exclusive discretion to reopen bidding when deemed appropriate under specified circumstances. Agreement for the Sale of Personal Property The presence of a sale contract is established through these Terms and Conditions, together with the Auctioneer�s records detailing each lot, its price, and the purchaser. Collectively, these documents constitute the foundation of the contractual agreement. Payment All purchases are required to be paid in full by the specified pick-up date and time. Accepted payment methods are cash, approved check, credit card, certified funds, or wire transfer. Certified funds or wire transfer may be necessary for larger transactions. Shipments will be processed only after payment has cleared. Please note that payments made by debit or credit card are subject to an additional 5% Buyer�s Premium. Title Ownership will be transferred to the Buyer solely upon receipt of full payment credited to the auction account, notwithstanding any contractual obligations established upon confirmation of winning. Delivery; Sales Tax Lots will be delivered to their designated location as specified upon the conclusion of the auction. The Auctioneer assumes no responsibility for transferring lots to alternative locations. Agents are permitted to accept delivery on behalf of buyers. Sales tax will be applied in accordance with the jurisdiction where delivery occurs, unless an exemption is applicable. Buyers are responsible for any taxes imposed by other jurisdictions and must cooperate in rectifying any errors related to tax collection. Pick up and Removal; Shipping; Insurance The Buyer is obligated to remove lots in a timely manner, as indicated in posted notices or announcements. All disassembly, rigging, shipping, and transportation shall be conducted at the Buyer's own risk and expense. Any damage incurred during removal must be repaired by the Buyer. Shipments will be made free on board (FOB) at the specified location, with risk transferring to the Buyer upon shipment. Buyers are also responsible for arranging insurance coverage. Non-Collection or Delivery Arrangements; Abandonment of Property; Storage Procedures Any lots that are not collected within one (1) day after the designated pickup date shall be considered abandoned by the Buyer to the Auctioneer, irrespective of payment status. The Buyer will remain liable for the purchase price, and the Auctioneer retains the right to donate any abandoned item(s) to a charity of his choice or resale without credit to previous buyer. Please note that all sales are considered final. Please note that all auction purchases are final; refunds and returns are not available. No Credit Card Chargebacks The initiation of a credit card chargeback for auction purchases is expressly forbidden. In the event that a chargeback occurs contrary to these terms, this agreement will serve as evidence disputing its validity. Buyers are liable for all costs and fees resulting from unauthorized chargebacks. Acceptance of these conditions is required for registration and participation in the auction. Claims Unless otherwise specified in writing, once a Lot has been collected or removed by you or your representative, claims, returns, adjustments, or rescissions will not be permitted. Involvement of Third Parties and Subsequent Purchasers The Auctioneer maintains no affiliation with third parties or subsequent purchasers of Lot(s), and neither third parties nor subsequent purchasers shall rely on any statements or descriptions provided by the Auctioneer. Furthermore, the Auctioneer assumes no liability toward such individuals or entities. You agree to indemnify and hold the Auctioneer harmless against any claims brought forth by third parties or subsequent purchasers regarding any Lot(s) acquired by you. Buyer's Remedies; Bidders and Buyers Are Not Eligible for Incidental or Consequential Damages Should you be entitled to remedies in connection with the Auction, your sole and exclusive recourse shall be the return from the Seller of (i) the Hammer Price paid, and (ii) an amount equivalent to the Buyer's Premium. In no event shall the Auctioneer or Seller be liable for incidental or consequential damages, including but not limited to lost profits or diminished productivity. Furthermore, you acknowledge and agree that you are not eligible for specific performance or other forms of equitable relief. Remedies Available to Sellers If you fail to fulfil any obligations outlined in these Terms and Conditions or within a contract with a Seller, the property in question may be resold. You will be liable for all resulting damages, including any shortfall or reduction in the Contract Price, as well as incidental damages, and be blocked from future sales. Private Sale You are required not to engage in any Private Sale transaction with the Seller(s) of any Lot(s) before or during the Auction. Should you enter into such a transaction either prior to, during, or within three (3) days following the Auction (for Lot(s) unsold at the Auction), the Auctioneer shall be entitled to receive its full Commission and Buyer�s Premium, calculated as a percentage of the Private Sale Price, along with any reimbursable expenses. Both you and the Seller shall be jointly and severally responsible to the Auctioneer for payment of these amounts. Waiver Certain provisions within these Bidder Terms and Conditions are designed solely for the benefit of the Auctioneer and/or Seller(s). These provisions�including, but not limited to, Bidder registration and qualification requirements, payment terms, removal and delivery terms, and inspection terms�do not confer any rights or advantages upon other individuals, such as competing Bidders, and may not be enforced by them. The Auctioneer and/or Seller reserve the right, at their discretion and on either a global or case-by-case basis, to waive any provisions intended for their benefit; however, they are under no obligation to do so. Indemnification You hereby agree to indemnify and hold the Auctioneer harmless from any claims for damages arising from the Auction, any purchases made at the Auction, or any subsequent sale of Lots. Email Subscription; Consent to Receive Communications By agreeing, you consent to being included in the email list maintained by the Auctioneer. Each communication from the Auctioneer will include an unsubscribe link at the bottom. You also agree not to designate any emails sent by or on behalf of the Auctioneer as spam. Applicable Law and Dispute Resolution These Bidder Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia, including its statutes of limitations, but excluding its conflict of law principles. In the event of a dispute, the parties agree to first pursue mediation; if mediation does not result in resolution, the matter will proceed to binding arbitration. The mediator will be an impartial individual mutually selected by both parties and situated within thirty (35) miles of Harrisonburg, Virginia. If the dispute remains unresolved within thirty (30) days following submission to mediation, it will be referred to binding arbitration before a single neutral arbitrator, also mutually agreed upon, located within the same geographic area. Arbitration proceedings must be concluded within sixty (60) days from the commencement date. The arbitrator�s decision shall be final, binding on all parties, and not subject to appeal. All costs associated with mediation or arbitration shall be divided equally among the parties. If the parties are unable to mutually select a mediation or arbitration venue within thirty (35) miles of Harrisonburg, Virginia, they irrevocably submit to the exclusive jurisdiction of the courts located in the City of Harrisonburg, Virginia for resolving disputes. Should any dispute be addressed through civil litigation rather than mediation or arbitration, all related expenses�including reasonable attorney�s fees incurred by the prevailing party�shall be promptly reimbursed by the losing party. The right to a jury trial is hereby waived.

These Bidder Terms and Conditions govern auctions conducted by Larry Wittig Auctioneer and Associate LLC ("Auctioneer") and constitute a valid, legally binding contract between the Auctioneer and each participating Bidder. These terms equally provide the foundation for the contract of sale between Seller and Buyer. For purposes of these Bidder Terms and Conditions, "YOU" refers to each Bidder as defined herein. Bidder Terms and Conditions; Posted Terms; Auction Announcements; Agreement to Be Bound. Auctions are conducted pursuant to these Bidder Terms and Conditions, as well as all other terms posted on the Auctioneer�s website(s) and those of any Online Auction Platform Provider(s) employed by the Auctioneer. The Auction may be subject to additional announcements or corrections by the Auctioneer. By participating in any manner, YOU affirm your agreement to these Bidder Terms and Conditions. The key terms are defined as: "Auction" denotes an online auction conducted by the Auctioneer. "Bidder" encompasses any individual or entity, including their agents or representatives, who registers, bids, purchases, or otherwise participates in the Auction (including inspection and pick-up), regardless of whether a bid is submitted. "Bidder Account" refers to the identifier assigned to a Bidder by the Auctioneer. "Bidder Registration" comprises the information provided by prospective Bidders and the registration process, which includes acceptance of the Bidder Terms and Conditions. �Buyer� identifies the Winning Bidder for a Lot, "Buyer's Premium" signifies a percentage of the Hammer Price payable by the Buyer to the Auctioneer. "Contract Price" is defined as the sum of the Hammer Price and the Buyer's Premium. "Delivery" is the transfer of possession of Lot(s) to the Buyer at a location specified by the Auctioneer, unless otherwise agreed; the Auctioneer is not required to relocate any Lot unless expressly provided in writing. "Fall of the Hammer" indicates the moment at which the Auctioneer formally declares a Lot sold, either in person or electronically, to the recognized Winning Bidder. "Hammer Price" is the highest bid accepted at that time. "High Bid" and "High Bidder" refer to the leading bid and its originator, respectively. "High Estimate" and "Low Estimate" indicate anticipated bidding ranges but do not represent appraisals. "Lot" refers to each item or grouping offered for sale. "No Sale" applies when a Lot is withdrawn or remains unsold. "Online Auction Platform" represents the technological system used for online bidding, "Online Auction Platform Provider" is its operator. "Private Sale" and "Private Sale Price" relate to transactions and corresponding values occurring outside the Auction setting. "Reserve" or "With Reserve" grants the Auctioneer discretion to withdraw Lots or reject bids post or prior to the Fall of the Hammer; unless specifically stated otherwise, all Lots are sold With Reserve. The "Reserve Price" is the minimum price acceptable, which may remain undisclosed. "Winning Bid" and "Winning Bidder" pertain to the accepted highest bid and its submitter. "Without Reserve" designates an Absolute auction. Bidder Registration; Qualification. Registration is required for participation in bidding. The Auctioneer sets forth all necessary requirements and qualifications for registration at their discretion. Bidders must submit information and documentation as requested to establish eligibility. The Auctioneer reserves the exclusive right to deny registration, restrict bidding privileges, or withdraw existing privileges at any time. By registering, individuals confirm they are at least eighteen (18) years of age and possess legal capacity to enter into contracts; entities similarly confirm they have the requisite authority to register and transact. Participation signifies full acknowledgment of and agreement to all applicable terms and conditions. The Auctioneer retains sole discretion to accept bids from unregistered parties, who will be subject to these terms. All qualification provisions are intended exclusively for the benefit of the Auctioneer and Seller, and do not extend rights to other parties. The Auctioneer and/or Seller reserve the right to waive any such qualifications as they deem appropriate. Jurisdiction. All bids and payments shall be considered received within the Commonwealth of Virginia, regardless of the physical location of the Bidder or Lot. Buyer�s Premium. A Buyer's Premium equivalent to ten percent (10%) of the Hammer Price shall be added to each Lot's Hammer Price to establish the final Contract Price not including any credit card charge fee. This premium is retained by the Auctioneer. Access and Reviews. Participants acknowledge and accept all risks associated with accessing the Auction, whether through online platforms or at any premises affiliated with the Auctioneer. Access may be restricted at the sole discretion of the Auctioneer. The Auctioneer also reserves the right to publish accurate reviews pertaining to Bidder conduct. Nature of the Auction. Unless stated otherwise, all auctions are conducted with reserve, and lots may be withdrawn at any time before the fall of the hammer. Bid Retraction After acknowledgment by the Auctioneer or submission through the online platform, bids are considered final and may not be withdrawn. The withdrawal of bids is strictly prohibited as it interferes with the orderly conduct of the Auction and violates the terms of participation. Timing All times indicated are in Eastern Standard Time (EST). Closing times are estimated and may be adjusted at the sole discretion of the Auctioneer. Online Bids; Maximum Bid Amounts A maximum bid amount may be specified by the bidder. Online bidding typically begins at either the opening bid or the next increment, which may be lower than the maximum bid entered. Bids will be automatically executed up to the point at which the Hammer falls or bidding concludes. The submission and execution of online bids does not create an agency relationship between the Auctioneer and the bidder. Party relationship The Auctioneer serves exclusively as the agent for the Seller(s) and does not represent or act on behalf of the bidder. Bid Increments The Auctioneer reserves the right to determine and adjust bid increments at their sole discretion. Records Except in cases of clerical error, the records maintained by the Auctioneer shall be considered definitive and binding for all purposes. Interruptions in website connections The Auctioneer shall not be held liable for any interruptions or malfunctions affecting website connectivity, including but not limited to connection issues, platform errors, or equipment failures. At the Auctioneer's discretion, the auction schedule may be modified in response to such disruptions; however, such adjustments are not obligatory. Shortcomings of Online Auction Platform Operators and Their Partners The Auctioneer may utilize third-party online auction platforms; however, the Auctioneer assumes no liability for any matters concerning Hibid or its affiliates. Soft Close (Auto-Extend Feature) If an online bid is submitted within one (1) minute of the scheduled auction closing time, the bidding period shall automatically be extended by one (1) additional minute. This extension process will repeat until no further qualifying bids are received during any subsequent one-minute interval, at which time the auction will officially close. Statement Concerning Online Auction Platform(s) The Auctioneer makes no representations or warranties regarding the uninterrupted or error-free operation of any Online Auction Platform(s) or related technology, and does not guarantee the results, accuracy, completeness, reliability, or security of these systems. Accountability Regarding Online Bidding You are fully responsible for all bids submitted via your computer or Bidder Account. Upon confirmation by the Auctioneer, any successful bid placed from your account will result in your designation as the Buyer. Successful bidders are subject to final certification by the auctioneer. The Auctioneer possesses exclusive authority to officially confirm the winning bidder; electronic notifications are not considered a final determination. Successful Bid; Buyer The person placing the highest bid on any Lot will be designated as the Buyer, subject to final confirmation by the Auctioneer. Bidders Inspection All property is offered for sale in its existing condition and location, inclusive of any known or unknown defects. Prospective purchasers are strongly encouraged to perform comprehensive due diligence, as all transactions adhere to the principle of caveat emptor (Buyer Beware). Each item is sold as-is, with all faults, including latent defects. Neither the Auctioneer nor the Seller makes any warranty or representation regarding the quality, value, function, authenticity, or suitability of any property. Buyers are advised to inspect all lots before bidding and must rely solely on their own assessment. Quality and Completeness of Descriptions and Visuals Prospective purchasers are strongly advised to examine items prior to placing bids. Participation in the bidding process signifies acknowledgment of the opportunity for such inspection and confirmation that all decisions are based exclusively on your assessment or waiver thereof. All images and descriptions are intended solely for identification purposes and shall not be construed as guarantees or warranties. Description of Property Except where expressly indicated in writing, descriptions of lots are prepared through visual inspection and are intended solely for identification; no warranty is provided. Upper and Lower Projections When available, high and low estimates are intended solely as reference points and should not be construed as definitive indicators of final hammer price, intrinsic value, or future resale prospects. Please note that these estimates do not include the Buyer�s Premium. Announcements All announcements or postings made by the Auctioneer during the Auction take precedence over any prior advertisements or listings. Administration of the Auction The Auctioneer oversees every aspect of the Auction, ensuring its orderly conduct. All decisions rendered by the Auctioneer are final and binding. The Auctioneer exercises complete authority over the bidding process and the resolution of any disputes, retaining exclusive discretion to reopen bidding when deemed appropriate under specified circumstances. Agreement for the Sale of Personal Property The presence of a sale contract is established through these Terms and Conditions, together with the Auctioneer�s records detailing each lot, its price, and the purchaser. Collectively, these documents constitute the foundation of the contractual agreement. Payment All purchases are required to be paid in full by the specified pick-up date and time. Accepted payment methods are cash, approved check, credit card, certified funds, or wire transfer. Certified funds or wire transfer may be necessary for larger transactions. Shipments will be processed only after payment has cleared. Please note that payments made by debit or credit card are subject to an additional 5% Buyer�s Premium. Title Ownership will be transferred to the Buyer solely upon receipt of full payment credited to the auction account, notwithstanding any contractual obligations established upon confirmation of winning. Delivery; Sales Tax Lots will be delivered to their designated location as specified upon the conclusion of the auction. The Auctioneer assumes no responsibility for transferring lots to alternative locations. Agents are permitted to accept delivery on behalf of buyers. Sales tax will be applied in accordance with the jurisdiction where delivery occurs, unless an exemption is applicable. Buyers are responsible for any taxes imposed by other jurisdictions and must cooperate in rectifying any errors related to tax collection. Pick up and Removal; Shipping; Insurance The Buyer is obligated to remove lots in a timely manner, as indicated in posted notices or announcements. All disassembly, rigging, shipping, and transportation shall be conducted at the Buyer's own risk and expense. Any damage incurred during removal must be repaired by the Buyer. Shipments will be made free on board (FOB) at the specified location, with risk transferring to the Buyer upon shipment. Buyers are also responsible for arranging insurance coverage. Non-Collection or Delivery Arrangements; Abandonment of Property; Storage Procedures Any lots that are not collected within one (1) day after the designated pickup date shall be considered abandoned by the Buyer to the Auctioneer, irrespective of payment status. The Buyer will remain liable for the purchase price, and the Auctioneer retains the right to donate any abandoned item(s) to a charity of his choice or resale without credit to previous buyer. Please note that all sales are considered final. Please note that all auction purchases are final; refunds and returns are not available. No Credit Card Chargebacks The initiation of a credit card chargeback for auction purchases is expressly forbidden. In the event that a chargeback occurs contrary to these terms, this agreement will serve as evidence disputing its validity. Buyers are liable for all costs and fees resulting from unauthorized chargebacks. Acceptance of these conditions is required for registration and participation in the auction. Claims Unless otherwise specified in writing, once a Lot has been collected or removed by you or your representative, claims, returns, adjustments, or rescissions will not be permitted. Involvement of Third Parties and Subsequent Purchasers The Auctioneer maintains no affiliation with third parties or subsequent purchasers of Lot(s), and neither third parties nor subsequent purchasers shall rely on any statements or descriptions provided by the Auctioneer. Furthermore, the Auctioneer assumes no liability toward such individuals or entities. You agree to indemnify and hold the Auctioneer harmless against any claims brought forth by third parties or subsequent purchasers regarding any Lot(s) acquired by you. Buyer's Remedies; Bidders and Buyers Are Not Eligible for Incidental or Consequential Damages Should you be entitled to remedies in connection with the Auction, your sole and exclusive recourse shall be the return from the Seller of (i) the Hammer Price paid, and (ii) an amount equivalent to the Buyer's Premium. In no event shall the Auctioneer or Seller be liable for incidental or consequential damages, including but not limited to lost profits or diminished productivity. Furthermore, you acknowledge and agree that you are not eligible for specific performance or other forms of equitable relief. Remedies Available to Sellers If you fail to fulfil any obligations outlined in these Terms and Conditions or within a contract with a Seller, the property in question may be resold. You will be liable for all resulting damages, including any shortfall or reduction in the Contract Price, as well as incidental damages, and be blocked from future sales. Private Sale You are required not to engage in any Private Sale transaction with the Seller(s) of any Lot(s) before or during the Auction. Should you enter into such a transaction either prior to, during, or within three (3) days following the Auction (for Lot(s) unsold at the Auction), the Auctioneer shall be entitled to receive its full Commission and Buyer�s Premium, calculated as a percentage of the Private Sale Price, along with any reimbursable expenses. Both you and the Seller shall be jointly and severally responsible to the Auctioneer for payment of these amounts. Waiver Certain provisions within these Bidder Terms and Conditions are designed solely for the benefit of the Auctioneer and/or Seller(s). These provisions�including, but not limited to, Bidder registration and qualification requirements, payment terms, removal and delivery terms, and inspection terms�do not confer any rights or advantages upon other individuals, such as competing Bidders, and may not be enforced by them. The Auctioneer and/or Seller reserve the right, at their discretion and on either a global or case-by-case basis, to waive any provisions intended for their benefit; however, they are under no obligation to do so. Indemnification You hereby agree to indemnify and hold the Auctioneer harmless from any claims for damages arising from the Auction, any purchases made at the Auction, or any subsequent sale of Lots. Email Subscription; Consent to Receive Communications By agreeing, you consent to being included in the email list maintained by the Auctioneer. Each communication from the Auctioneer will include an unsubscribe link at the bottom. You also agree not to designate any emails sent by or on behalf of the Auctioneer as spam. Applicable Law and Dispute Resolution These Bidder Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia, including its statutes of limitations, but excluding its conflict of law principles. In the event of a dispute, the parties agree to first pursue mediation; if mediation does not result in resolution, the matter will proceed to binding arbitration. The mediator will be an impartial individual mutually selected by both parties and situated within thirty (35) miles of Harrisonburg, Virginia. If the dispute remains unresolved within thirty (30) days following submission to mediation, it will be referred to binding arbitration before a single neutral arbitrator, also mutually agreed upon, located within the same geographic area. Arbitration proceedings must be concluded within sixty (60) days from the commencement date. The arbitrator�s decision shall be final, binding on all parties, and not subject to appeal. All costs associated with mediation or arbitration shall be divided equally among the parties. If the parties are unable to mutually select a mediation or arbitration venue within thirty (35) miles of Harrisonburg, Virginia, they irrevocably submit to the exclusive jurisdiction of the courts located in the City of Harrisonburg, Virginia for resolving disputes. Should any dispute be addressed through civil litigation rather than mediation or arbitration, all related expenses�including reasonable attorney�s fees incurred by the prevailing party�shall be promptly reimbursed by the losing party. The right to a jury trial is hereby waived.
