PLEASE NOTE: Many vehicles have been sitting idle for some time. Some vehicles require, at a minimum, a jump start, air for tires, tow or more. Many vehicles are not initially roadworthy and require inspection and repair, if necessary, by a trained automotive professional. Successful bidders must possess the ability and where-with-all to provide appropriate manpower and equipment to remove their purchases from the auction site. VIN's are provided for bidders to do their own due diligence.

Auction Terms & Conditions: Auction Agreement: By participating in this auction the bidder agrees to the following terms and conditions:

Location: Fleet Distribution Center, 100 East Broadway, Hackensack, New Jersey 07601

Auction Preview: Vehicles will be available for inspection on Friday, December 12 from 10:00 am to 3:00 pm and the morning of the Auction, Saturday, December 13 from 9:00 am to 11:00 am @ 100 East Broadway, Hackensack, NJ 07601. All prospective bidders are encouraged to attend and inspect the vehicles prior to placing a bid.

Although you may be approved to bid online we encourage all bidders to inspect each vehicle and bid live onsite.

In order to be approved to bid on-line you must register with a current valid credit card which may be used as a deposit towards the purchase price.

An eight percent (8%) buyer's premium is in effect for all on-line sales.

On-site bidders will be required to register with a current valid driver's license and tender a 25% deposit immediately upon the knockdown of the bid and before the next vehicle is offered.

A five (5%) buyer's premium is in effect for all on-site sales.

Payment: Invoices for successful on-line bidders will be available in the winning bidder's account after the conclusion of the auction (i.e. last lot sold). Invoices for successful on-site bidder's will be available at the auction site immediately following the conclusion of the auction.

At the conclusion for the Auction we offer multiple ways to pay for your purchase (Prior to Removal) but in no case later than Monday, December 15 by 3:00 pm:

1) Cash; 2) Pre-Approved Company Checks (Contact the Auction Company Prior to Bidding); 3) Certified or Cashier's checks; 4) Wire Transfer.

Pick Up & Removal: Pick up will begin immediately following the auction until 3:00 pm and Monday, December 13 from 9:00 am to 3:00 pm. All vehicles must be paid for in full and removed from the auction site no later than Monday, December 13 by 3:00 pm.

Pick Up Location: Fleet Distribution Center, 100 East Broadway, Hackensack, New Jersey 07601 (Across the street from J Fletcher Creamer & Son Inc.)

Removal: The buyer will be responsible for bringing help and appropriate equipment to retrieve their vehicles without the assistance of the Auction Company. Some vehicles may not start, have flat tires and may require towing. Any vehicle(s) not removed by Monday, December 15 by 3:00 pm will be considered abandoned and will be removed from the auction site by a local towing company and the successful bidder will be responsible for all towing, storage and other associated fees.

Documentation: Each successful bidder must provide a current valid driver’s license (a copy of which will be maintained by the Prosecutor's Office) in order to receive a Bill of Sale and Title, which will be made out in the name of the purchaser. No open titles will be issued and the Bergen County Prosecutor will not issue replacement titles for a lost, stolen or missed placed title.

Theft: Any instances or theft or vandalism will be prosecuted to the full extent of the law. Security surveillance cameras are present at this location.

Shipping: The Auction Company does not ship. Buyers may either pick up their vehicles at the auction site personally or can arrange for a third-party logistics firm to manage the removal process for them. If someone other than the registered buyer is designated to pick up the vehicle, the buyer must contract with an independent logistics firm or other representative who will ship your vehicle to meet the deadlines indicated in this auction and authorize the Auction Company to release the vehicle to a third party for shipping purposes. Further, the Auction Company is not affiliated with any transport company. We provide the names and contact information of available companies solely as a courtesy to our buyers and do not endorse or guarantee their services and are not responsible for any damage, omission or other problems incurred as a result of their actions.

Local Towing Company: All Points Towing 201-522-1732

Buyer's Premium: There is a five percent (5%) buyer's premium for all on-site sales and an eight percent (8%) buyer's premium for all on-line sales made at this auction.

Sales Tax: No Sales Tax Will Be Collected. Sales Tax Will Be Collected Upon Registration with the Department of Motor Vehicles.

The Auction Company does not give or make any type of guarantee or warranty regarding the vehicles to be sold, implied or otherwise as to the quality, condition, performance, mileage or nomenclature of any vehicle to be offered, so buyer beware. ALL SALES ARE FINAL: There are no returns, refunds, adjustments, credit or exchanges once the vehicle has left the auction site.

Risk of Loss: Vehicles becomes the full responsibility of the bidder at time of payment and the bidder assumes all risk of loss and damage to the item(s) at that time.

Debt Collection and Interest Charges: The bidder agrees to pay all reasonable attorney fees and other costs incurred by the Auction Company in its efforts to collect unpaid funds from the bidder. The bidder agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due the Auction Company. In addition, in case of a default, the defaulting bidder will be responsible for any shortfall, should the vehicle be resold at a price that is lower than the highest bid.

Guaranty Agreement: By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to the Auction Company for any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee.

Resale: The Auction Company reserves the right to resell any vehicle not paid for in full by the conclusion of the stated pickup period. In any such event, the bidder will still be responsible for payment for the original purchase, buyer’s premium, any shortfall and the costs of collection of this payment and/or damages resulting from the resale of the vehicle as well as towing, storage and other associated costs.

Limitation of Liability: If, for any reason, the Auction Company is unable to make available or deliver any purchase, or portion thereof, or documentation required in respect of any purchase, the sole liability of the Auction Company, if any, shall be the return of monies paid in respect of such purchase upon its return by Purchaser. In addition, each prospective bidder must sign an Acknowledgement of Auction Terms and a Waiver & Release at time of registration and/or removal.

Age Requirement: All bidders must be 21 years of age or older.

Bidder Information and Security: All registration information the bidder provides to the Auction Company shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders guarantee that the information they supply to the Auction Company is accurate. Risk of Loss: Vehicles becomes the full responsibility of the bidder at time of payment and the bidder assumes all risk of loss and damage to the item(s) at that time. Debt Collection and Interest Charges: The bidder agrees to pay all reasonable attorney fees and other costs incurred by the Auction Company in its efforts to collect unpaid funds from the bidder. The bidder agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due the Auction Company. In addition, in case of a default, the defaulting bidder will be responsible for any shortfall, should the vehicle be resold at a price that is lower than the highest bid. Guaranty Agreement: By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to the Auction Company for any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee. Resale: The Auction Company reserves the right to resell any vehicle not paid for in full by the conclusion of the stated pickup period. In any such event, the bidder will still be responsible for payment for the original purchase, buyer’s premium, any shortfall and the costs of collection of this payment and/or damages resulting from the resale of the vehicle as well as towing, storage and other associated costs. Limitation of Liability: If, for any reason, the Auction Company is unable to make available or deliver any purchase, or portion thereof, or documentation required in respect of any purchase, the sole liability of the Auction Company, if any, shall be the return of monies paid in respect of such purchase upon its return by Purchaser. In addition, each prospective bidder must sign an Acknowledgement of Auction Terms and a Waiver & Release at time of registration and/or removal. Age Requirement: All bidders must be 21 years of age or older. Bidder Information and Security: All registration information the bidder provides to the Auction Company shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders guarantee that the information they supply to the Auction Company is accurate.
