1. READ. ALL. THE. TERMS. AND. CONDITIONS! You are required to check a box stating that you've read these. Please do not just check the box without reading the terms. This will prevent misunderstandings later.

1a. CONDITION of ITEMS - INSPECTION: *****IMPORTANT***** All items are sold AS-IS, WHERE-IS with no warranties expressed or implied. That means COME TO THE INSPECTION. If you don't or can't, READ THE DESCRIPTION of the item and LOOK AT ALL PHOTOS. If you don't see something (such as cords, remotes, accessories, etc.) in the photos, DON'T ASSUME IT'S THERE. Most items are USED and may have condition issues. If we do not explicitly say we have tested it, do not assume we have. There are typically measurements of larger items or size references in photos, so please look at ALL pictures before making a request for info. We can't guarantee that we have found ALL flaws on every item and photographed them, but we make every effort to do so. By bidding you agree to accept items in their current condition, whether you have inspected or chosen not to, flaws and all, pictured or unpictured. Do not expect to return items if you find a scratch or a crack or other flaw that wasn't clearly shown. You are EXPECTED TO ATTEND INSPECTION to discover flaws or send someone or ask questions. When in doubt, sit it out!

Definitions: "Untested" - Means we have not powered up an item or tested any functions. Power cords might be missing, gas items may have no gas. It means we have NO operational info so bid at your own risk. "Powers up" means we flipped a switch and something happened. That's all. We do not test all functions. This is easy for a drill, but for something more complicated, assume we only turned it on and nothing else. To attempt to test the full functionality of every item would be ridiculously cumbersome. Come to inspection and we'll let you plug it in and decide for yourself.

1b. INFO REQUESTS: We encourage you to ask questions about items and we will respond to the best of our knowledge... However, like anyone else, we deserve some time off. We are NOT always at the gallery on weekends and we are certainly not there 15 minutes before the auction closes, so PLEASE do not expect answers to specific questions that require us to look at the item that close to auction closing time. Look at ALL photos and read all of the description. If your questions are not answered by that info, DO NOT BID.

1c. FIREARMS and AMMO: IMPORTANT! Firearms and ammo are sold for CASH ONLY, IN- PERSON with no shipping. Our credit card processors do not allow transactions for firearms and ammo. Ammo can be picked up at the auction gallery. For FIREARMS, your purchase must be paid for IN CASH at the auction gallery. We will provide a paid receipt for pick up at Tiller & Lanier Guns where the final transfer will occur. Tiller & Lanier will collect a $40 transfer fee from you before turning over possession.

Understand that you will be subject to a NICS check when purchasing firearms.

If Your Firearm Is Not Picked Up Within 14 Days Of Auction Closing, Your Item Will Be Forfeited And No Refund Provided. Please Pick Up Your Winnings!

If you do NOT pass a NICS check, your item will be forfeited without a refund. Please do NOT bid on firearms if you will not pass a NICS check.

1d. AUCTION EQUIPMENT PICTURED IS NOT INCLUDED: Any rack, tray, dolly or other piece of equipment pictured and on which items offered for auction sit upon IS NOT INCLUDED with the lot unless it is specifically stated that such equipment is included. Example: Items pictured on a tray do not include the tray, and furniture pictured sitting on a wheeled dolly does not include the dolly. A lot of items photographed on a rack DOES NOT include the rack.

1e. Before you contact us about an issue involving an item, you must honestly answer YES to the following questions.

Before you bid on the item, did you:
- Read ALL the terms and conditions and not just quickly check the box saying that you did?
- Did you CAREFULLY read the lead AND entire description?
- Did you look at ALL the photos and not just the first one?
- Did you take note of ALL size references and those in the lead and decription?
- Did you read about the Buyer's Premium and tax collected?
- Did you attend inspection?
- If you didn't attend inspection because you live too far away, did you contact us to ask questions BEFORE the weekend. Contacting us 1 hour before auction closing doesn't count.

If the answer is NO to any question, understand you are taking a larger risk when you buy a used / AS-IS item.

1f. The auctioneer reserved the right to remove or change a lot in the auction due to an error in the listing or per the sellers request.

1g. Auction Orange reserves the right to update our Terms and Conditions at any time and without notice.

1h. Auction Orange, at any time reserves the right to reject any bid or decline any bidder during the auction.

2. BUYERS PREMIUM: A 18% Buyer's Premium applies to all purchases. There are no discounts for cash payments. Starting a January 1, 2025, the buyers premium will increase to 18% applies to all purchases.

2a. PAYMENTS: Our system will charge the credit card on file AUTOMATICALLY after the close the auction UNLESS you are a first time buyer requiring shipping or picking up of gold, jewelry, coins, or similar rare or expensive items, OR if the auctioneer requests an alternate payment method.

For all transactions, invoices are to be settled within 48 hours of the auction closing time. Any invoices open after that time may, at the auctioneer's discretion, be voided and items resold. Buyers who fail to settle purchases within 48 hours may be banned from bidding in all future sales. This may affect the Buyer's ability to register and bid at other sales as well. Auction Company does NOT accept personal or business checks without prior authorization.

Auctioneer reserves the right to require a wire transfer or other form of guaranteed payment from those buyers known or not known to us, particularly if you are not in the immediate geographic area of the auction gallery and /or if you are purchasing gold, jewelry, coins or precious metals, or if you've made a purchase over $250.

Auctioneer reserves the right to require a wire transfer or other form of guaranteed payment from a previously registered buyer who has not purchased items in the previous six months or current buyer who has made a purchase over $250.00.

If you are not in our geographic area and your credit card declines, the only alternate payment method is a wire transfer, Zelle, or the original credit card on file. This is due to a high incidence of fraud. Purchases will be automatically charged to the credit card on file at the close of the auction unless an alternative payment method is requested by the auctioneer.

Any purchase over $750.00 may require a wire transfer or Zelle payment.

Should your card get declined as a first time buyer requiring shipping, a zelle payment or wire transfer will be required.

Vehicles, trailers, golf carts, boats, riding lawnmowers, heavy equipment or items similar will require a wire transer or cash payment. Checks and credit / debit cards will not be an accepted form of payment.

Declined credit cards may be subject to a $20 administration fee, so please be sure cards are valid before registering.

2b. TAX EXEMPT BUYERS: Buyers are considered tax exempt ONLY if we have a valid 595E Tax Exempt Form already on file AT THE TIME YOU REGISTER.. Any forms filled out AFTER auction closing will be tax exempt for the NEXT auction. No sales tax will be refunded if a form IS NOT on file at the time of registration.

2c. VEHICLES OR TITLED ITEMS: All items sold as is where is. Accepted form of payment is Cash, Zelle or Wire Transfers. Debit and credit cards or checks will not be accepted. Buyer agrees to meet seller at DMV for title transfer. Vehicle will be released once proof of title transfer is completed. Title must go in registered buyers name. Auction Orange is not repsonsible for any title delay.

3. SALES TAX: NC sales tax will be charged on all purchases unless you have a valid, original, signed reseller certificate on file or are otherwise exempt from paying sales tax -(documentation required).

4. AUCTIONEER DECISONS IN DISPUTES: In all disputes, the decision of the auctioneer is FINAL. Auction company may refuse bids for any reason.

5. INTERNET CONSIDERATIONS: Bidders understand that the internet, wifi connections, servers and the like are not always reliable and that bids placed, may not be received in a timely fashion or at all. It is strongly recommended that bidders bid EARLY by using the Max Bid feature in case of any connection, server or internet issues at the closing of the auction. Auctioneer has the right to stop, delay or extend the auction if possible in the event of any issue that may, in the opinion of the auctioneer, affect the ability of bidders to submit bids. If you are having bidding issues before the live closing, please contact us and we'll attempt to help. We can not reopen bids or change results if you have an isolated incident that leaves you unable to bid. Servers, platforms, routers, cables, modems, and computers can have individual problems or communication errors beyond our control and auction results cannot be changed because of them.

5a. LOT TIME EXTENSIONS: Our auctions utilize a SOFT CLOSE mechanism. That means the TIME WILL BE EXTENDED by 2 minutes on any lot receiving a bid with less than 2 minutes remaining. This gives the outbid bidder (which could be you) an opportunity to place another bid. This could cause an item to stay open for a good while as people continue bidding. The auction will close when NO bids have been received in the last two minutes. Note: This is NOT like ebay where you can slip a bid in at the end and snatch an item in the last seconds. Also, if you are not bidding from the LIVE CATALOG, bid statuses do not automatically update so you could be outbid and not know it. Be sure you are bidding from the LIVE CATALOG screen at closing time.

6. PICK UP: Pick up times are noted in the auction description. PICK UP is ON PICK DAY so unless you are having items shipped, please be prepared to come at the designated time. We cannot guarantee availability of staff at any other time besides pick up times. You are welcome to send someone to pick up your purchases if we know in advance. Later pickup will be charged at $10/ day for storage ($10 PER ITEM PER DAY for furniture). We do not have space to store items, so we must move them around which uses labor and increases chances for loss and breakage.

Failure to pick up items within 14 days after the auction closing time (7 days for furniture) will result in items being considered abandoned. Abandoned items will become property of the auction company to be resold for storage fees without a refund. Failure to pick up items in a timely manner will result in restricted bidding privileges. Buyers purchasing large or heavy items, MUST bring appropriate vehicles and sufficient help to load.

7. SHIPPING: If your address is more than 50 miles from the gallery, we may automatically assume you require shipping unless informed otherwise.

Shipping is done in house and will be packed and invoice sent as early as Monday afternoon follwoing the auction. Invoice for shipping includes box fees, packing fee and postage expense. Packing materials are free of charge.

Please note we will ONLY ship to the address associated with the registered credit card. We will not ship to a different address.

Large, heavy items will not be shipped unless buyer pays a firm to properly palletize and wrap such items. If you desire shipping on a larger item, you must contact the auction house FIRST to verify the item can be shipped.

If the shipping invoice is not paid within 2 weeks, the items are considered to be abandoned. Such items will become property of the Auction Company and may be disposed of sold to cover labor, storage and administrative fees associated with handing, and or re-listing the items. No refunds will be provided on abandoned items so please be sure all registration info is up to date so you can be contacted in a timely fashion if you require shipping.

Buyer assumes ALL risks of loss damage or breakage after items leave our facility. We cannot control what occurs after items leave our facility, so you are STRONGLY ENCOURAGED to purchase INSURANCE when shipping to protect purchases.

We do NOT accept prepaid shipping labels.

8. ITEMS SOLD "TIMES THE MONEY": Many items are "times the bid", meaning that your bid is multiplied times the number of items indicated IN RED on the listing, where you bid, and in the title as the quantity followed by "X". Bidder is responsible for knowing this considering it is in THREE places in the live catalog. We will not reverse bids on lots that are already closed due to "not knowing" or "not seeing" that the lot was sold "times the money" or for any other reason. Bidder is responsible for knowing the indicated quantity is "times the money." If you're unsure, ask and we'll gladly explain.

9. Auctioneer reserves the right to add or remove items anytime throughout the auction.

Before you bid on the item, did you: - Read ALL the terms and conditions and not just quickly check the box saying that you did?

Listing Terms and Conditions
Auction Orange 1930 Castle Hayne Road Ste 150 Wilmington, NC 28401 Melissa Hefner NCAL#10431 NCAFL#10792 FFL 1-56-129-01-7E-18720 704-258-4751 1. READ. ALL. THE. TERMS. AND. Before you bid on the item, did you: - Read ALL the terms and conditions and not just quickly check the box saying that you did?
