Whitaker Marketing Group � Online Only Auction Terms & Conditions

1. Bidding Agreement
By registering and placing a bid, you agree to these Terms and Conditions. Bids are legally
binding. All items are sold AS IS, WHERE IS, with no warranties expressed or implied. It is
the bidder's responsibility to inspect and assess item condition and suitability.

2. Item Descriptions
Item descriptions take precedence over photos. If an item is unclear, contact our office
before bidding. Bids cannot be removed once placed.

3. Due Diligence
All sales are final. Whitaker Marketing Group is not responsible for errors, omissions, or
failures in item descriptions, internet service, or bidding platforms. Bid accordingly.

4. Auctioneer Rights
We reserve the right to:
- Add, remove, split, or combine lots
- Set or change reserve prices
- Cancel, suspend, or extend auctions or individual lots
- Refuse service to anyone

5. Buyer�s Premium
A Buyer�s Premium (e.g., 5%) will be added to each purchase. The final amount = winning
bid + buyer�s premium. Confirm total bid each time before placing a bid.

6. Bidding Process
This is a maximum bid auction. You may place a higher bid than the current asking price.
The system will auto-bid on your behalf up to your max. If two identical max bids are
entered, the earliest wins. Outbid notifications are optional, but recommended.
(Notice: If anyone bids on any item during the close of the auction, the bidding will be extended for ALL items. All bidding will be extended until no more bids are received.)

Whitaker Marketing Group is not responsible for internet delays, glitches, or lost
notifications. Bid early to avoid last-minute issues.

7. Email & Account Responsibility
A valid email address is required. It is your responsibility to ensure email delivery from our
system. All communication, invoices, and updates are sent via email. Your bidder profile
must be kept current.

8. Payment Terms
- Payment is due immediately at auction close.
- Accepted cards: Visa, MasterCard, Discover (USD only)
- Cards may be charged automatically at close.
-Invoices Above $1500 will be given the option of ACH (electronic check) or wire transfer.
- No refunds, and no chargebacks.

Invoices over $1,500 must be paid via wire transfer or certified funds, unless pre-approved.
Failed payments are subject to a $25 fee per attempt. Defaulted accounts may be blacklisted.

Invoices will include item details, total charges, and pickup instructions. You must present a
paid invoice (print or digital) to collect items.

9. Pickup & Loadout
Pickup times and locations are posted in each auction listing. Items must be collected during
the scheduled time only or when arrangements have been made and agreed upon. No early or late pickups allowed. If items are not picked up within 2 weeks of the close of the auction then those items will be considered a forefeit and the item will be resold. No refund will be given.

Buyers are responsible for removing all items they purchase from the auction site. Any
items left behind may be considered abandoned, and are subject to disposal at the buyer�s
expense. Whitaker Marketing Group reserves the right to charge a disposal or hauling fee to
cover labor, equipment, and removal costs.

Bring your own packing materials, tools, and sufficient help. Our staff is not responsible for
loading or disassembly unless explicitly arranged in advance. Buyers must complete
removal within the posted pickup window.

Failure to follow pickup terms may result in:
- A $20+ per item hauling or convenience fee
- Loss of item ownership without refund
- Blacklisting from future auctions

Buyers are also liable for any damage caused to items or property during removal.

10. Legal & Liability
- All items sold as-is. No returns.
- Whitaker Marketing Group may describe items to the best of our ability, but provides no
guarantees.
- Internet bidding is provided as a courtesy, but we are not liable for platform failures or
missed bids.
- Bidders are responsible for knowing what they are bidding on, but mistakes will not void a
bid.
- Auctioneer may accept or reject any bid in the best interest of the seller.
- Buyer indemnifies Whitaker Marketing Group and sellers from any claims or damages
arising from auction participation or item removal. Whitaker Marketing Group will enforce
these terms to the fullest extent possible.

11. Breach of Terms
Failure to comply with these terms may result in:
- Legal action to recover bid amounts
- Liquidated damages
- Resale of item(s) at buyer's expense
- Blacklisting from future auctions

12. Disclaimers
All listing details are believed accurate, but not guaranteed. Buyers are encouraged to
inspect items or ask questions prior to bidding.

13. Shipping
Whitaker Marketing Group does not guarantee shipping services on any auction unless
explicitly stated in the auction listing.

Shipping Disclaimer: Payment for shipped items is final - no chargebacks or refunds will be processed. By requesting shipping, you acknowledge you cannot examine items beforehand and accept the risk and liability for any damages incurred during transit.

- Shipping is only available on select auctions and specific items.
- If shipping is offered, you must contact Whitaker Marketing Group prior to bidding to
confirm availability, costs, and logistics.
- Do not assume shipping is available � each auction and item may differ.

If shipping is confirmed:
- Buyer is responsible for all shipping and handling costs, including materials, labor, and
transport fees.
- Whitaker Marketing Group is not responsible for lost, stolen, delayed, or damaged
shipments once they leave our possession.
- Shipping arrangements may delay item delivery, but we do not guarantee shipping
timelines.
- Items will only be shipped once payment is received in full, and we have confirmed all
shipping details with the buyer.

Failure to confirm shipping prior to bidding does not void your purchase or remove your
obligation to pay. All standard Terms and Conditions apply regardless of shipping
availability.
