GENERAL . . .
1. All properties offered at this auction have been authorized to be sold by Bankruptcy Trustee Kenneth W. Gordon (hereinafter "Trustee" or "Seller") via public online auction by Reynolds Auction Co., Inc. (hereinafter "Reynolds Auction" or "Auctioneer") pursuant to a Court Order of the United States Bankruptcy Court for the Western District of New York dated December 18, 2025 in the Chapter 7 bankruptcy case of Stuart and Harriet Baldwin (Case No. 24-20610). 2. All properties are sold "AS IS - WHERE IS" with ownership transferred by Trustee's Deed. The Trustee WILL NOT furnish an abstract of title or title insurance and will not provide any survey for the properties. Properties are sold subject to all easements, liens, encumbrances, interests, rights and licenses of record except as expressly stated in these Auction Terms. 3. All properties are sold subject to a Reserve Price to ensure that there are sufficient funds generated by the auction to obtain a mortgage satisfaction and to pay off past due taxes. If the high bid on a property does not reach the Reserve Price for that property, the property will not be sold. If the Reserve Price is not achieved during the bidding time period, Trustee and Reynolds Auction reserve the right to contact the high bidder after bidding closes to ascertain whether the high bidder is willing to match the Reserve Price. 4. The Trustee will pay from auction proceeds the outstanding mortgage on the subject properties and will obtain and file at the Trustee's expense a mortgage discharge. From the auction proceeds, the Trustee will also pay all taxes due to the County of Chemung, City of Elmira and Elmira School District which are assessed and due up to and including December 31, 2025. All taxes assessed and due thereafter will be the responsibility of the buyer. The Trustee will not pay for any special district assessments or charges including pure water charges, water charges and code or administrative fees or violations for any period of time whatsoever. Buyers are purchasing properties subject to any existing code violations and charges. It is believed that code violations and charges, pure water charges and water charges apply to several of the properties and buyers are encouraged to contact Elmira Code Enforcement, Elmira Pure Water District and Elmira Water Board to ascertain the fees and charges that are outstanding. 5. NOT ALLOWED TO BID: a. The Trustee and his relatives, employees and contractors will not be allowed to bid on the properties nor will any other Chapter 7 trustee or their family members or employees. b. Reynolds Auction Co., Inc. - All employees and their immediate family members will not be allowed to bid on the properties. 6. By acknowledging and executing these Terms and Conditions, the purchaser certifies that he/she has read through and understands these Terms and Conditions, has consulted with legal counsel to their satisfaction and accepts these terms as binding and unequivocal. 7. Each purchaser will be required to sign a legally binding Property Bid Acknowledgment Form for each purchase which commits the Purchaser to compliance with all Terms and Conditions as stated herein and payment of the purchase price bid 8. Any promotional tools such as photographic slides, tax maps, written or verbal descriptions, etc. are for informational purposes only. The Seller neither guarantees nor warranties anything as to location, dimensions, parcel use or size. It is the sole responsibility of the purchaser to determine the legal and/or physical fitness of the property. 9. Risk of loss or damage by fire, vandalism or any other cause (except taking under the power of eminent domain) between the time of sale and the time of deed delivery is assumed by the purchaser. 9a. All properties are sold subject to current occupancy. ONLINE BIDDING . . . 10. All potential bidders must register to bid online with a Visa or Mastercard. Credit cards will be used for registration purposes only and will not be charged at the end of the auction. See payment information and terms in next section. 11. All potential bidders will also be required to complete and sign a pre-registration packet to be submitted to Reynolds Auction company by 12:00 PM on Thursday, January 22nd, 2026. 12. Registration opens at 3:00 PM on Monday, January 5th, 2026. All potential buyers must register for this auction by 12:00 PM on Thursday, January 22nd, 2026. Anyone, who in the past has defaulted, or at this auction defaults, on paying either the initial deposit or remaining balance will be prohibited from registration and bidding. Reynolds Auction Company reserves the right to reject any and all bids. 13. Bids cannot be retracted once the auction begins. 14. Bidding ends at 7:00 PM on Thursday, January 22nd, 2026. Soft close/extended bidding. 15. Reynolds Auction will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. 16. The Auctioneer and the Seller shall remain forever immune from any and all liability concerning any personal injury or property damage occurring before, during or after the auction, no matter what the cause. Additionally, the Auctioneer and Seller shall remain forever immune from the consequence of purchase of any property at this auction. FINANCIAL . . . 17. The successful bidder for each property will pay the highest bid amount plus a ten percent (10%) Buyer's Commission to be retained by Reynolds Auction. 18. Payments shall be made by cash, bank check, certified check, money order sent via Fedex/UPS next day shipping or wire transfer to Reynolds Auction Co., Inc. Contact Reynolds Auction for wire transfer details. Bank instruments must be made payable to Reynolds Auction Co., Inc. Full payment will be in the amount of Purchaser's highest bid plus the 10% buyer's commission. 19. Full payment must be received by 3:00 PM on Tuesday, January 27th, 2026 for ALL properties. 20. Upon payment of the full amount due, Purchasers will be provided with an original executed Trustee's deed, Form RP 5217 and Form TP 584 all of which will need to be recorded by the Purchaser in the Chemung County Clerk's Office. Purchasers will be responsible for all filing fees and for executing the forms prior to filing. Neither Reynolds Auction nor the Trustee will assist with or advise on the recording or filing of these papers. The documents can either be picked up in person by appointment on Monday, January 26th, 2026 or Tuesday, January 27th, 2026 between the hours of 9:00 AM and 3:00 PM at Reynolds Auction Company, 3569 Palmyra-Newark Rd, Palmyra, New York 14522 at which time Purchasers may pay in person or if the Purchaser elects to wire or ship payment to Reynolds Auction, the documents will be sent via overnight delivery service to Purchaser for an additional charge of $35.00 which would need to be paid by Purchaser prior to shipping by Reynolds Auction. TAXES . . . 21. Purchasers will not be responsible for delinquent taxes up to and including all those assessed in calendar year 2025 and prior years. 22. The purchaser will be responsible for all 2026 City and County taxes, 2026-27 School taxes and any past due, current and future pure water, sewer, and water charges as well as any code violations, fines and administrative charges against the properties for past, current or future code violations. |
