AUCTION TERMS, CONDITIONS AND DISCLAIMERS - READ BEFORE BIDDING

(1) By bidding in this auction, Buyers agree to purchase all lots, items and merchandise sold by Damewood Auctioneers, LLC (Auctioneer) in "As-Is, Where-Is" Condition. No warranties or guarantees are either expressed, or implied. (2) All Sales are Final. No Returns, Exchanges, or Refunds. (3) If Auctioneer has knowledge of a defect, it will be disclosed. Buyer agrees to hold harmless Auctioneer and Seller for both obvious and unknown item defects, including but not limited to: mechanical and electrical power train defects, hour inaccuracies or defective hour meters, title brands, oil or fluid leaks, cracks to metal, surface rust, frame and unibody rust, vehicle history defects and issues, defective heat/A.C., wood scratches, cuts and stains to upholstery/seats. Buyer acknowledges that Auctioneer does not operate or test drive all mechanical units prior to the auction. Buyer must make his or her own decision to the fitness and condition of any item or lot and bid accordingly. (4) Bidders/Buyers are strongly advised to attend the Auction Preview. By not attending the Auction Preview, the Buyer acknowledges the increasing likelihood that he/she purchases an item with an obvious or hidden defect. (5) Auctioneer reserves the right to accept and reject any, and all bids. Auctioneer reserves the right to bid on any lot, or lots. (6) Online Bidders and Buyers should be advised that he/she may experience technical issues with bidding software, or internet glitches which may prevent a bid from being communicated to the Auctioneer. (7) Auctioneer has sole discretion and authority to verbally declare a lot “Sold”. In the event of a dispute between any one or more bidders, or a bid coming in after the Auctioneer declares a lot “Sold”, the decision of the Auctioneer shall be final and absolute. (8) In the event of a Buyer default on the payment of a sold lot, the Auctioneer reserves the right to refuse the participation of that Buyer in future auctions. If you, the Bidder/Buyer do not agree to buy under these above Auction Terms, do not bid on any item or lot in this auction.

Buyer’s Premium, Taxes & Fees

All auction lots will be assessed a 15% Buyer's Premium, with a 5% discount for all cash, wire and check purchases. No cap on Buyer's Premium. All purchases (except titled vehicles & trailers) will be assessed a 6% Virginia state sales tax. Buyer may present Auctioneer with a valid sales tax exemption form at the time of payment for a waiver of sales tax.

Removal

Pay and Pick-Up at 13087 James Monroe Hwy, Lucketts (Leesburg), VA 20176, Payment due in full by 2pm on Saturday following the Equipment Auction unless prior written approval has been given by the Auctioneer. Pick Up Hours on Auction Day until 4PM, and Saturday, January 17th from 9AM to 2PM. *NOTE: Auctioneer is not responsible for any small tool, hardware, or furniture lot left after Saturday at 2PM*. Buyers must bring their own labor, help, straps, chains or pallets to remove their purchases. A skid steer operator will be on-site to assist with heavy items, unless noted on the individual item description. AUCTIONEER AND SELLER ARE NOT OBLIGATED TO ASSIST BUYERS IN MOVING THEIR PURCHASES BY HAND. Buyers assume all responsibility to any damage made to the property during removal. No sold lot or item may be loaded, or leave the auction site until it has been paid in-full.

Payments

Payment may only be made by cash, check, wire transfer or credit card. Wire Transfers: Buyers paying by Wire Transfer agree to initiate wire transfers on Auction Day by 4PM. On-site Buyers must pay on the day of the auction before leaving, unless approval has been given by the Auctioneer. Payment can be made through your emailed invoice via credit card. Credit Cards: By paying Auctioneer with a credit card, Buyers agree, swear and affirm he/she will not request or issue a charge-back against the Auctioneer. Auctioneer reserves the right to refuse credit card payments on items with a DMV Title, or on invoices greater than $2,500. Auctioneer reserves the right to require Buyer present proof of funds on check payments or perform a wire transfer for transactions $5,000 or greater. Auctioneer reserves the right to hold vehicle titles until cash or wire payment clears.

The credit card used at registration will have a credit card balance check performed for $99 (will show at PENDING charge from Damewood Auctioneers). Auctioneer does not hold or keep this money. This hold will drop off after the auction.

All Bids Are Final

All bids recognized by the Auctioneer, the Auctioneer’s bidding app, and 3rd Party Online Bidding Platforms are final and constitute a binding contract to purchase between the Buyer and the Seller. Auctioneer will not remove bids on behalf of Bidders.
