Bidding Instructions: Credit card on file will be charged immediately when the auction is completed. Any declined credit card charges must be settled within 24 hours following the conclusion of the auction to avoid a dispute filed with Hibid. Your credit card will be charged for the following: Your Total Purchases, Buyer's Premiums, Shipping and Handling Fees, and any applicable sales taxes. A pre-auction authorization will be performed to establish available credit. Debit cards may show a hold on funds for a short period of time. Nothing will be charged to your card until a purchase is made. Credit card chargebacks will NOT be accepted. Declined Credit cards may be subject to a $10 fee. Invoices will be posted within 24 hours of the close of the Auction. All sales are final and items are sold AS-IS, with no warranty expressed or implied. It is the bidder's responsibility to determine condition, age, genuineness, authenticity or value BEFORE bidding. Fouss Auction & Appraisal LLC may attempt to describe the merchandise in the auction but makes no representations regarding any product. Bidders should rely on their own knowledge and research of value and other characteristics before bidding on any item. Buyers will accept the items or lots in spite of any defects or conditions, known or unknown, visible or not visible, and therefore buyers do by these presents remise, release, acquit, quit claim and forever discharge the sellers, auctioneers, licensees, employees and agents from any and all claims now and in the future. Buyer understands that any description given in the catalog or written on the lot is not guaranteed, and the buyer will rely entirely on their own inspection and/or investigations. All information and descriptions contained in advertising this sale are believed correct, but are not guaranteed. Bidders agree to hold Fouss Auction & Appraisal LLC harmless if the internet fails to function properly, for power outages, for computer or internet complications before during or after the auction. Bidding may be extended if bids are placed in the last new minutes to prevent bid sniping.

Currency Type: USD ONLY

Vehicles: Buyers of Vehicles/Tractors/ATVs/Mortocycles will be charged a 1000.00 non refundable deposit on the credit card on file which will apply to the purchase price if the entire balance does not clear. Buyer will be required to immediately wire guaranteed funds or bring cash to the auctioneer for the balance within 24 hours after the close of the auction. Failure will be considered a default and deposit will be retained as damages by the auctioneer. NO CHECKS OF ANY KIND. Seller shall have the right to hold the Title and/or vehicle will be held until guaranteed funds are received. All wire tranfer fees to either party will be paid by Buyer.

Pick-up: Free local pickup is available on the designated date and time ONLY. Buyers must bring
packing materials, blankets, shrink wrap, dollies, trucks, tools, trailers and manpower as needed to disassemble, carry and load their purchases. Auction staff WILL NOT assist with loading. Buyers are solely responsible for the transportation of any vehicles, equipment, and/or large items. Buyer agrees that any and/or all remaining lots left after removal deadline are considered to be automatically forfeited, but buyer is still responsible for invoice total. Auction company will not be responsible for accidents, loss or injury during the loading and pick up process and buyers agree to hold the auction company/agents and sellers harmless from any accident or injury. If you buy a closet contents, contents of a storage unit, contents of a cabinet or closet, and /or remaining items in a room lot you must take everything in the area as shown including items of no value including trash. Failure to take everything as noted will result in additional charges to buyer including dumpster fees, dump fees, labor, and all other costs. In addition buyer may be banned from all future auctions. Buyer authorizes Auction company to automatically charge thier credit card on file for all damages and fees as outlined above.

Shipping: EACH LOT IS MARKED TO SHOW IF SHIPPING IS AVAILABLE. FOR THAT SPECIFIC LOT. WE DO OT SHIP GOLD, SILVER, or COINS. Generally shipping is available on most smaller items that will fit into a 12"x12"x12" or smaller box and is available upon request in the Continental USA only. We ship via USPS Priority Mail ONLY at the buyer's expense to include actual shipping charges plus a $10 charge PER 12"x12"x12" or smaller box PLUS a $2.50 per lot fee for packing & handling. All items will be shipped within 14 days following the auction when possible. Shipping only available to Domestic USA. We will only ship to the address on your invoice under the "Ship To" column and this address cannot be changed after the auction starts so please be sure your information is correct with Hibid before you register. While we will assist with information, everything is being sold as is and we will not accept responsibilty for any damage happening during shipping.

Forfeiture: If you do not wish to pick up or ship your items, you may forfeit them. Forfeiting your items is defined as relinquishing all ownership and claim to the items in question to the auctioneer with no expectations of reimbursement; however, you are still responsible for the invoice total. No refunds will be made if you decide to forfeit your item(s). If you wish to forfeit your item(s), please contact us ON or BEFORE the removal deadline. Buyer agrees that any and/or all remaining lots left after removal deadline are considered to be automatically forfeited without further notice, but buyer is still responsible for invoice total.

Auction Revisions: All aspects of this auction are subject to change without or with limited notice. The Auctioneer reserves the right to, at any time: 1. Add or remove items from the auction, 2. Split or combine lots, 3. Add minimum bids or reserve prices, 4. Cancel, suspend, extend or reschedule the sale of an individual item, lot, part of or an entire auction, 5. Make changes to the auction's closing date or time, inspection, or removal times, or 6. Take any other action the Auctioneer deems necessary to effect the fair conduct of this auction or protection of the buyers, sellers or other parties of interest. Auctioneer and staff retain the right to bid and buy at the auction. 7. Auctioneer reserves the right to wave or enforce any rights.

Governance: These terms are governed by severability in the event a single element is determined unenforceable. In all cases the Liability of Fouss Auction & Appraisal LLC and any seller of products in this auction will be limited to the refund of your purchase price regardless of circumstances. These terms will be governed by and in accordance with the laws of the State of West Virginia.
