The offering and sale of property by�Estate Downsizing Specialists,�LLC (EDS) is subject to the following conditions of sale, as modified or supplemented by other written provisions and/or in announcements made by the auctioneer, prior to or at the time of the sale.

YOUR BID IS YOUR CONTRACT TO BUY. All auctions are considered reserve auctions unless otherwise posted. EDS and its employees reserve the right to bid on any item for any reason, including absentee bids placed by non-internet bidders and reserve bids placed by EDS staff on behalf of our sellers.

BUYER�S PREMIUM: All bidders will pay an buyer�s premium of 20% or as noted in the auction details. Bidders using Invaluable or Live Auctioneers platforms will pay a premium of 25%. Buyer�s Premium for Specialty and Automobile Auctions may vary, see individual auction descriptions for details.

REMOVAL of PURCHASED LOTS: Items may be removed from the auction house by the buyer after the invoice has been paid. Removal shall be at the expense, liability, and risk of the purchaser. EDS shall not be responsible for items not collected by close of business on the Friday of the week of the auction. Lots not paid for and/or removed within this time frame may be resold at public or private sale without further notice.

PAYMENT: EDS accepts cash, major credit cards, Zelle, wire transfer, personal checks (with a hold until payment clears) and certifiable funds. Nothing will ship until payment is clear and certified to our bank.

Buyers will be contacted via email by Shipping Saints after the auction closes; buyers must click on SHIPPING or PICK UP within this message. EDS makes every effort to contact buyers, however, it is the buyers' responsibility to communicate with EDS to arrange pick up or shipping. Purchased items will not be stored at the EDS facility beyond the week of the auction and will be considered forfeited.

Gold, Numismatics, Sterling Silver or purchases over $1000 REQUIRE CONFIRMED FUNDS for new buyers with EDS, such as ACH, Bank or Wire Transfer, as well as proof of identity. Restrictions on shipping of gold and other items may apply. The full purchase price and all applicable taxes and fees are required before removal or shipping of any items.

Because of the level of fraud encountered in this industry, it is important that buyers understand this responsibility prior to bidding. All sales are final.

YOUR BID IS A CONTRACT TO BUY: Bidding in an EDS Auction is your contract to purchase. Effective and enforceable immediately when you become the high, winning bidder, you have agreed contractually to your purchase per the laws of the State of Indiana. All bidders must be 18 years of age or older and competent to conduct a financial transaction. EDS makes every effort to accurately describe all lots. We will make every effort to accurately describe all items - descriptions, marks, identification, and photographs of the items will not be considered a warranty or guarantee of authenticity or value. All auctions are considered reserve auctions unless otherwise posted. EDS and its employees reserve the right to bid on any item for any reason, including absentee bids placed by non-internet bidders. The bidder/buyer agrees to pay all costs associated with any collection process for funds due to EDS. This may include legal and court fees, time, and ANY associated costs. The purchaser agrees that a fee of 10% per month will be added to the balance of any unpaid amount due to EDS. This will include ANY and ALL costs associated with collection, including damages.

NEW LOTS MAY BE ADDED: New lots may be added to any of our auctions up to the Friday before the Monday close of the sale.

BIDDING: Auction lots will have a staggered ending time starting at 6pm or 7pm EST, depending on the season, with most auctions closing on Mondays and Wednesdays. All EDS auctions have soft closing times. Stagger time varies per auction depending on the total lot count. Any bids placed in the last two minutes of time remaining will extend the total time. If two bidders place high bids that are the same amount, the FIRST recorded bid becomes the winner. Make sure you have the high bid before assuming you have purchased an item. EDS assumes no responsibility or liability in the bidding activities during the close of the auction. Once an item is closed, EDS cannot change the winning bidder status under any circumstances. EDS reserves the right to withdraw any bid for any reason.

ADDITION TO OR WITHDRAWAL FROM SALE: Seller or Auctioneer may withdraw or change the items being sold in this event at any time and at their discretion.

SALES TAX: 7% Indiana Sales Tax will be charged for all buyers with Indiana residence. If you have a Tax Exemption, we must have your Exemption Certificate on file before the close of the auction.
