PLEASE READ: At the request of the auction company, this auction permits bids to be placed by the auctioneer, an employee of the auctioneer, or the seller or an agent on the seller's behalf. While Proxibid's Unified User Agreement prohibits this behavior, in accordance with UCC 2-328, this auction is permitted to engage in this activity by providing this clear disclosure to you, the bidder.

Payment Instructions: Your credit card will be charged the required 25% deposit on your purchases immediately following the auction unless alternate payment arrangements are made PRIOR to the auction. The online buyer's premium is 6%, which includes the 3% loss of cash discount for credit card charges.

Payment Terms:
Payment for vehicles purchased through auction ring may be made in cash, cashier's check, wire transfer or money order. PAYMENT IN FULL IS DUE WITHIN TWO WORKING DAYS OF THE AUCTION. No Exceptions. Payment for bank repossessions confirmed on Monday or Tuesday following the auction, must be paid for within 48 hours of purchase confirmation. Bidders refer to light system guidelines on website.
If the Green light vehicle is not inspected prior to Tuesday at 4PM, they waive all rights that are granted under the light system. All sales are subject to the following buyer's premium.

BUYER'S FEES:
Up to $999.99 = $100 Buyers Premium

$1,000 to $14,999 = 10% Buyers Premium

$15,000 and up = $1,500 Buyers Premium
Deposit Requirements: Card hold used to validate card. Funds will be released the following week.

Shipping Instructions: It is the responsibility of the purchaser to pay for shipment of purchase.
Please contact Auctioneers within 24 hours of receipt of your invoice to notify them of your intentions. Load out day of sale or MUST be picked up within 3 working days after the auction sale or storage will be charged. THC will not recognize nor be responsible for any theft or damage to the vehicle after the vehicle has been awarded to member bidder. Storage fees are $20 a day starting on the Friday AFTER the auction in which the vehicle was won.
Preview Date & Times: Wednesday 8AM-4PM, Thursday 8am-4pm and Day of Sale at 7:30AM
Checkout Date & Times: Vehicles MUST be picked up within 3 working days after the sale. Pick up hours, Monday -Friday 8AM - 4PM. A storage fee will be charged per day/per vehicle after 3 business days. Storage fee is $20 per day after the 3rd business day.

Special Terms
Thank you for participating in a Thomas Hirchak Company Online Auction. It is important that you become familiar with the terms and conditions as all sales are final. The terms of sale are non-negotiable.

Registration at the auction (online and/or in person) finalizes each bidder's agreement to the terms and conditions of sale as stated in the Contract and any Addenda which are incorporated by reference into your bidding. Do not bid until you have read the terms and conditions. In order to bid at the auction all Bidders must be signed up and register to bid through Proxibid.com. A valid credit card will be required to verify identity and funds. By bidding you are representing to Thomas Hirchak Company (Auctioneer) and the seller that you have read and agree to be bound by the terms and conditions for this sale as stated herein. If you do not agree with any of the terms and conditions stated DO NOT BID or you will be bound by those terms and conditions. By bidding you agree to all disclosures.

THE SALE WILL BE CONTROLLED BY THE AUCTIONEER PROGRAM. Thomas Hirchak Company is not responsible for malfunctions or system errors which cause a bid or bidder to fail to be recognized or registered. If there is a dispute, the Auctioneer may re-open the bidding at the Auctioneer's sole discretion and shall serve as the sole arbiter as to who is or is not allowed to bid.

Equipment is sold 'AS IS, WHERE IS' with no financing, inspection or other contingencies to sale. Thomas Hirchak Company represents the Sellers only and does not inspect properties on bidder's behalf. Buyers must conduct their own due diligence and investigation of each property and must also investigate the suitability of each parcel prior to making a bid and purchase at the auction. Buyers must rely solely upon their own investigation and not any information provided by the Seller or Auctioneer. Failure of a Buyer to be fully informed on the condition of a property will not constitute grounds for any claim adjustment or right to cancel sale.
YOU ARE ENTERING INTO A BINDING CONTRACT. THERE ARE NO REFUNDS OR BID CANCELLATIONS. THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. AN ONLINE BID ACCEPTED AT PUBLIC AUCTION IS A LEGAL AND BINDING CONTRACT TO PURCHASE. ANY BIDDER WHO FAILS TO COMPLETE A PURCHASE WILL BE BANNED FROM BIDDING AT ALL FUTURE SELLER AUCTION EVENTS AND MAY BE PURSUED FOR CIVIL AND/OR CRIMINAL VIOLATIONS.
