THESE TERMS CONSTITUTE A LEGALLY BINDING CONTRACT BETWEEN YOU AND MCGEE AUCTIONS. IF YOU DO NOT AGREE WITH ANY PROVISION OF THESE TERMS, DO NOT BID. SECTION 1 - DEFINITIONS For purposes of these Terms and Conditions, the following definitions shall apply throughout: "Auction Company" / "Auctioneer" / "McGee Auctions": refers to McGee Auctions, operated by Holli McGee, a licensed Auctioneer in the State of South Carolina and a Federal Firearms Licensee 1-57-063-01-8M-09680 located at 560 Meeting St. West Columbia, South Carolina 29169 "Bidder": any person, entity, or agent who registers to participate in this auction and/or places a bid on any lot. "Buyer" / "Purchaser": the highest successful Bidder to whom a lot is knocked down (sold). "Consignor": the owner or authorized agent of the owner who has consigned property to McGee Auctions for sale. "FFL" (Federal Firearms Licensee): a dealer licensed by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) under 18 U.S.C. § 923 to engage in the business of dealing in firearms. "Firearm": any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; the frame or receiver of any such weapon; any firearm muffler or silencer; or any destructive device, as defined by 18 U.S.C. § 921(a)(3) and the Gun Control Act of 1968. "Antique Firearm": any firearm manufactured in or before 1898, including any firearm with a matchlock, flintlock, percussion cap, or similar ignition system, or any replica thereof not designed to use conventional fixed ammunition, as defined by 18 U.S.C. § 921(a)(16). Antique firearms are generally exempt from FFL transfer requirements under federal law. "NFA Item" / "Title II Firearm": any item regulated under the National Firearms Act (26 U.S.C. § 5845), including suppressors/silencers, short-barreled rifles (barrel under 16" or overall length under 26"), short-barreled shotguns (barrel under 18" or overall length under 26"), machine guns, destructive devices, and any other weapons (AOWs). "Prohibited Person": any individual prohibited from shipping, transporting, receiving, or possessing firearms or ammunition under 18 U.S.C. § 922(g) and (n), or under applicable state law, as further detailed in Section 3 of these Terms. "Hammer Price": the final bid price at which a lot is knocked down to the Buyer, excluding Buyer's Premium, taxes, fees, and shipping. "Buyer's Premium": an additional charge assessed to the Buyer, calculated as a percentage of the Hammer Price, as set forth in Section 6. "Lot": any individual item or group of items offered for sale under a single lot number in this auction. SECTION 2 - BIDDER ELIGIBILITY AND REGISTRATION 2.1 - Age Requirements By registering to bid, you certify that you meet the following minimum age requirements as mandated by federal law (18 U.S.C. § 922(b)): (a) You must be at least twenty-one (21) years of age to bid on or purchase any handgun, frame, receiver, or handgun ammunition from a Federal Firearms Licensee. (b) You must be at least eighteen (18) years of age to bid on or purchase any rifle, shotgun, or long gun ammunition from a Federal Firearms Licensee. (c) You must be at least twenty-one (21) years of age to bid on or purchase any NFA/Title II item. 2.2 - Registration Requirements All Bidders must register through the HiBid platform prior to placing any bid. Registration requires a valid government-issued photo identification displaying your full legal name, date of birth, and current residential address. McGee Auctions reserves the right to require additional identification or verification at any time. 2.3 - Bidder Certification By registering to bid and/or placing any bid, you certify under penalty of perjury that: (a) You meet all applicable age requirements set forth above; (b) You are the actual buyer/transferee and are not acquiring any firearm on behalf of another person (i.e., this is not a "straw purchase" as prohibited by 18 U.S.C. § 922(a)(6)); (c) You are not a Prohibited Person as defined herein and under applicable federal and state law; (d) You have reviewed and will comply with all applicable federal, state, and local laws governing the purchase, possession, transfer, and transportation of firearms in your jurisdiction; (e) You will complete all required FFL transfer procedures, including ATF Form 4473 and NICS background check; (f) You understand that providing false or misleading information or failing to comply with transfer requirements may result in criminal prosecution under federal and/or state law. SECTION 3 - PROHIBITED PERSONS 3.1 - Federal Prohibitions Under 18 U.S.C. § 922(g) and (n), the following categories of persons are prohibited from shipping, transporting, receiving, or possessing any firearm or ammunition. It is unlawful and a violation of these Terms for any such person to bid on or attempt to purchase any firearm at this auction: (i) Any person convicted in any court of a crime punishable by imprisonment for a term exceeding one year (felony); (ii) Any person who is a fugitive from justice; (iii) Any person who is an unlawful user of or addicted to any controlled substance (as defined in Section 102 of the Controlled Substances Act, 21 U.S.C. § 802); (iv) Any person who has been adjudicated as a mental defective or has been committed to any mental institution; (v) Any person who is an illegal or unlawful alien, or any alien admitted to the United States under a nonimmigrant visa (with limited exceptions); (vi) Any person who has been discharged from the Armed Forces under dishonorable conditions; (vii) Any person who, having been a citizen of the United States, has renounced such citizenship; (viii) Any person who is subject to a qualifying domestic violence restraining order; (ix) Any person convicted of a misdemeanor crime of domestic violence (including dating relationships per the Bipartisan Safer Communities Act of 2022); (x) Any person under indictment for a crime punishable by imprisonment exceeding one year (prohibited from shipping, transporting, or receiving under § 922(n)). 3.2 - South Carolina State Prohibitions In addition to federal prohibitions, South Carolina Code § 16-23-30 prohibits the sale or delivery of firearms to: any person convicted of a crime of violence (as defined in § 16-23-10); habitual drunkards; members of subversive organizations; any person declared mentally unfit by a circuit or county court judge; and unlawful aliens (§ 16-23-530). Additionally, South Carolina imposes domestic violence prohibitions under § 16-25-30 including lifetime, ten-year, and three-year prohibitions depending upon the severity of the domestic violence conviction. SECTION 4 - CONDITION OF ITEMS; "AS IS, WHERE IS" DISCLAIMER ALL FIREARMS, AMMUNITION, ACCESSORIES, AND RELATED ITEMS OFFERED IN THIS AUCTION ARE SOLD "AS IS, WHERE IS" WITH ALL FAULTS. MCGEE AUCTIONS MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND WHATSOEVER, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DESCRIPTION, CONDITION, SAFETY, OPERABILITY, FIRING CONDITION, FITNESS TO FIRE OR OTHERWISE DISCHARGE, OR RELIABILITY OF ANY FIREARM, AMMUNITION, OR PARTS. ALL FIREARMS ARE SOLD STRICTLY AS COLLECTOR ITEMS. FITNESS TO FIRE OR OTHERWISE DISCHARGE ANY FIREARM OR AMMUNITION IS EXPRESSLY DENIED BY MCGEE AUCTIONS. A COMPETENT, QUALIFIED GUNSMITH SHOULD BE CONSULTED AND A THOROUGH INSPECTION PERFORMED BEFORE ATTEMPTING TO USE, LOAD, FIRE, OR OTHERWISE DISCHARGE ANY FIREARM OR AMMUNITION PURCHASED AT THIS AUCTION. 4.1 - Buyer's Duty to Inspect It is the sole responsibility of each Bidder to inspect all items prior to placing any bid. Inspection may be performed by visiting McGee Auctions in person at [INSERT ADDRESS], [INSERT CITY], South Carolina [INSERT ZIP], during scheduled preview times, or by contacting Holli McGee directly at [INSERT PHONE] or [INSERT EMAIL] to arrange an inspection or request additional photographs, measurements, or condition details. Placing a bid constitutes acknowledgment that you have either personally inspected the item or have chosen to waive your right to do so and accept the item in its present condition. 4.2 - Descriptions and Photographs All lot descriptions, photographs, measurements, and condition reports are provided in good faith as a courtesy to Bidders and are for general guidance only. They do not constitute a guarantee, warranty, or representation of any kind. Descriptions may contain inadvertent errors or omissions. In the event of any discrepancy between a written description and the physical item, the physical item as viewed in person shall prevail. 4.3 - Serial Number and Provenance McGee Auctions makes no guarantee or representation regarding the provenance, originality, historical significance, or complete ownership history of any item. While serial numbers are provided where available, McGee Auctions does not warrant that any serial number has not been altered, re-stamped, or otherwise modified, nor does McGee Auctions warrant the accuracy of any third-party database or record. SECTION 5 - FIREARMS TRANSFER PROCEDURES 5.1 - General Transfer Requirements All post-1898 manufactured firearms (i.e., non-antique firearms) must be transferred in compliance with all applicable federal, state, and local laws. This includes completion of ATF Form 4473 (Firearms Transaction Record) and a successful NICS (National Instant Criminal Background Check System) background check prior to transfer of possession. 5.2 - Local Pickup / In-Person Transfer Buyers electing to pick up firearms in person must do so at the licensed premises of McGee Auctions, 560 Meeting St South Carolina. At the time of pickup, Buyer must present a valid government-issued photo identification, complete ATF Form 4473, and successfully pass a NICS background check. South Carolina Concealed Weapons Permit (CWP) holders are exempt from the NICS background check requirement but must still complete ATF Form 4473 and present their valid CWP at the time of transfer. 5.3 - Shipped Firearms / FFL-to-FFL Transfer Buyers who wish to have firearms shipped must provide, within seventy-two (72) hours of auction close, a signed copy of their chosen receiving FFL dealer's current, valid Federal Firearms License. McGee Auctions will ship firearms only to a licensed FFL dealer. It is the Buyer's sole responsibility to: (a) Identify and arrange for a receiving FFL dealer in the Buyer's state of residence; (b) Provide a signed copy of the receiving FFL's license to McGee Auctions; (c) Complete all transfer paperwork (including ATF Form 4473 and background check) at the receiving FFL; (d) Pay any and all transfer fees charged by the receiving FFL (these fees are separate from and in addition to amounts owed to McGee Auctions); (e) Ensure the firearm is legal to possess in the Buyer's state, county, and municipality of residence. 5.4 - Interstate Transfer Requirements Under federal law (18 U.S.C. § 922(a)(3) and (b)(3)): Handguns, frames, and receivers may only be transferred to a resident of the state in which the FFL is licensed. All interstate handgun purchases must be shipped to an FFL in the Buyer's state of residence. Long guns (rifles and shotguns) may be transferred over-the-counter to residents of any state provided the transaction complies with the laws of both states; however, McGee Auctions reserves the right to require FFL-to-FFL transfer for all interstate transactions regardless of firearm type. 5.5 - Enhanced Background Checks for Buyers Under 21 Pursuant to the Bipartisan Safer Communities Act (BSCA), buyers between the ages of eighteen (18) and twenty (20) purchasing long guns are subject to an enhanced NICS background check, which may extend the investigation period up to ten (10) business days and includes review of juvenile records and contact with state/local authorities. Buyers in this age range should be aware of potential delays in transfer. 5.6 - Background Check Denial If a Buyer is denied by NICS, the Buyer will not be permitted to take possession of the firearm. In such case: the firearm may be consigned to a future McGee Auctions sale or, at the sole discretion of the Auctioneer, returned to the Consignor; the Buyer shall remain liable for the Buyer's Premium and all fees incurred; no refund of any amounts paid shall be issued; and storage fees as set forth in Section 14 shall apply. A NICS denial does not constitute grounds for cancellation of the sale, refund, or release from financial obligation. 5.7 - Antique Firearms Firearms manufactured in or before 1898 that qualify as "Antique Firearms" under 18 U.S.C. § 921(a)(16) are generally exempt from FFL transfer requirements under federal law. However, Buyers are solely responsible for verifying compliance with their own state and local laws, as some jurisdictions impose additional restrictions on antique firearms. SECTION 6 - BUYER'S PREMIUM, FEES, AND TAXES 6.1 - Buyer's Premium A Buyer's Premium of 15% shall be added to the Hammer Price of each lot. The Buyer's Premium is non-negotiable and non-refundable. 6.2 - Credit Cards A credit/debit card will be charged the first $500. for out of state bidders. The remainer will be paid via wire transfer or check. 6.3 - Sales Tax Applicable South Carolina state and local sales taxes will be collected on all purchases unless the Buyer provides a valid resale certificate or tax exemption documentation prior to invoicing. Out-of-state Buyers are responsible for remitting any use tax required by their state of residence. 6.4 - Total Purchase Price The total amount due from Buyer shall consist of: the Hammer Price, plus Buyer's Premium, plus any applicable credit card surcharge, plus applicable sales tax, plus shipping and insurance costs (if shipped), plus any applicable NFA transfer tax. This total represents the complete and final obligation of the Buyer. SECTION 7 - PAYMENT TERMS 7.1 - Payment Deadline Full payment is due within seventy-two (72) hours of auction close unless prior arrangements have been made in writing with McGee Auctions. Failure to remit timely payment shall constitute default under these Terms. 7.2 - Accepted Payment Methods McGee Auctions accepts the following forms of payment: cash (in person only); cashier's check or money order (made payable to McGee Auctions); personal check (subject to a ten (10) business day hold pending clearance-no items released until funds clear); wire transfer (Buyer responsible for all wire fees); and credit/debit card (Visa, Mastercard, Discover, American Express-subject to processing surcharge as stated in Section 6.2). 7.3 - Prohibited Payment Methods MCGEE AUCTIONS DOES NOT ACCEPT PAYMENT VIA PAYPAL, ZELLE, VENMO, CASH APP, APPLE PAY, GOOGLE PAY, OR ANY OTHER PEER-TO-PEER PAYMENT APPLICATION. THESE PLATFORMS PROHIBIT FIREARMS TRANSACTIONS IN THEIR TERMS OF SERVICE AND ANY PAYMENT SUBMITTED THROUGH SUCH PLATFORMS WILL BE REFUSED AND/OR RETURNED. 7.4 - Late Payment Invoices not paid within the seventy-two (72) hour window shall accrue interest at a rate of one and one-half percent (1.5%) per month (18% per annum) or the maximum rate permitted by South Carolina law, whichever is less. A returned check fee of $35.00 shall be assessed for any payment returned for insufficient funds. SECTION 8 - NFA / TITLE II ITEMS 8.1 - Items Covered This section applies to all items regulated under the National Firearms Act (26 U.S.C. Chapter 53), including but not limited to: (i) Suppressors / silencers; (ii) Short-barreled rifles (SBRs) - barrel length under 16 inches or overall length under 26 inches; (iii) Short-barreled shotguns (SBSs) - barrel length under 18 inches or overall length under 26 inches; (iv) Machine guns - any weapon that fires automatically more than one shot per single function of the trigger; (v) Destructive devices - explosives, bombs, grenades, and firearms with a bore diameter exceeding one-half inch (0.50 caliber); (vi) Any Other Weapons (AOWs) - cane guns, wallet guns, smooth-bore pistols, and similar concealable devices. 8.2 - NFA Transfer Process All NFA items require ATF approval via ATF Form 4 (Form 5320.4) prior to transfer of possession. Buyers must submit: a completed ATF Form 4; two (2) passport-style photographs (2" x 2"); FBI fingerprint cards (Form FD-258) for each responsible person; trust or entity documentation, if applicable; and payment of applicable NFA transfer tax. 8.3 - NFA Transfer Tax Effective January 1, 2026, pursuant to the One Big Beautiful Bill Act (P.L. 119-21), the NFA transfer tax is zero dollars ($0) for suppressors, short-barreled rifles, short-barreled shotguns, and any other weapons (AOWs). The transfer tax remains two hundred dollars ($200) for machine guns and destructive devices. All other NFA requirements (Form 4 application, background check, ATF registration, fingerprints, and photographs) remain in full force and effect regardless of tax amount. Buyer is solely responsible for payment of all applicable NFA taxes. 8.4 - Machine Guns - Special Requirements Under the Firearm Owners Protection Act of 1986 (Hughes Amendment), only machine guns manufactured and registered with the ATF prior to May 19, 1986 ("transferable" or "pre-86" machine guns) may be lawfully transferred to non-FFL/SOT holders. Machine guns manufactured or registered after May 19, 1986 may only be transferred to qualified FFL/SOT dealers. Additionally, South Carolina Code § 23-31-310 et seq. requires all machine guns to be registered with the South Carolina Law Enforcement Division (SLED) in addition to ATF registration. This SLED registration must be renewed annually (expiring December 31 of each year). Buyer is solely responsible for SLED registration compliance. 8.5 - NFA Non-Cancellation Policy BUYERS WHO BID ON AND WIN NFA/TITLE II ITEMS OWN THE ITEMS AND ARE FULLY RESPONSIBLE FOR PAYMENT WITHIN THE STATED TERMS REGARDLESS OF WHETHER THE BUREAU OF ALCOHOL, TOBACCO, FIREARMS AND EXPLOSIVES (ATF) APPROVES THEIR TAKING PHYSICAL POSSESSION OF THE ITEM(S). MCGEE AUCTIONS WILL NOT CANCEL THE SALE DUE TO ATF DISAPPROVAL, DELAY, DENIAL, OR ANY OTHER REASON RELATING TO THE NFA TRANSFER PROCESS. THE BUYER ASSUMES ALL RISK ASSOCIATED WITH THE NFA APPLICATION AND APPROVAL PROCESS. 8.6 - NFA Processing Time Buyers acknowledge that NFA Form 4 processing times may vary significantly and are entirely beyond the control of McGee Auctions. McGee Auctions shall securely store NFA items pending ATF approval at no additional charge for up to twelve (12) months from the date of sale. Storage fees as set forth in Section 14 shall apply thereafter. SECTION 9 - SHIPPING TERMS 9.1 - Shipping Costs All shipping, handling, packaging, and insurance costs are the sole responsibility of the Buyer and will be added to the final invoice. Shipping costs are non-refundable. 9.2 - Shipping Method All firearms will be shipped via a commercial carrier authorized to transport firearms (FedEx, UPS, or as required by law). Handguns must be shipped via overnight or second-day air service. Long guns may be shipped via ground service. All firearms will be shipped unloaded, in compliance with 18 U.S.C. § 922(e), and without external markings indicating the contents of the package. 9.3 - Insurance All shipments will be fully insured for the total purchase price. Insurance costs are included in shipping charges. Any claim for damage or loss in transit must be filed by the receiving FFL with the carrier within forty-eight (48) hours of delivery. 9.4 - International Shipping McGee Auctions does not ship firearms internationally under any circumstances. All sales and transfers are limited to the United States and its territories. 9.5 - Restricted States and Jurisdictions Certain states and local jurisdictions impose additional restrictions on specific types of firearms, magazines, accessories, and/or ammunition (including but not limited to: California, Connecticut, Hawaii, Illinois, Maryland, Massachusetts, New Jersey, New York, and the District of Columbia). It is the Buyer's sole and absolute responsibility to know and comply with all laws applicable to their jurisdiction. McGee Auctions will not ship any item to any jurisdiction where such item is prohibited. McGee Auctions shall not be liable for Buyer's failure to research applicable laws. SECTION 10 - RETURNS, REFUNDS, AND CANCELLATIONS ALL SALES ARE FINAL. NO RETURNS, REFUNDS, EXCHANGES, OR CANCELLATIONS WILL BE PERMITTED AFTER TRANSFER OF ANY FIREARM OR ITEM. BY PLACING A BID, YOU AGREE THAT YOU ARE MAKING AN IRREVOCABLE OFFER TO PURCHASE THE ITEM AT THE BID PRICE, SUBJECT TO THESE TERMS. In the limited event that an item is materially and significantly different from its auction description (not including minor cosmetic variations, normal wear, or subjective condition assessments), Buyer must notify McGee Auctions in writing within three (3) calendar days of taking possession. Any such claim shall be resolved at the sole discretion of the Auctioneer. Under no circumstances shall McGee Auctions' liability exceed the total purchase price paid by Buyer for the specific item in question. SECTION 11 - AUCTIONEER'S RIGHTS AND RESERVATIONS McGee Auctions and Auctioneer Holli McGee reserve the absolute and unconditional right, in their sole discretion, to: reject or refuse any bid from any Bidder for any reason or no reason; withdraw any lot from the auction at any time prior to or during the sale; rescind any sale for nonpayment, suspected fraud, disputed ownership, clerical error, or any other reason deemed appropriate; refuse to transfer any firearm to any person for any reason, including but not limited to suspicion that the transfer may be unlawful; set and enforce reserve prices on any lot; group, split, or re-lot items at any time; and resolve any dispute regarding bidding, including the right to re-offer any disputed lot. SECTION 12 - INDEMNIFICATION AND HOLD HARMLESS BUYER AGREES TO RELEASE, INDEMNIFY, DEFEND, AND HOLD HARMLESS MCGEE AUCTIONS, HOLLI MCGEE, AND THEIR RESPECTIVE OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, HEIRS, SUCCESSORS, ASSIGNS, AND REPRESENTATIVES (COLLECTIVELY, THE "INDEMNIFIED PARTIES") FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LAWSUITS, JUDGMENTS, DAMAGES, LOSSES, COSTS, PENALTIES, FINES, LIABILITIES, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES AND COURT COSTS) ARISING FROM OR RELATING TO: (i) Buyer's purchase, receipt, possession, ownership, storage, display, transfer, transportation, modification, or use of any item purchased at auction; (ii) Any breach of these Terms and Conditions by Buyer; (iii) Any violation of applicable federal, state, or local law by Buyer; (iv) Any injury, death, or property damage caused by or related to any item purchased; (v) Any dispute between Buyer and any third party (including receiving FFL dealers, carriers, or other Bidders); (vi) Any misrepresentation, false certification, or fraud committed by Buyer. This indemnification obligation shall survive the completion of any transaction, the transfer of any item, and the termination of any relationship with McGee Auctions. Buyer's indemnification obligation is not contingent upon or limited by the availability or coverage of any insurance. SECTION 13 - LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MCGEE AUCTIONS OR ANY INDEMNIFIED PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, PERSONAL INJURY, PROPERTY DAMAGE, OR ANY OTHER DAMAGES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF MCGEE AUCTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE AGGREGATE LIABILITY OF MCGEE AUCTIONS AND ALL INDEMNIFIED PARTIES FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO ANY TRANSACTION UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL PURCHASE PRICE ACTUALLY PAID BY BUYER FOR THE SPECIFIC LOT GIVING RISE TO THE CLAIM. SECTION 14 - DEFAULT, STORAGE, AND ABANDONED PROPERTY 14.1 - Default A Buyer shall be in default if: payment is not received within seventy-two (72) hours of auction close; Buyer fails to complete required transfer paperwork within fourteen (14) calendar days of notification; Buyer fails to arrange pickup or shipping within thirty (30) calendar days of payment; or Buyer provides false information on ATF Form 4473 or any other document. 14.2 - Consequences of Default Upon default, McGee Auctions may, at its sole discretion and without further notice: report Buyer to HiBid and bar Buyer from all future McGee Auctions sales; resell the item at public or private sale; hold Buyer liable for any deficiency between the original purchase price and the resale price, plus all costs of resale; retain any amounts previously paid as liquidated damages; report nonpayment to applicable credit reporting agencies; and pursue all available legal remedies. 14.3 - Storage Fees Items not picked up or shipped within thirty (30) calendar days of payment (or, for NFA items, within thirty (30) calendar days of ATF approval, subject to the twelve-month grace period in Section 8.6) shall incur a storage fee of [INSERT AMOUNT] per item per month, or any portion thereof. All storage fees must be paid before the item will be released. 14.4 - Abandoned Property Any item not claimed within ninety (90) calendar days of the payment deadline (or, for NFA items, ninety (90) calendar days following ATF approval) shall be deemed abandoned property. McGee Auctions may dispose of abandoned property in any lawful manner, including resale at public or private auction, without further notice to Buyer and without any obligation to account to Buyer for the proceeds. All storage fees, Buyer's Premium, and other amounts owed shall be deducted from any proceeds prior to remittance (if any) to Buyer. Buyer shall remain liable for any deficiency. SECTION 15 - DISPUTE RESOLUTION 15.1 - Good Faith Negotiation The parties shall first attempt to resolve any dispute arising from or relating to these Terms through good faith negotiation for a period of not less than thirty (30) calendar days. 15.2 - Mediation If negotiation is unsuccessful, the parties agree to submit the dispute to non-binding mediation administered by a mutually agreed-upon mediator in [INSERT COUNTY] County, South Carolina, prior to initiating arbitration or litigation. 15.3 - Binding Arbitration IF MEDIATION IS UNSUCCESSFUL, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING FROM OR RELATING TO THESE TERMS AND CONDITIONS, OR THE BREACH, TERMINATION, OR INVALIDITY THEREOF, SHALL BE FINALLY RESOLVED BY BINDING ARBITRATION ADMINISTERED UNDER THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION. THE ARBITRATION SHALL BE CONDUCTED BY A SINGLE ARBITRATOR IN [INSERT COUNTY] COUNTY, SOUTH CAROLINA. BUYER HEREBY WAIVES ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST MCGEE AUCTIONS. 15.5 - Jury Trial Waiver TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BUYER AND MCGEE AUCTIONS EACH IRREVOCABLY AND UNCONDITIONALLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING FROM OR RELATING TO THESE TERMS AND CONDITIONS. 15.6 - Attorneys' Fees In any dispute resolution proceeding (whether negotiation, mediation, arbitration, or litigation), the substantially prevailing party shall be entitled to recover its reasonable attorneys' fees, costs, and expenses from the non-prevailing party. Any party who commences litigation without first complying with the mediation and arbitration requirements of this Section shall not be entitled to recover attorneys' fees regardless of outcome. ? SECTION 16 - PROHIBITED ITEMS AND RESTRICTED SALES McGee Auctions will not sell: Teflon-coated ammunition or armor-piercing ammunition as prohibited under South Carolina Code § 16-23-520 and 18 U.S.C. § 922(a)(7)-(8); any firearm with an obliterated, altered, or removed serial number as prohibited under 18 U.S.C. § 922(k) and S.C. Code § 16-23-30(C); stolen property of any kind; and any item whose sale would constitute a violation of federal, state, or local law. If any item is determined after sale to fall into a prohibited category, the sale shall be rescinded and any amounts paid shall be refunded less Buyer's Premium and fees incurred. SECTION 17 - STATE AND LOCAL LAW COMPLIANCE IT IS THE BUYER'S SOLE AND ABSOLUTE RESPONSIBILITY TO KNOW, UNDERSTAND, AND COMPLY WITH ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS, ORDINANCES, AND REGULATIONS GOVERNING THE PURCHASE, POSSESSION, TRANSFER, TRANSPORTATION, STORAGE, AND USE OF FIREARMS, AMMUNITION, MAGAZINES, AND ACCESSORIES IN THE BUYER'S JURISDICTION. McGee Auctions makes no representation or warranty regarding the legality of any item in any jurisdiction other than the State of South Carolina. ATF Form 4473 records and Acquisition and Disposition (A&D) book entries are retained for the lifetime of the FFL license as required by 27 C.F.R. § 478.129. Personal information will not be sold, shared, or disclosed to any third party except as required by law, court order, or lawful government inquiry, or as necessary to complete the transaction (e.g., providing Buyer information to a receiving FFL for transfer purposes). SECTION 19 - GOVERNING LAW AND JURISDICTION These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of laws principles.
