*All items are sold "as is" , "where is" without guarantees of any kind, expressed or implied. All descriptions advertised are believed to be correct but never guaranteed, descriptions state only what can be visibly seen during an inspection. No statement by auctioneer or Winstead's Auction Co. employee or associate shall be considered a warranty; it is only an opinion and should not be considered a guarantee of authenticity. All items should be examined and inspected closely before bidding. The bidder hereby agrees to accept any item the way it is and has to use his/her own judgment whether bidding live, online, by phone, or by absentee. Buyers are advised to hire an expert to inspect items prior to bidding. For vehicles or machinery buyers are advised to hire a mechanic to inspect vehicles/machinery prior to bidding. Buyers are responsible for verifying all hours and miles.

*By bidding you signify that you have examined the item, chosen not to examine the item, or have hired an independent agent to examine the item for you.

* All items are to be paid for the day of the auction. No item is to be removed from the auction premises until it is paid for in full. Payment must be made within 24 hours of the close of the auction.

*Sales tax will be added to each item unless you are a dealer and provide a valid tax-exempt number.

* By registering and receiving a bidder's number or participating by absentee, phone, or online bidding at Winstead's Auction Company you are agreeing to all of the terms of the auction.

*Bidder understands that the Internet service may or may not function correctly the day of the auction. Under no circumstances shall the Bidder have any kind of claim against Winstead's Auction Co or anyone else if the internet service fails to function properly before or during an auction. Internet bidders who desire to make certain their bid is acknowledged should use the proxy / max bidding feature and leave their maximum bid at least 24 hours before the auction closes.

* Winstead’s Auction Company reserves the right to change the dates, withdraw or re-catalog items in any auction.

* Any Statement / Information Regarding Pick-up Location, Time, or Shipping, in the current auction listing takes precedence over auction terms.

* All sales will have an 18% buyer's premium fee added to total amount.

*Cash accepted upon pick up of items, with prior approval from auction company. Personal/Business checks accepted with prior approval from auction company. All payments should be made within 24 Hours of the close of the auction. Any unpaid invoices will result in revocation of bidding privileges.

*Items may be picked up in person at Winstead's Auction, unless advertised otherwise. Items advertised as onsite pickup must be removed from the location on advertised pickup day only. Failure to pick up items on designated date and time will result in forfeiture of items without refund. Items in our building must be picked up within 14 of close of the auction. Any items not picked up will be forfeited by the buyer without a refund. Shipping arrangments may be made with a third party shipper. Winstead's auction reserves the right to deem any item as too large or fragile to ship. The Buyer assumes all responsibility for items shipped, Winstead's Auction is not responsible for items damaged in transit. Buyer assumes responsibility for any insurance claims for damaged shipments. Winstead's Auction will gladly accommodate pick-up from pre-paid outside shipping services (i.e. U-Ship, Fed-Ex, UPS).
