By bidding at this simulcast auction (in-person or online), you agree to the following terms and conditions.

1. All Sales Final
All items are sold as-is, where-is with no guarantees or warranties expressed or implied. Online bidders acknowledge they are bidding without physical inspection and accept full responsibility for their purchases.

2. Registration Required

In-Person Bidders: Must register with valid ID and obtain a bidder number before bidding.
Online Bidders: Must complete online registration at bidburgesss.com with valid payment method on file prior to bidding.
3. Buyer's Premium & Payment Terms
A 15% buyer's premium will be added to all winning bids (in-person and online). We accept cash, approved checks, and major credit cards. In-person purchases must be paid in full on the day of sale. Online purchases must be paid within 48 hours of auction close.

4. Sales Tax
Indiana sales tax will be collected unless a valid exemption certificate is provided at registration.

5. Online Bidding Platform
Burgess Auctions uses bidburgesss.com for online bidding. Bidders are responsible for understanding the platform's features including proxy bidding, bid increments, and lot closing times.

6. Internet & Technology
Burgess Auctions is not responsible for internet connectivity issues, platform outages, or technical difficulties that prevent online bidding. Bidders should test their connection and equipment prior to the auction.

7. Bidding Priority & Disputes
In-person and online bids are accepted equally. In the event of a dispute between bidders, the auctioneer's decision is final. The auctioneer reserves the right to accept or reject any bid.

8. Item Pickup & Shipping

In-Person Buyers: Items become your responsibility at the fall of the hammer and must be removed the day of sale unless prior arrangements have been made.
Online Buyers: Items must be picked up within 7 days of auction close at our facility during posted hours, OR shipping can be arranged at buyer's expense. Burgess Auctions can provide shipping quotes but is not responsible for items once transferred to carrier.
9. Announcements Take Precedence
Any announcements made from the auction block or posted in the online catalog take precedence over all other materials.

10. Liability Waiver
Burgess Auctions is not liable for accidents, theft, injury, or item damage. Online bidders acknowledge they have not physically inspected items and accept all risk.

11. Firearms (If Applicable)
All firearm sales comply with federal and state law through our licensed FFL. Online firearm buyers must complete transfer through a local FFL of their choice. Buyer must be legally eligible to purchase. Shipping restrictions apply.

12. Account Suspension
Failure to pay or pick up items may result in account suspension and legal action to collect payment plus fees.
