BUYER'S PREMIUM: A 10% buyer's premium will be added to each purchase. If you bid $100.00, you will be charged $110 at checkout.

PAYMENT: Accepted forms of payment include Visa, MasterCard, Discover (for purchases under $2,000), Cash, Cashier's Check, Money Order, or Wire Transfer. Vehicle assets must be paid using cash, certified check, or wire transfer. Payment must be made prior to picking up any items. Personal/Business Check accepted with prior approval.

STAGGERED/GROUP/DYNAMIC CLOSING: The auction will begin closing at 11:00 AM on Thursday, March 5, 2026. This auction's closing will end as one lot closing every three minutes. The closing of a lot or group of lots will be automatically extended by three minutes whenever a bid is placed within the last three minutes of the lot's closing time, and will continue to be extended until the timer runs out. 

We utilize scheduled load-out by appointment. We will send an email to all winning bidders with a link to schedule an appointment after the auction. Buyers MUST schedule a loadout appointment time!!

LOAD OUT: Winning bidders may pick up their items at (Address on Invoice), Oxford, Kansas, or Wellington, Kansas, by appointment only during the published load-out times. Load Out will be held on Thursday, March 5, 2:00 to 5:00 pm, and Friday, March 6, 10:00 am to 1:00 pm, by scheduled appointment only. Any items left after the specified load-out dates will be considered forfeited unless alternate pickup or shipping arrangements are made. It will be the buyer's responsibility to dismantle & disconnect any and all equipment. Please bring your own tools, labor, packing materials & moving equipment. Excavators can be driven onto your trailer. CONTAINER PICKUP: By appointment and AFTER all excavators have been picked up. If the buyer needs the use of a crane to load, there will be a $400 fee for the operator.

WARRANTY & CONDITION OF ITEMS SOLD: All items are sold 'AS IS, WHERE IS, with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items and bid accordingly. Items part of a court-ordered sale are subject to court approval.

CAUTION: For demonstration purposes, various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.

CATALOG DISCREPANCIES: You are bidding on the described item, not the photograph; the wrong photo may be displayed. Always read the item description.

CHOOSE WISELY: We want everyone to get a good deal, and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness, or suitability for intended use, please bid accordingly.

Server & Software Technical Issues: In the event that there are technical difficulties related to the server, software, or any other online auction-related technologies, Theurer Auction/Realty reserves the right to extend bidding, continue the bidding, or close the bidding.

NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR THEURER AUCTION/REALTY SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by Theurer Auction/Realty.

The auctioneer reserves the right to add or remove items from the auction; split or combine lots; add minimum bids or reserve prices. The auctioneer reserves the right to cancel, suspend, extend or reschedule an individual item and or auction event or to make changes to the auction closing times or inspection or removal times.

📦Load-out days for this auction will be Thursday, March 5, from 2 PM to 5 PM, and Friday, March 6, from 10 AM to 1 PM, by appointment only. Load-out will be Friday, March 6, 12 PM to 2 PM for the container only. ($400 fee for loading the container onto the buyer's trailer/truck)

💲Any invoice over $2,000 must be paid with certified funds, such as Cash, Cashier's Check, Money Order, or Wire Transfer. Payment must be made before picking up any items.

• If you are unable to manage your bids during the closing, we encourage you to use our MAX BID feature. The system will bid for you up to your max bid amount. Your max bid is confidential and only known to you. If the bid does not reach the max bid amount, you will be the winning bidder at your last competitive bid. 

These mini excavators are brand new; however, Theurer Auction/Realty has not inspected or verified the fluid levels, including fuel, oil, hydraulic fluid, or coolant. Bidders are strongly encouraged to inspect the equipment and conduct their own due diligence before operating.
