Mike Nichols Auctions has endeavored to accurately describe all items being sold but all property offered in this auction is strictly "as is" and is the bidder's responsibility weather bidding in person, by mail, telephone, or on the internet to determine exact condition of each item. No statement in our catalog, bill of sale, invoice, or elsewhere by any representative of a person in the employment of Mike Nichols Auctions shall be deemed to be a warranty, representation, or assumption of liability with respects to age, condition, size, quality, variety, importance, provenance, or historical relevance of any of these items. Any such statements are strictly matters of opinion. Descriptions have been prepared for guide purposes only and shall not be relied upon by Buyer for accuracy or completeness. By submitting a bid, Buyer/Bidder affirms it has inspected all items or has waived its right to do so prior to bidding. Buyers shall be deemed to have relied entirely upon their own inspections and investigations. The auctioneer will be the final judge as to which bidder is the highest bidder. Once the Auctioneer has said sold, the item cannot be reopened for bidding. Title to all merchandise shall pass to the highest bidder at the fall of the Auctioneer's "hammer". The purchaser shall assume full risk & responsibility for the lot purchased once the title has passed. All accounts are to be settled the day of the auction unless arrangements have been previously arranged with Mike Nichols (phone # 1-501-590-9755) Payments may be made by cash, credit card, cashier's check, money order, or a personal check if approval has made with Mike Nichols accompanied with authorization guaranteeing it. Visa, Discover, Mastercard, & Square is Accepted there is a 3.5% fee for credit card use. Photos are of the actual objects being sold but exact condition is the condition on the sale day. No returns will be accepted. You may bid by phone, absentee, or live internet. Mike Nichols Auctions will not be responsible for any errors or failures in executing bids of any kind due to technical or other failure associated with an internet auction. 25% buyer's premium. Any announcements made on the day of the auction take precedence over catalogue or other previously announced or documented information, but do not alter in any way the basic terms and conditions of sale. We reserve the right to correct any mistakes or typographical errors made on its behalf in any of its announcements or documents. If Auctioneer is unable to deliver an article sold to Buyer due to fire, theft, or any other reasons whatsoever, Auctioneer shall reimburse Buyer for all monies paid to Auctioneer in respect to the article and Auctioneer shall have no further liability to the purchaser arising from or relating to such loss, including without limitation any damages for loss of profits. In no event shall Auctioneer's liability to Buyer exceed the purchase price actually paid. A Buyer's claim shall be limited to the amount paid for the merchandise, and shall not extend to any obligation; risk; liability; right; claim; remedy for loss of use, revenue or profit; liability of Buyer to any third party; personal injury; or any other direct, indirect, incidental or consequential damages. A successful bid at auction constitutes a legally binding contract of sale. Auctioneer reserves the right to refuse any applicant the privilege of bidding or attending the auction and may revoke such privilege of bidding or attending the auction AT ANY TIME. This sales transaction shall be governed by and construed in accordance with the local laws of the State of Arkansas, USA. If any provision of these Terms and Conditions shall be held invalid, illegal, unenforceable or inoperative, the balance of Terms and Conditions shall remain in full force and affect as if such provisions had not been included. These Terms and Conditions with any amendments or modifications expressly made by Auctioneer at the time of the auction constitute all the terms and conditions with respect to the sale of articles at this auction. There are no representations, warranties, terms, conditions, undertakings or collateral agreements except as herein provided. All Buyers acknowledge and accept by their bid at auction the Terms and Conditions of Sale contained here within. Artifact Collections come in from multiple dealers & consignors from across the Country. A lot of times little is known about each item. If you do not pick up within 2 weeks, the property will transfer to the auctioneer & be sold again. Buyer Pays All Shipping & handling Cost which will be $15 for first arrowhead $3.50 per additional arrowhead, $25 for hardstone, $45 per piece of pottery. we know this may seem high, but our goal is to make sure your pottery gets to you in one piece, it has survived this long without being broken & I want to make sure the post office isn't the one who breaks it. I will combine shipping, when possible, I want everyone to be happy with our auction service.
