2026 Auction Terms & Condition

All Bidders acknowledge to have read, comprehend, and agree to the following terms & conditions set forth by Jeff Boone Auction & Realty. ("Boone Auctions"). All bidders agree to be legally bound to these terms & conditions. All announcements made by the Auctioneer shall supersede any printed material.

Boone Auctions reserves the right to deny and or terminate bidding privileges at any time.

Buyers: Once invoiced, you have 24 hours to contact Boone Auctions to notify of payment arrangements. Please note that any purchase is subject to automatically be charged to your credit card on file. If you prefer to pay another way, please contact us immediately following the Auction with your bidder number and invoice number to inform us on your payment & pickup details, by emailing us at JeffBooneAuctions@gmail.com. Boone Auctions has the right to charge your card on file if no communication has been made on payment preference.

Payment Terms: Cash & Check accepted with no extra fee - Wire Transfer accepted with a $20 fee from the Auction company that will be added to your invoice before payment - Credit & Debit Cards accepted with a 3.99% charge in addition to the purchased amount. This applies to onsite and Internet bidders.

For successful Buyers, A 12% buyers premium will be charged to the total invoice price.

7% Indiana State Sales Tax will be charged unless proof of exemption is provided. All titled items will be charged sales tax at the rate of where your vehicle will be titled up to a max of 7% unless purchased by a registered dealer. This applies to in state and out of state purchasers.

All bidders understand that they will be liable for payment of sales or use taxes which may become due for failure to comply with the provisions of federal, state, and local tax codes for any items sold as tax exempt or for resale. All bidders understand that it is a criminal offense to give an exemption certificate to the seller for taxable items that they know, at the time of purchase, will be used in a manner other than that expressed in this certificate and, depending on the amount of tax evaded, the offense may range from a class c misdemeanor to a felony of the second degree.

Attention! Purchaser Pick-Up times are as follows - One Day Pickup: Tuesday, April 7th from 9 AM to 5 PM

Due to other upcoming Auctions that we need to prepare for, items must be picked up during these times. Any items not picked up during these times will be set outside, and subject to be sold or discarded. The Auction company is not responsible for lost, stolen, or damaged items. It is the buyers responsibility to insure purchases as needed immediately.

All items must be paid for by Tuesday, April 7th @ 5 PM unless prior arrangements have been made. Any unpaid bills will result in revoked bidding privileges/immediate legal action.If mailing a check for payment, buyer must send priority mail with a tracking number.

There will be a Titled Vehicle Entry Fee added to all Titled items $20 Paid by Seller & $40 Paid by the Buyer. Fee includes: Title processing (paperwork filled out and documents needed to take to your local BMV), and USPS Priority Mail (with tracking number) delivery, if applicable. Cash buyers on titled items may take the title upon payment if the title is present. Those paying with checks will receive title upon check clearing. For items noted �Title to Arrive�, titles may take up to 30 days to come in if obtaining from a lender, and or waiting to receive from the BMV. Boone Auctions will secure titles and distribute as soon as possible for each titled item. Items that say "Title to Arrive" or "Title Present" will have a title. If it does not mention a title, assume that there is not one, and that is how that item is being sold.

Immediately when an item is Sold it becomes the property and responsibility of the Buyer. All items sell �AS-IS� �Where-Is� with no warranties or guarantees by the Seller(s) or the Auction company. All sales are Final. The described condition or representation of hours, use, and miles is provided as a courtesy, and not guaranteed by the Seller(s) or the Auction company. The Bidder is responsible for determining his or her opinion of the condition, and authenticity of an item before purchasing the item, not after. It is the buyers responsibility to inspect the item of interest prior to bidding on it. Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. (Boone Auctions) shall endeavor to describe in detail each item and any pertinent information about it. After a bidder has won the bid, all risk of loss and damage passes to the bidder, even though the bidder may have not paid for the item yet. Buyers should guard their items accordingly. The Seller(s) and the Auction Company and all of its Associates are not responsible for loss, theft, damages, or accidents.

By placing bids you agree to follow all of the terms and conditions, agree to make payment, and to take possession of purchased items. Although we strive to provide the best internet connections and software available, please understand that internet speeds and reliability will vary.

The Auction company is not responsible for lost connection or software failures that result in lost or unaccepted bids. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against (Boone Auctions) or anyone else if the Internet service fails to work correctly before or during the live auction. (Boone Auctions) will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should leave their maximum bid 24 hours before the auction begins, and confirm with the auction company if the bidder has any doubts about the process. Do not hesitate to bid or wait until the final seconds. This will be a fast paced auction and quick bidding will be required.

All online bidders are responsible for complete control of their online bidding accounts. You are 100% responsible for every bid placed under your account, accidental and intentional. Online bidding is a serious matter. You must understand exactly what you are doing at all times.

Although we strive to do this as little as possible, (Boone Auctions) reserves the right to withdraw or re-catalog items at any time.

Boone Auctions will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as-is and that they may not return any item they purchase.

Auctions Terms of Sale and Conditions
Auction Date: Monday, April 6th @ 5 PM EST
1. There is a 3% buyers premium charged to the final bid price of the Real Estate.
2. Property sells with the confirmation of the sellers.
3. $20,000 non-refundable deposit is required on Tuesday, Apri 7th via check made payable to Jeff Boone Realty. This payment will be held in a non interest bearing account and applied toward the purchase price at a successful closing. This is a nonrefundable deposit unless by default of the Seller(s). The sale of the real estate is not contingent on financing, so it is advised that the purchaser make financial arrangements prior to bidding. The balance of the purchase price is due in cash at closing via a wire transfer or as required by the Title Company.
4. Real Estate Closing to take place within 45 days of auction or when insurable title is available.
5. A Title Insurance Policy will be issued by a company of the auctioneer�s choice. Seller and purchaser will split closing costs of sale 50/50. Any cost associated with purchaser financing is at the expense of the purchaser only.
6. Any surveys requested or required are to be at the expense of the buyer(s). When the new survey is ordered, the survey will be ordered by the Auction Company or its designated agent, and will be for the perimeter only. No information, data, or discussion is permitted by the surveyor and the buyer(s) or buyer(s) agent without authorization from the seller, auction company, or real estate broker.
7. Possession of the house and property will be at closing.
8. Taxes will be prorated to the day of closing.
9. If Separate owners are represented at this auction, then the terms and conditions apply to all parcels. Bidding increments are at the discretion of the auctioneer and may vary.
10. All Real Estate and property is sold As-Is without any warranty. Agent and Seller(s) make no assurances to the ability to obtain any zoning or building permits of any kind. Your bids are to be based solely upon your inspection. The sellers, auction company, real estate broker, and their representatives make NO warranty with regard to zoning classifications, specific purpose or use restrictions, easements or deed restrictions, availability or location of utilities; availability of building, driveway, water or septic permits; or any information or materials provided by any third party regarding the auction property.
11. Parcels will be sold by the dollar and not by the acre. Parcels were created by using the County Beacon GIS online mapping website and acreage amounts are approximate and as accurate as the system will allow. Parcel acreages are not guaranteed and no price adjustments will be made for variations in amounts.
12. The Auction company, Broker, or owner(s) are not responsible for accidents. Information has been provided via various printed and electronic media for the bidders�/potential buyers� review. Although this information is deemed to be reliable, it is NOT guaranteed, and should NOT be substituted for the bidders�/potential buyers independent verification and investigation of the property. The auction company and its agents including real estate broker(s) disclaim any warranty or liability for information provided.
13. At the close of the auction or within 24 hours of its completion, the high bidder(s) will be required to execute a purchase contract in the form of the Agreement to Purchase Real Estate, Addendum A, and if applicable(Lead Based Paint Disclosure, and Sellers Residential Real Estate Disclosure). These terms and documents are non-negotiable. Time is of the essence. All terms and conditions of the Agreement to Purchase Real Estate and Addendum A shall survive the closing. 2026 Auction Terms & Condition All Bidders acknowledge to have read, comprehend, and agree to the following terms & conditions set forth by Jeff Boone Auction & Realty. ("Boone Auctions"). All bidders agree to be legally bound to these terms & conditions. All announcements made by the Auctioneer shall supersede any printed material. Boone Auctions reserves the right to deny and or terminate bidding privileges at any time. Buyers: Once invoiced, you have 24 hours to contact Boone Auctions to notify of payment arrangements. Please note that any purchase is subject to automatically be charged to your credit card on file. If you prefer to pay another way, please contact us immediately following the Auction with your bidder number and invoice number to inform us on your payment & pickup details, by emailing us at JeffBooneAuctions@gmail.com. Boone Auctions has the right to charge your card on file if no communication has been made on payment preference. Payment Terms: Cash & Check accepted with no extra fee - Wire Transfer accepted with a $20 fee from the Auction company that will be added to your invoice before payment - Credit & Debit Cards accepted with a 3.99% charge in addition to the purchased amount. This applies to onsite and Internet bidders. For successful Buyers, A 12% buyers premium will be charged to the total invoice price. 7% Indiana State Sales Tax will be charged unless proof of exemption is provided. All titled items will be charged sales tax at the rate of where your vehicle will be titled up to a max of 7% unless purchased by a registered dealer. This applies to in state and out of state purchasers. All bidders understand that they will be liable for payment of sales or use taxes which may become due for failure to comply with the provisions of federal, state, and local tax codes for any items sold as tax exempt or for resale. All bidders understand that it is a criminal offense to give an exemption certificate to the seller for taxable items that they know, at the time of purchase, will be used in a manner other than that expressed in this certificate and, depending on the amount of tax evaded, the offense may range from a class c misdemeanor to a felony of the second degree. Attention! Purchaser Pick-Up times are as follows - One Day Pickup: Tuesday, April 7th from 9 AM to 5 PM Due to other upcoming Auctions that we need to prepare for, items must be picked up during these times. Any items not picked up during these times will be set outside, and subject to be sold or discarded. The Auction company is not responsible for lost, stolen, or damaged items. It is the buyers responsibility to insure purchases as needed immediately. All items must be paid for by Tuesday, April 7th @ 5 PM unless prior arrangements have been made. Any unpaid bills will result in revoked bidding privileges/immediate legal action.If mailing a check for payment, buyer must send priority mail with a tracking number. There will be a Titled Vehicle Entry Fee added to all Titled items $20 Paid by Seller & $40 Paid by the Buyer. Fee includes: Title processing (paperwork filled out and documents needed to take to your local BMV), and USPS Priority Mail (with tracking number) delivery, if applicable. Cash buyers on titled items may take the title upon payment if the title is present. Those paying with checks will receive title upon check clearing. For items noted �Title to Arrive�, titles may take up to 30 days to come in if obtaining from a lender, and or waiting to receive from the BMV. Boone Auctions will secure titles and distribute as soon as possible for each titled item. Items that say "Title to Arrive" or "Title Present" will have a title. If it does not mention a title, assume that there is not one, and that is how that item is being sold. Immediately when an item is Sold it becomes the property and responsibility of the Buyer. All items sell �AS-IS� �Where-Is� with no warranties or guarantees by the Seller(s) or the Auction company. All sales are Final. The described condition or representation of hours, use, and miles is provided as a courtesy, and not guaranteed by the Seller(s) or the Auction company. The Bidder is responsible for determining his or her opinion of the condition, and authenticity of an item before purchasing the item, not after. It is the buyers responsibility to inspect the item of interest prior to bidding on it. Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. (Boone Auctions) shall endeavor to describe in detail each item and any pertinent information about it. After a bidder has won the bid, all risk of loss and damage passes to the bidder, even though the bidder may have not paid for the item yet. Buyers should guard their items accordingly. The Seller(s) and the Auction Company and all of its Associates are not responsible for loss, theft, damages, or accidents. By placing bids you agree to follow all of the terms and conditions, agree to make payment, and to take possession of purchased items. Although we strive to provide the best internet connections and software available, please understand that internet speeds and reliability will vary. The Auction company is not responsible for lost connection or software failures that result in lost or unaccepted bids. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against (Boone Auctions) or anyone else if the Internet service fails to work correctly before or during the live auction. (Boone Auctions) will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should leave their maximum bid 24 hours before the auction begins, and confirm with the auction company if the bidder has any doubts about the process. Do not hesitate to bid or wait until the final seconds. This will be a fast paced auction and quick bidding will be required. All online bidders are responsible for complete control of their online bidding accounts. You are 100% responsible for every bid placed under your account, accidental and intentional. Online bidding is a serious matter. You must understand exactly what you are doing at all times. Real Estate Terms & Conditions: Todd Estate - Real Estate & Personal Property Auction Property Address: 4351 N County Road 575 W Middletown, IN 47356 �Addendum A� Auctions Terms of Sale and Conditions Auction Date: Monday, April 6th @ 5 PM EST 1. There is a 3% buyers premium charged to the final bid price of the Real Estate. 2. Property sells with the confirmation of the sellers. 3. $20,000 non-refundable deposit is required on Tuesday, Apri 7th via check made payable to Jeff Boone Realty. This payment will be held in a non interest bearing account and applied toward the purchase price at a successful closing. This is a nonrefundable deposit unless by default of the Seller(s). The sale of the real estate is not contingent on financing, so it is advised that the purchaser make financial arrangements prior to bidding. The balance of the purchase price is due in cash at closing via a wire transfer or as required by the Title Company. 4. Real Estate Closing to take place within 45 days of auction or when insurable title is available. 5. A Title Insurance Policy will be issued by a company of the auctioneer�s choice. Seller and purchaser will split closing costs of sale 50/50. Any cost associated with purchaser financing is at the expense of the purchaser only. 6. Any surveys requested or required are to be at the expense of the buyer(s). When the new survey is ordered, the survey will be ordered by the Auction Company or its designated agent, and will be for the perimeter only. No information, data, or discussion is permitted by the surveyor and the buyer(s) or buyer(s) agent without authorization from the seller, auction company, or real estate broker. 7. Possession of the house and property will be at closing. 8. Taxes will be prorated to the day of closing. 9. If Separate owners are represented at this auction, then the terms and conditions apply to all parcels. Bidding increments are at the discretion of the auctioneer and may vary. 10. All Real Estate and property is sold As-Is without any warranty. Agent and Seller(s) make no assurances to the ability to obtain any zoning or building permits of any kind. Your bids are to be based solely upon your inspection. The sellers, auction company, real estate broker, and their representatives make NO warranty with regard to zoning classifications, specific purpose or use restrictions, easements or deed restrictions, availability or location of utilities; availability of building, driveway, water or septic permits; or any information or materials provided by any third party regarding the auction property. 11. Parcels will be sold by the dollar and not by the acre. Parcels were created by using the County Beacon GIS online mapping website and acreage amounts are approximate and as accurate as the system will allow. Parcel acreages are not guaranteed and no price adjustments will be made for variations in amounts. 12. The Auction company, Broker, or owner(s) are not responsible for accidents. Information has been provided via various printed and electronic media for the bidders�/potential buyers� review. Although this information is deemed to be reliable, it is NOT guaranteed, and should NOT be substituted for the bidders�/potential buyers independent verification and investigation of the property. The auction company and its agents including real estate broker(s) disclaim any warranty or liability for information provided. 13. At the close of the auction or within 24 hours of its completion, the high bidder(s) will be required to execute a purchase contract in the form of the Agreement to Purchase Real Estate, Addendum A, and if applicable(Lead Based Paint Disclosure, and Sellers Residential Real Estate Disclosure). These terms and documents are non-negotiable. Time is of the essence. All terms and conditions of the Agreement to Purchase Real Estate and Addendum A shall survive the closing.
