RES Auction Services BIDDING TERMS AND CONDITIONS 

By bidding you agree to all terms and conditions of this auction including, but not limited to: 

Buyer’s Premium: If bidding in-person, there is no Buyer’s Premium. If bidding through RES.bid, a 5% Buyer’s Premium will be applied to each purchase. If bidding through Equipment Facts, a 7% Buyer’s Premium will be applied to each purchase.
Payment Terms: All invoices must be paid by Wednesday, April 8th at 5:00PM. We accept cash, check, wire transfer, and credit cards (Up to $3,000). 5% Buyer’s Premium waved if paid by cash or check. All items must be paid in full before removal.

Bidder acknowledges that he/she has read, understands, and agrees to abide by the Terms and Conditions contained herein. 

Auctioneer reserves the right to add such Terms and Conditions to sale as announced or posted on day of the sale. 

Bidder cards may be denied to an applicant at any time, at the sole discretion of the Auctioneer. Auctioneer also reserves the right to terminate bidding privileges at any time. 

All items will be sold “As Is” “Where Is”.  

All sales are final. 

No guarantees or warranties whatsoever, implied, expressed, or otherwise. 

Auctioneer makes no representation or warranty of any kind on lots included in the auction. Auction listings are prepared based on information provided by the Consignor. It is the buyer’s responsibility to verify condition, descriptions, and hours/mileage of equipment. No sale shall be invalidated by inaccuracies, defects, damaged goods, or incorrect descriptions. 

It is Bidder’s responsibility to inspect equipment prior to bidding. 

Sales Tax Exemption: Tax exempt Buyers must present a current and valid exemption certificate at time of registration.   

Bidding disputes will be settled at the sole discretion of Auctioneer and Auctioneer may put the disputed lot up for sale again to be resold to the highest bidder of the disputing parties. The Auctioneer’s decision is final. 

Purchases become the responsibility of the high bidder immediately upon acceptance of his bid. They shall be and remain at the risk of the Buyer. It is the Buyer’s responsibility to insure his purchases immediately. 

No removal of purchases from the auction site will be allowed until stated load out time. 

Buyer must pay for all items purchased before any items can be removed from auction facility. In order to remove all items from the RES Facility, including those that will be transported by third-party transportation services, the person picking up the items is required to provide a paid invoice.

Load Out: Items can be removed auction day until 3pm and also Monday April 6th from 1pm-5pm. After Monday April 6th removal will be by appointment only. All items must be paid in full before removing them from the premises.

Titles: Will be sent within 14 business days after payment in full via certified mail. A $15 title processing fee will be applied to each titled item on all applicable invoices. Titles for items with a reserve will not be available day of auction for items with reserves.

It is the Buyer’s responsibility to be aware of their local motor vehicle regulations pertaining to titles and registrations prior to purchase of a motor vehicle. Buyer is also advised to take notice of title information noted on each motor vehicle, in the catalog, and as announced by the auctioneer on sale day.

When you place a maximum bid, you are indicating the highest amount you are willing to pay for an item. The auction system will automatically submit bids on your behalf, beginning at the current bid amount and increasing only as necessary to maintain your position as the highest bidder, up to and not exceeding your stated maximum bid.

Please note the following:

You may win the item for less than your maximum bid if no other competing bids reach your maximum amount.
If you are already the high bidder at the increment immediately below your maximum bid, and another bidder places a bid equal to your maximum bid, the item may sell for the same amount as your maximum bid. This occurs because bidders cannot bid against themselves, and the auction system will not advance your bid beyond your stated maximum.
All bidding activity is handled automatically by the auction system and is designed to ensure fair and impartial bidding.
For example, your max bid is $200 and you are currently winning at $175. If someone places the next bid at $200, they will win that item because the next bid will be beyond your max bid.

Note: Mark your calendars for a good clean auction with well-kept equipment. We will start with shop and small uncatalogued items at 10am with the major equipment selling at 10:30 AM.  Online bidding is available for the equipment at www.RES.bid.

Preview: Equipment will be available for inspection on Friday April 3rd from 12pm-4pm.

Load Out: Items can be removed auction day until 3 pm and also Monday April 6th from 1pm-5pm. After Monday April 6th removal will be by appointment only.  All items must be paid in full before removing them from the premises.

Buyer’s Premium: If bidding in-person, there is no Buyer’s Premium. If bidding through RES.bid, a 5% Buyer’s Premium will be applied to each purchase. If bidding through Equipment Facts, a 7% Buyer’s Premium will be applied to each purchase.

Payment Terms: All invoices must be paid by Wednesday, April 8th at 5:00 PM. We accept cash, check, wire transfer, and credit cards (Up to $3,000). 5% Buyer’s Premium waved if paid by cash or check. All items must be paid in full before removal.
