Listing Terms and Conditions
Auction Terms & Conditions-Updated 1/2/2025
You are required to read and agree to all terms and conditions for this auction. (If you do not agree please do not register to bid.) All items are sold as is / where is! It is recommended that you attend the open house to familiarize yourself with the items you wish to purchase. (Example: color, size, shape, age, or overall condition). If there is no open house offered, please feel free to call us if there is a question about the condition of a lot prior to bidding. All bids are binding.

Registration:
Registration requires a credit card for verification and identification. At the conclusion of the auction these cards will be charged for all invoices under $3,000. The auction house will also use this card for the shipping charges if the item is requested to be shipped.

By registering for our online or live auctions you agree to all of our terms and conditions, an online registration will be considered a signed contract from the bidder who wishes to participate in our auction and that the bidder is accepting all of these terms & conditions. All registrations and bids are considered legal and binding.

Bidding:
Once you have registered now it's time to bid. Go to the view catalog. Click on an item inside the catalog that you wish to bid on. After reading the description you can now bid. Click on the "bid button". You can bid to the next increment or place a max bid. If you choose max bid the computer will bid for you up to your max amount. Preset bidding increments have been set up. As the price of an item increases the bid amount increments will increase. It is not necessary to enter a decimal point and zeros to your bid amount. The computer software will enter them for you. Some items will be sold "times the money". If it's a sold "times the money" item it will look like this "X5". Example: If an item sells for $2 dollars each and it is a X5 lot then the price will be $10. You can also bid live as the auction closes. 30 minutes before the auction closes click on "enter live auction" button. Place your bids as the increments increase.

Auction Closing:
Our Internet auctions use a "soft close" format. An item will close every 10 seconds after the beginning of an auction. This gives the bidder the opportunity to bid on more than one item. If there is an advance bid inside of 2 minutes to close the bidding, that item will be extended by 2 minutes. This process will continue until there is no more bidding activity.

Payment:
A 13% buyer's premium will be added to the final purchase price of each item. Payment is expected at the conclusion of the auction for all invoices under $3,000. We accept most major credit cards. All invoices over $3,000 will have the opportunity to pay with cash or check (with a 3% discount) at the time of pick-up. All items that are not picked up during the scheduled pick-up times will have a $20 no show fee added to the unpaid invoice. After 30 days, the items will be considered abandoned and resold. All monies will be retained by Bid-N-Buy Realty and Auctions, Inc. and any losses will be owed by the delinquent buyer.

Pick up information:
Pick up times are listed in the auction description, as well as the beginning lots of the auction. An appointment must be made to pick up your items.

Buyers will be charged for all items purchased whether you pick them up or not. It is your best interest to make an appointment during the scheduled pick up times.

Sales Tax: 8% New York State sales tax will be charged on all purchases and buyer's premium. If you are tax exempt, you must sign a resale or farm exempt form.

Shipping: We ship USPS and UPS. There is a $5 per box shipping charge added to each box shipped. We will accept credit card payment or a check for shipping. If you wish to pay with a check your items will be held until the check clears. If you wish to have your items shipped please respond to your emailed invoice at the conclusion of the auction and we will contact you if we have any questions.

NO STOP PAYMENT ORDERS OR CREDIT CARD CHARGEBACKS:
No stop payment orders or credit card chargebacks. Each bidder agrees that such bidder will not, under any circumstances, (i) issue a stop payment order with respect to any checks issued or in connection with the auction, or (ii) initiate a credit card chargeback with respect to any purchases at the auction. Each bidder further agrees that if, in violation of these terms and conditions, a stop payment order is issued or a credit card chargeback is initiated, these buyer terms & conditions will be conclusive evidence of the bidder's (i) waiver of any rights to issue a stop payment order or to initiate a credit card chargeback, and (ii) agreement not to issue a stop payment order or to initiate a credit card chargeback; and each bidder acknowledges and agrees that the auctioneers presentation of these bidder terms and conditions to the bank, credit card company, or other financial institutions against which a check was drawn or that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to, or for the account of auctioneer. If, in violation of these bidder terms and conditions, a bidder issues a stop payment order or initiates a credit card chargeback, such bidder, even if successful, will remain liable for all purchases made at the auction, and will be responsible for all costs and expense, including attorney's fees, incurred by or on behalf of auctioneer and/or seller in challenging the stop payment order or credit card chargeback and in collecting payment. Each bidder acknowledges and agrees that the covenant not to issue a stop payment order or initiate a credit card chargeback is a condition to the issuance of a bidder number to such bidder, and is being made as an inducement for the auctioneer to accept such bidder's bidder registration, to issue a bidder number, and to permit the bidder to bid at the auction. At the conclusion of the auction these cards will be charged for all invoices under $3,000. The auction house will also use this card for the shipping charges if the item is requested to be shipped. By registering for our online or live auctions you agree to all of our terms and conditions, an online registration will be considered a signed contract from the bidder who wishes to participate in our auction and that the bidder is accepting all of these terms & conditions. All registrations and bids are considered legal and binding. Bidding: Once you have registered now it's time to bid. Go to the view catalog. Click on an item inside the catalog that you wish to bid on. After reading the description you can now bid. Click on the "bid button". You can bid to the next increment or place a max bid. If you choose max bid the computer will bid for you up to your max amount. Preset bidding increments have been set up. As the price of an item increases the bid amount increments will increase. It is not necessary to enter a decimal point and zeros to your bid amount. The computer software will enter them for you. Some items will be sold "times the money". If it's a sold "times the money" item it will look like this "X5". Example: If an item sells for $2 dollars each and it is a X5 lot then the price will be $10. You can also bid live as the auction closes. 30 minutes before the auction closes click on "enter live auction" button. Place your bids as the increments increase. Auction Closing: Our Internet auctions use a "soft close" format. An item will close every 10 seconds after the beginning of an auction. This gives the bidder the opportunity to bid on more than one item. If there is an advance bid inside of 2 minutes to close the bidding, that item will be extended by 2 minutes. This process will continue until there is no more bidding activity. Payment: A 13% buyer's premium will be added to the final purchase price of each item. Payment is expected at the conclusion of the auction for all invoices under $3,000. We accept most major credit cards. All invoices over $3,000 will have the opportunity to pay with cash or check (with a 3% discount) at the time of pick-up. All items that are not picked up during the scheduled pick-up times will have a $20 no show fee added to the unpaid invoice. After 30 days, the items will be considered abandoned and resold. All monies will be retained by Bid-N-Buy Realty and Auctions, Inc. and any losses will be owed by the delinquent buyer. Pick up information: Pick up times are listed in the auction description, as well as the beginning lots of the auction. An appointment must be made to pick up your items. Buyers will be charged for all items purchased whether you pick them up or not. It is your best interest to make an appointment during the scheduled pick up times. Sales Tax: 8% New York State sales tax will be charged on all purchases and buyer's premium. If you are tax exempt, you must sign a resale or farm exempt form. Shipping: We ship USPS and UPS. There is a $5 per box shipping charge added to each box shipped. We will accept credit card payment or a check for shipping. If you wish to pay with a check your items will be held until the check clears. If you wish to have your items shipped please respond to your emailed invoice at the conclusion of the auction and we will contact you if we have any questions. NO STOP PAYMENT ORDERS OR CREDIT CARD CHARGEBACKS: No stop payment orders or credit card chargebacks. Each bidder agrees that such bidder will not, under any circumstances, (i) issue a stop payment order with respect to any checks issued or in connection with the auction, or (ii) initiate a credit card chargeback with respect to any purchases at the auction. Each bidder further agrees that if, in violation of these terms and conditions, a stop payment order is issued or a credit card chargeback is initiated, these buyer terms & conditions will be conclusive evidence of the bidder's (i) waiver of any rights to issue a stop payment order or to initiate a credit card chargeback, and (ii) agreement not to issue a stop payment order or to initiate a credit card chargeback; and each bidder acknowledges and agrees that the auctioneers presentation of these bidder terms and conditions to the bank, credit card company, or other financial institutions against which a check was drawn or that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to, or for the account of auctioneer. If, in violation of these bidder terms and conditions, a bidder issues a stop payment order or initiates a credit card chargeback, such bidder, even if successful, will remain liable for all purchases made at the auction, and will be responsible for all costs and expense, including attorney's fees, incurred by or on behalf of auctioneer and/or seller in challenging the stop payment order or credit card chargeback and in collecting payment.
